She raises concerns about the judge&#8217;s involvement in previous\u200b trials related \u200bto\u200d Trump, potentially\u2064 violating <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-rules-ca-gov-overstepped-his-authority-with-covid-order-issues-permanent-injunction-restraining-newsom-from-further-issuing-unconstitutional-orders\/\" title=\"Judge Rules CA Gov Overstepped His Authority with Covid Order, Issues Permanent Injunction Restraining Newsom From Further Issuing Unconstitutional Orders\">state laws<\/a> requiring random case assignments. If violations are found, she requests appropriate disciplinary action.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>House Republican Conference Chairwoman <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/elise-stefanik\/\" target=\"_blank\" rel=\"noreferrer noopener\">Elise Stefanik<\/a> (R-NY) is requesting an investigation into the judge overseeing <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2807778\/stefanik-files-judicial-complaint-after-trumps-gag-order-appeal-is-dismissed-in-new-york\/\" target=\"_blank\" rel=\"noopener\" title>Donald Trump\u2019s criminal case in New York<\/a>, pointing to his role in at least two other trials related to the former president in possible violation of state laws that dictate judges must be randomly assigned to cases. <\/p>\n<p><a href=\"https:\/\/www.scribd.com\/document\/737095543\/Stefanik-Random-Assignment-Complaint\" target=\"_blank\" rel=\"noopener\" title>In a letter<\/a> sent to the New York State Commission on Judicial Conduct on Tuesday, Stefanik requested the panel determine whether the appointment of Judge Juan Merchan\u00a0to Trump\u2019s hush money trial violates the Uniform Rules for New York State Trial Courts. Those rules dictate that judges must be assigned \u201cpursuant to a method of random selection authorized by the Chief Administrator\u201d \u2014something Stefanik suggests is being ignored in order to convict Trump.<\/p>\n<p>\u201cOne cannot help but suspect that the \u2018random selection\u2019 at work in the assignment of Acting Justice Merchan, a Democrat Party donor, to these cases involving prominent Republicans, is in fact not random at all,\u201d Stefanik wrote in the letter, which was also sent to Kay-Ann Porter Campbell, the inspector general of the New York State Unified Court System. \u201cIf Acting Justice Merchan or any other Justices of the Court are found to have violated these rules, I would hope that the Commission would subject them to the required discipline.\u201d<\/p>\n<p>Stefanik pointed to Merchan\u2019s current role overseeing Trump\u2019s hush money trial in New York, where the former president faces 34 counts of falsifying business records. The GOP chairwoman also cited Merchan\u2019s involvement in at least two other cases related to the former president, including the <a href=\"https:\/\/www.cnn.com\/2022\/12\/06\/politics\/trump-organization-fraud-trial-verdict\/index.html\" target=\"_blank\" rel=\"noopener\" title>Trump Organization\u2019s tax fraud trial<\/a> in 2022 as well as former Trump adviser Steve Bannon\u2019s <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2607510\/steve-bannon-indicted-after-surrendering-to-new-york-authorities\/\" target=\"_blank\" rel=\"noopener\" title><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-former-top-ftx-executives-plead-guilty-to-federal-charges-in-fraud-case\/\" title=\"BREAKING: Former Top FTX Executives Plead Guilty To Federal Charges In Fraud Case\">criminal fraud case<\/a>.<\/a><\/p>\n<p>\u201dIf justices were indeed being randomly assigned in the Criminal Term, the probability of two <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/white-house-denies-knowledge-of-new-york-times-gag-order\/\" title=\"White House Denies Knowledge Of New York Times Gag Order\">specific criminal cases<\/a> being assigned to the same justice is quite low, and the probability of three specific criminal cases being assigned to the same justice is infinitesimally small,\u201d Stefanik wrote. \u201cAnd yet, we see Acting Justice Merchan on all three cases.\u201d<\/p>\n<p>The complaint comes just one week after Stefanik submitted a separate complaint against Merchan, urging the judge to recuse himself from Trump\u2019s hush money trial over allegations his daughter is using the indictment for financial gain. <\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>Stefanik, a fierce Trump supporter who is vying for a chance to be his vice presidential pick, has filed several complaints in support of the former president, arguing Democrats are using his criminal trials to damage him politically as the GOP presidential nominee. <\/p>\n<p>It\u2019s not clear whether action will be taken on the complaint as closing arguments in Trump\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-big-problem-with-the-stormy-daniels-hush-money-case-against-trump\/\" title=\"The Big Problem With The Stormy Daniels Hush Money Case Against Trump\">hush money case<\/a> have already begun, meaning the trial could conclude as early as this week.
