The latest effort comes from The New York Times fabricating a flag controversy with a series of hysterical stories claiming Justice Samuel Alito is a far-right provocateur because of a pair of flags flown at his East Coast residences. Several Republican senators have joined in the criticism.<\/p>\n<p>Earlier this month, The New York Times <a href=\"https:\/\/www.nytimes.com\/2024\/05\/16\/us\/justice-alito-upside-down-flag.html\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> on an American flag that apparently flew upside down at the judge\u2019s home in Virginia. The flag, according to the paper, was flown amid the turbulent month of President Joe Biden\u2019s inauguration, when the banner of distress was sometimes used to depict tacit support for Republicans\u2019 efforts to \u201cStop the Steal.\u201d<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-46748794\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-48a500d968b60de1db8d70e0cf9c9d0d fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-48a500d968b60de1db8d70e0cf9c9d0d\"><\/div>\n<p>\u201cWhile the flag was up, the court was still contending with whether to hear a 2020 election case, with Justice Alito on the losing end of that decision,\u201d the Times reported. Now, later this spring, \u201cthe justices will rule on two climactic cases involving the storming of the Capitol on Jan. 6, including whether Mr. Trump has immunity for his actions.\u201d<\/p>\n<p>The court\u2019s upcoming decisions show why The New York Times is just now raising an issue with the banner more than three years later. The nine justices will soon issue opinions that threaten to strike at the heart of the Democrats\u2019 2024 campaign strategy. Those cases will determine whether former President Donald Trump enjoys a high enough degree of presidential immunity to escape far-left prosecution and whether the Department of Justice (DOJ) has the authority to confer excess prison time on Jan. 6 defendants. <\/p>\n<p>The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/justice-alito-becomes-latest-target-of-fabricated-controversies-to-delegitimize-scotus\/\" title=\"Fabricated Controversies Target Justice Alito, Undermining SCOTUS\">paper quoted supposed ethics experts<\/a> to discredit Justice Alito as an impartial juror, despite Alito\u2019s explanation that his wife, and not Alito himself, had raised the banner following a dispute with a neighbor over a profane anti-Trump sign.<\/p>\n<p>\u201cJudicial experts said in interviews that the flag was a clear violation of ethics rules, which seek to avoid even the appearance of bias, and could sow doubt about Justice Alito\u2019s impartiality in cases related to the election and the Capitol riot,\u201d the Times reported. <\/p>\n<div class=\"fdrlst__b89e9-e0003f47c5d98bd08a97473ad189d092 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-e0003f47c5d98bd08a97473ad189d092\"><\/div>\n<p>Federalist Senior Legal Correspondent Margot Cleveland, who spent decades as a permanent law clerk, where she developed an expertise in legal ethics, <a href=\"https:\/\/thefederalist.com\/2024\/05\/20\/i-researched-judicial-ethics-rules-for-years-heres-why-the-alito-recusal-calls-are-ridiculous\/\" target=\"_blank\" rel=\"noreferrer noopener\">explained<\/a> why the upside-down flag debacle doesn\u2019t require Alito to do anything.<\/p>\n<p>\u201cFor simplicity\u2019s sake, let\u2019s assume Mrs. Alito placed a \u2018Stop the Steal\u2019 sign in the front yard of the home she shares with her husband. Such a sign would qualify as political activity within the meaning of the various <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/i-researched-judicial-ethics-rules-for-years-heres-why-the-alito-recusal-calls-are-ridiculous\/\" title=\"After Extensive Research, Why Demanding Alito's Recusal Seems Absurd\">ethical codes governing judicial conduct<\/a>,\u201d Cleveland wrote. The sign, she added, \u201cwould clearly fit in the \u2018should not engage in other political activity\u2019 prohibition\u201d outlined in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dc-bar-panel-recommends-rudy-giuliani-lose-law-licence-over-2020-election-fraud-claims\/\" title=\"DC Bar Panel suggests revoking Rudy Giuliani's law license due to election fraud allegations.\">legal ethics rules<\/a>. \u201cBut it wasn\u2019t Justice Alito who hung the upside-down flag we are hypothesizing was instead a \u2018Stop the Steal\u2019 placard \u2014 it was Mrs. Alito. And the Code of Conduct does not govern a spouse\u2019s actions.\u201d<\/p>\n<p>Senate Republicans, however, still jumped on the media bandwagon to give CNN this <a href=\"https:\/\/www.cnn.com\/2024\/05\/21\/politics\/republican-senators-alito-upside-down-flag\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">headline<\/a>: \u201cKey GOP Senators Criticize Alito Over Upside-Down Flag Incident.\u201d The lawmakers who made objections to Alito\u2019s alleged misconduct include Utah\u2019s Mitt Romney, Lindsey Graham of South Carolina, and John Thune of South Dakota, who wants to be the next GOP Senate chief.<\/p>\n<p>\u201cI don\u2019t know how you explain that,\u201d Thune said of Alito\u2019s invented flag controversy. <\/p>\n<div class=\"fdrlst__b89e9-88e92b7bf9b2038cee2fdc4656c4fe88 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-88e92b7bf9b2038cee2fdc4656c4fe88\"><\/div>\n<p>\u201cIt creates a bad image,\u201d Graham said. \u201cIt created a situation that we\u2019re all talking about. So, yeah, I think it was a mistake.\u201d<\/p>\n<p>Romney encouraged lawmakers to \u201ctake a look at it.\u201d <\/p>\n<p>\u201cIt\u2019s very unfortunate,\u201d Romney said. <\/p>\n<p>The Times followed the initial flag story last week with an even more <a href=\"https:\/\/thefederalist.com\/2024\/05\/24\/the-most-dangerous-part-of-the-nyt-alito-flag-meltdown-is-the-politicization-of-patriotism\/\" target=\"_blank\" rel=\"noreferrer noopener\">hysterical piece<\/a> to rebrand an iconic banner from the American Revolution as an emblem of insurgency. On Tuesday, the Times reported that an \u201cAppeal to Heaven\u201d flag, also known as the Pine Tree flag, was flown outside Alito\u2019s New Jersey home on Long Beach Island last summer. <\/p>\n<p>\u201cTwo years after an upside-down American flag was flown outside the Virginia home of Justice Samuel A.
