Following‌ an incident at ⁣a ⁣Philadelphia Planned Parenthood clinic, he was detained ‌at gunpoint in front of his family. Houck, a Catholic father based in Pennsylvania, was acquitted by a jury in January 2023 and has⁢ now filed a lawsuit against the Department of Justice.

The lawsuit, filed this ‌week, accuses the DOJ under‌ the Biden administration of ⁢various ⁤charges, including malicious prosecution, retaliatory ⁣prosecution, and abuse of process. The complaint specifically ‌calls out six police officers, all of‍ whom were involved in the raid on Houck’s home ⁣which his⁣ attorney,⁢ Matt Britton, describes as “needless”.

The charges Houck faced ⁣in court, which could have ⁢resulted in imprisonment for up to 11 years, accused him of violating the Freedom of⁢ Access to Clinic Entrances, or FACE, Act. The prosecution alleged that he “forcefully ⁤shoved” a Planned⁤ Parenthood volunteer ⁢named Bruce Love. Houck, however, ⁤denied attacking Love. He expressed that ‌the supposed attack was only a protective maneuver against Love’s disturbing behavior towards his son.

The abrupt raid on Houck’s house‌ and his subsequent arrest sparked outrage among conservatives, who perceived the actions of the Department of Justice as an unfair targeting⁢ of anti-abortion ⁣activists.‌ Now, Houck’s⁢ lawsuit is receiving support⁢ from the activist group 40‌ Days for Life⁣ and its recently launched Institute of Law & Justice.⁣ CEO Shawn Carney expresses that the institute’s goal ⁣is to provide legal support against the DOJ’s increased targeting ⁢of anti-abortion campaigners.

Carney revealed that before the 2022 overturning of ⁣Roe v. Wade, his group had relied ⁣heavily on the⁣ DOJ and⁢ FBI for protection⁤ during vigils. A jury ultimately acquitted him of all charges he faced in January last year; the charges could have sent him to prison for up to 11 years.

The abrupt raid on the 49-year-old Catholic activist’s house drew widespread condemnation from conservatives who accused the Department of Justice of unfairly targeting anti-abortion activists.

Houck’s new lawsuit is backed by activist group 40 Days for Life’s recently launched Institute of Law & Justice. Once the group filed a Notice of Claim in November making the DOJ aware of their litigation plans against the federal government, Carney said “essentially all harassment ceased.”

In order to sue the federal government, a person must file a notice of claims before he or she can file the actual lawsuit six months later, which is why Houck’s lawsuit was filed May 20.

“The federal government didn’t even bother to respond to the Notice of Claim,” Britton said.
