Trump&#8217;s team argue this represents an \u2064unconstitutional gag order.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Former President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\/\" target=\"_blank\" rel=\"noopener\" title>Donald Trump<\/a>\u2018s lawyers are seeking sanctions against special counsel <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/jack-smith\/\" target=\"_blank\" rel=\"noopener\" title>Jack Smith<\/a> and his office for the request to limit what Trump could say about <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/jack-smith-requests-gag-order-after-trump-says-fbi-agents-were-ready-to-take-me-out\/\" title=\"Jack Smith Seeks Gag Order Following Trump's Assertion of FBI Agents' Threat\">law enforcement agents involved<\/a> in his <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/florida\/\" target=\"_blank\" rel=\"noopener\" title>Florida<\/a> classified documents case. <\/p>\n<p>Trump\u2019s lawyers filed a motion on Monday asking U.S. District Judge Aileen Cannon, who is presiding over the case, to strike Smith\u2019s request, make civil contempt findings for all attorneys in the government who were involved with the decision, and impose sanctions following an \u201cevidentiary hearing\u201d into Smith\u2019s office\u2019s decision to \u201cdisregard required procedures.\u201d<\/p>\n<p>Federal prosecutors on Friday asked Cannon to revise the conditions of Trump\u2019s release to prohibit him from making public comments that could \u201cpose a significant, imminent, and foreseeable danger to law enforcement agents.\u201d<\/p>\n<p>Trump\u2019s team is arguing Smith\u2019s motion \u201cimproperly asks the Court to impose an unconstitutional gag order on President Trump,\u201d which was \u201cbased on vague and unsupported assertions about threats to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/update-washington-d-c-mayor-muriel-bowser-was-warned-but-refused-any-additional-help-before-january-6th-vote-on-stolen-election\/\" title=\"UPDATE: Washington, D.C. Mayor Muriel Bowser Was Warned but Refused Any Additional Help Before January 6th Vote on Stolen Election\">law enforcement personnel<\/a> whose names have been redacted from public filings.\u201d<\/p>\n<p>Smith\u2019s office filed the request <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3017581\/classified-documents-prosecutors-seek-block-trump-statements-endanger-law-enforcement\/\" target=\"_blank\" rel=\"noopener\" title>in response<\/a> to a claim Trump made last week regarding the FBI agents who searched his home in August 2022, stating they were \u201cauthorized to shoot me\u201d and were \u201c<a href=\"https:\/\/thehill.com\/policy\/technology\/4679715-trump-falsely-says-biden-was-locked-loaded-and-ready-to-take-me-out-in-mar-a-lago-search\/\" target=\"_blank\" rel=\"noopener\" title>locked &#038; loaded<\/a> ready to take me out &#038; put my family in danger.\u201d<\/p>\n<p>During the search, the FBI followed a standard use-of-force policy that prohibits the use of deadly force except when the officer has a reasonable belief that the subject being searched has an intent to harm the officer or another person.<\/p>\n<p>\u201cThe Government\u2019s request is necessary because of several intentionally false and inflammatory statements recently made by Trump that distort the circumstances under which the Federal Bureau of Investigation planned and executed the search warrant at Mar-a-Lago,\u201d prosecutors on Smith\u2019s team said when asking Cannon to restrict Trump\u2019s language regarding law enforcement agents.<\/p>\n<p>Trump\u2019s motion said Smith\u2019s request was based on \u201cunsupported assertions about threats to law enforcement personnel\u201d and that their names have already been redacted from public filings.  <\/p>\n<p>Trump\u2019s team said the petition was \u201cunprecedented.\u201d<\/p>\n<p>\u201cThe Motion is an extraordinary, unprecedented, and unconstitutional censorship application,\u201d the filing said. \u201cThe Motion unjustly targets President Trump\u2019s campaign speech while he is the leading candidate for the presidency.\u201d<\/p>\n<p>Trump\u2019s team also took issue with the special counsel\u2019s timing of the request. They said the motion was filed Friday evening at 5:30 p.m. ahead of the Memorial Day weekend holiday, to which Trump\u2019s team responded within 10 minutes. <\/p>\n<p>\u201cWe noted the suspicious timing of the communication,\u201d the filing said. Trump\u2019s team said they offered to meet Monday evening, to which the special counsel called a conferral a \u201cfruitless exercise.\u201d <\/p>\n<p>The filing also outlined additional timing concerns with Trump\u2019s criminal hush money trial in New York that they said the special counsel was aware of.<\/p>\n<p>\u201cUnder no circumstances can an email exchange initiated at 5:30 p.m. on a Friday evening constitute the type of conferral required by Local Rule 88.9,\u201d The filing said. \u201cFor President Trump, the fact that the Special Counsel\u2019s Office initiated the exchange on the Friday preceding a holiday weekend is less important than the fact that the Office\u2014well aware of the proceedings in <em>People v.
