Democrats and the NAACP accused the redistricting map of being\u200b racially discriminatory. The court&#8217;s 6-3 decision favored the conservative stance, \u200bemphasizing the importance of distinguishing between\u200c race and \u2062politics in such cases. The ruling had implications on <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/us-appeals-court-upholds-florida-congressional-map-reversing-lower-court-ruling\/\" title=\"US appeals court supports Florida congressional map, overturns lower court decision\">future redistricting challenges<\/a>.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/news\/\">  News <\/a>   <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/igcolonel\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/igcolonel\/%20\"><span>Warner Todd Huston<\/span><\/a> <\/span> <span>   May 25, 2024 at 12:46pm <\/span> <\/span>  <\/header>\n<section>\n<p>The U.S. Supreme Court has ruled in favor of Republicans in a crucial redistricting case for the state of South Carolina that had Democrats alleging \u201cracism.\u201d<\/p>\n<p>Democrats and the NAACP had taken the legislature\u2019s <a href=\"https:\/\/www.westernjournal.com\/ap-democrats-flop-state-races-despite-flip-everything-push\/\" target=\"_blank\" rel=\"noopener\">redistricting<\/a> map to court claiming that it was racially discriminatory and a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/christian-graphic-designer-defends-right-of-all-americans-to-be-protected-from-compelled-speech\/\" title=\"Christian Graphic Designer Defends Right Of All Americans To Be Protected From Compelled Speech\">lower court agreed<\/a>, telling the legislature that the map was unconstitutional.<\/p>\n<p>The state, though, appealed the decision to the nation\u2019s highest court and in a <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-807_3e04.pdf\" target=\"_blank\" rel=\"noopener\">6-3 decision<\/a>, the court sided with conservatives and ruled that the lower court was wrong, that the map was not created to discriminate against minority voters, according to <a href=\"https:\/\/www.foxnews.com\/politics\/supreme-court-upholds-gop-drawn-voting-map-south-carolina\" target=\"_blank\" rel=\"noopener\">Fox News<\/a><\/p>\n<p>For the majority, Justice <a href=\"https:\/\/www.westernjournal.com\/liberals-smearing-alito-upside-flag-story-real-point\/\" target=\"_blank\" rel=\"noopener\">Samuel Alito<\/a> added that, \u201ca party challenging a map\u2019s constitutionality must disentangle race and politics if it wishes to prove that the legislature was motivated by race as opposed to partisanship. Second, in assessing a legislature\u2019s work, we start with a presumption that the legislature acted in good faith.\u201d<\/p>\n<p>\u201cIn this case, which features a challenge to South Carolina\u2019s redistricting efforts in the wake of the 2020 census, the three-judge District Court paid only lip service to these propositions,\u201d Alito continued.<\/p>\n<p>\u201cThat misguided approach infected the District Court\u2019s findings of fact, which were clearly erroneous under the appropriate legal standard,\u201d Alito added.<\/p>\n<p>\u201cNo direct evidence supports the District Court\u2019s finding that race predominated in the design of District 1,\u201d Alito continued. \u201cThe circumstantial evidence falls far short of showing that race, not partisan preferences, drove the districting process.\u201d<\/p>\n<p>\u201cWe should not be quick to hurl such accusations at the political branches,\u201d Alito said, referencing accusations of racism aimed at the state\u2019s GOP leaders.<\/p>\n<p>At issue is the district that GOP Rep. Nancy Mace now represents which state Republicans in the state capital in Columbia wanted to strengthen. According to <a href=\"https:\/\/www.politico.com\/news\/2024\/05\/23\/supreme-court-south-carolina-redistricting-map-00159666\" target=\"_blank\" rel=\"noopener\">Politico<\/a>, the district began trending away from the Democrats since 2018, and after the 2020 Census, the state GOP moved to give Mace more security in her district.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Did the Supreme Court get this one right?<\/p>\n<\/p><\/div>\n<p>With the district already trending away from Democrats, state <a href=\"https:\/\/www.westernjournal.com\/ap-alabama-rushes-adopt-new-congressional-map-amid-disagreement-district-look-like\/\" target=\"_blank\" rel=\"noopener\">Republicans<\/a> claim they intended to move to speed that shift with their new map. Their goal, they said, was purely political and had nothing at all to do with race.<\/p>\n<p>Despite the lower court\u2019s ruling that the map was discriminatory, the court also allowed the state to use the districting this year because it was too late to change things in time for the 2024 election. But now that ruling is nullified because the upper court found the lower court\u2019s invalidation of the map to be incorrect.<\/p>\n<p>Regardless, nothing was going to change for the 2024 election.<\/p>\n<p>The <a href=\"https:\/\/www.westernjournal.com\/federal-courts-hand-republicans-congressional-map-wins-two-days-row\/\" target=\"_blank\" rel=\"noopener\">South Carolina<\/a> Republicans behind the map said that their sole goal was to increase Republican votes in the district they remapped, and that they had no intention of denuding minorities of any power. And while the high court agreed that there was no evidence that race formed the basis for the remapping, liberals disagreed that there was any distinction at all.<\/p>\n<p>Liberal activists decried the distinction that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/justices-decline-to-hear-appeal-from-wash-florist-who-refused-to-service-gay-couple-over-religious-beliefs\/\" title=\"Justices decline to hear appeal from Wash. florist who refused to service gay couple over religious beliefs\">high court made<\/a> in the case, saying that it will have a negative impact on other redistricting challenges.<\/p>\n<p>\u201cThe bar keeps on getting moved, and it keeps getting harder and harder for plaintiffs to uproot racial discrimination,\u201d said Leah Aden, a lawyer with the Legal Defense Fund civil rights group, according to <a href=\"https:\/\/www.nbcnews.com\/politics\/supreme-court\/supreme-court-rules-gop-south-carolina-redistricting-case-rcna127946\" target=\"_blank\" rel=\"noopener\">NBC News<\/a><\/p>\n<p>Left-wing Supreme Court Justice Elena Kagan also blasted the majority decisions and stated it was a roadmap for race-based redistricting and biased <a href=\"https:\/\/www.westernjournal.com\/ap-alabama-rushes-adopt-new-congressional-map-amid-disagreement-district-look-like\/\" target=\"_blank\" rel=\"noopener\">elections<\/a>.<\/p>\n<p>\u201cWhat a message to send to state legislators and mapmakers about racial gerrymandering,\u201d she complained in her dissenting decision, adding that the decision tells politicians who \u201cmight want to straight-up suppress the electoral influence of minority voters\u201d that they should just \u201cGo right ahead.\u201d<\/p>\n<hr>\n<div>\n<p><b><i>A Note from Our Deputy Managing Editor:<\/i><\/b><\/p>\n<p><i><span>\u201cWe don\u2019t even know if an election will be held in 2024.\u201d Those 12 words have been stuck in my head since I first read them. <\/span><\/i><\/p>\n<p><i><span>Former Lt.
