Eyewitnesses, \u2062like journalist Tayler Hansen, offer a different narrative. Contrary\u2063 to media reports, Babbitt allegedly \u200dengaged with Capitol officers, demanding backup, and \u2062even subduing an agitator. The incident led to\u2063 legal action by her\u2062 family against\u2063 the federal government. Byrd later confessed that he shot Ashli before seeing her hands or assessing her intentions or even identifying her as female. Ashli was unarmed,\u201d the <a href=\"https:\/\/www.judicialwatch.org\/wp-content\/uploads\/2024\/01\/Estate-of-Ashli-Babbitt-and-Arron-Babbitt-et-al.-v.-U.S.A.pdf\" target=\"_blank\" rel=\"noopener\">complaint<\/a> said.<\/p>\n<p>\u201cHer hands were up in the air, empty, and in plain view of Lt. Byrd and other officers in the lobby,\u201d it said. \u201cAshli posed no threat to the safety of anyone. Not one member of Congress was in the lobby, which was guarded by <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/florida-sheriff-on-active-shooters-shoot-them-so-much-that-you-can-read-the-local-newspaper-through-them\/\" title=\"Florida Sheriff On Active Shooters: \u2018Shoot Them So Much That You Can Read The Local Newspaper Through Them\u2019\">multiple armed police officers<\/a>.\u201d<\/p>\n<p>The court filing said, \u201cLt. Byrd, who was not in uniform, did not identify himself as a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/california-sheriffs-tell-newsom-they-wont-enforce-covid-curfew\/\" title=\"California Sheriffs Tell Newsom They Won't Enforce COVID Curfew\">police officer<\/a> or otherwise make his presence known to Ashli. Lt. Byrd did not give Ashli any warnings or commands before shooting her dead.\u201d<\/p>\n<p>Byrd told <a href=\"https:\/\/x.com\/NBCNightlyNews\/status\/1431037492547842051\" target=\"_blank\" rel=\"noopener\">NBC News<\/a> in August 2021 that he had given commands to Babbitt and she did not comply.<\/p>\n<p>The lawsuit further alleged that at 2:45 p.m., or within one minute after shooting Babbitt, Byrd called in, \u201cWe got shots fired in the lobby. We got shots shots fired in the lobby of the House chamber. Shots are being fired at us and we\u2019re sh, uhh, prepared to fire back at them.
