Criticized by Republicans for partisanship, she also faced scrutiny for\u200c housing a repeat\u2062 sexual offender in a women&#8217;s prison. Her actions \u2063in 2020, including ordering\u2063 Google to provide a \u2064journalist&#8217;s emails, sparked controversy. Netburn&#8217;s decisions continue\u2063 to draw mixed reactions.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p>A few years before she was nominated by Joe Biden to a lifetime judicial appointment, Judge Sarah Netburn <a href=\"https:\/\/dw-wp-production.imgix.net\/2024\/05\/Netburn-Veritas-search-warrant.pdf\">signed off<\/a> on an order that compelled Google to secretly hand over to criminal investigators the personal emails of the journalist who had obtained Ashley Biden\u2019s diary.<\/p>\n<p>Netburn has been eviscerated by Republican senators for alleged partisanship during her confirmation hearings this week, chiefly for allowing a repeat sexual offender to be <a href=\"https:\/\/www.dailywire.com\/news\/cruz-grills-biden-nominee-for-putting-serial-child-rapist-with-male-genitalia-in-womens-prison\" target=\"_blank\" rel=\"noopener\">housed in a female prison<\/a> because he said he was a woman. Senators including Texas\u2019 Ted Cruz have accused her of putting ideology over jurisprudence.<\/p>\n<p>Unmentioned, however, have been her actions in 2020. Netburn as a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/celeb-backed-rodney-reed-case-victims-sister-says-reed-a-serial-rapist-and-murderer-new-testimony-not-credible\/\" title=\"Celeb-Backed Rodney Reed Case: Victim\u2019s Sister Says Reed \u2018A Serial Rapist And Murderer,\u2019 New Testimony Not Credible\u00a0\">federal magistrate judge<\/a> in New York signed the order compelling Google to provide information from a Project Veritas journalist\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/andrew-cuomo-was-offered-more-than-4-million-for-pandemic-leadership-book-report-says\/\" title=\"Andrew Cuomo Was Offered More Than  Million For Pandemic \u2018Leadership\u2019 Book, Report Says\">personal email account<\/a>, court records show. Project Veritas purchased the diary after a woman said she found it when she moved into a room previously occupied by Ashley Biden.<\/p>\n<p>The conservative-leaning <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ukrainian-intel-claims-another-high-ranking-russian-general-killed\/\" title=\"Ukrainian Intel Claims Another High-Ranking Russian General Killed\">journalism outfit<\/a> ultimately decided not to publish the diary. Nonetheless, lawyers for Ashley Biden contacted the U.S. Attorney for the Southern District of New York, which turned the missing diary into a federal case.<\/p>\n<p>The contents of the diary, in which the president\u2019s daughter discusses drug addiction and questions whether her sexual compulsion stemmed from Joe Biden allegedly showering with her as a child, had the potential to be politically explosive.<\/p>\n<p>Netburn granted the ruling favorably to Ashley Biden, in spite of First Amendment implications, in December 2020, after Joe Biden had won the presidential election but while Donald Trump was still in office. Three and a half years later, Joe Biden nominated Netburn for a lifetime appointment to the position of District Judge for the Southern District of New York.<\/p>\n<p>The order signed by Netburn ordered Google to turn over information associated with a personal account of a Project Veritas journalist, while forbidding Google from letting the target know about it, preventing the journalism outfit from fighting the move. \u201cThe information sought is relevant and material to an ongoing criminal investigation, and that disclosure to any person of this investigation of this application and order\u2026 would seriously jeopardize the investigation,\u201d the order said.<\/p>\n<p>The application for a search warrant was also sealed, making it unknown exactly what prosecutors told Netburn.<\/p>\n<p>The case became public after prosecutors executed pre-dawn raids at the homes of three former Project Veritas journalists, drawing condemnation from even left-leaning civil liberties groups.<\/p>\n<p>Prosecutors eventually got warrants from Apple, Microsoft, and other providers from other magistrate judges, and pressed for them to remain sealed. In 2022, Microsoft realized the case was already well-publicized, meaning the government could not legitimately argue for sealing them, and prosecutors relented, filing an order to end the non-disclosure orders, which Netburn signed.<\/p>\n<p>In May 2022, Project Veritas\u2019 lawyers <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.580045\/gov.uscourts.nysd.580045.3.0.pdf\">wrote<\/a> to Netburn that the subpoenas were \u201cunprecedented government invasions into the newsgathering work of Project Veritas, which lawfully received an abandoned diary and other personal effects previously belonging to an adult child of then-presidential candidate Joe Biden.\u201d<\/p>\n<p>\u201cThere is no potential crime to investigate, only First Amendment-protected newsgathering,\u201d it wrote, saying that, \u201cwhile the government continues to peddle the lie that the diary \u2014 or other abandoned belongings \u2014 were \u2018stolen,\u2019 it has produced no support for its false claim.\u201d<\/p>\n<p>Even if it were stolen, precedent holds that \u201cjournalists may lawfully receive materials from sources even if that material is illegally obtained by sources themselves,\u201d it argued.<\/p>\n<p>Netburn did not immediately return a request for comment to her chambers.<\/p>\n<p>Mike Davis, a Republican former chief counsel for nominations on the Senate Judiciary Committee who now leads the Article III Project, a nonprofit focused on the judiciary, told The Daily Wire that the order is another sign Netburn is too partisan for the nomination.<\/p>\n<p>\u201cNow, we learn Sarah Netburn ordered a secret search of a journalist\u2019s email account to protect Joe Biden from the highly troubling abuse allegations in daughter Ashley Biden\u2019s diary,\u201d Davis said after reviewing the orders. \u201cSarah Netburn has proven she doesn\u2019t have the necessary judgeship or independence to serve on the federal bench for the rest of her life. That\u2019s probably why Joe Biden picked her.\u201d<\/p>\n<p>The White House says it was unaware of the order when Biden nominated Netburn, and that it was therefore not a factor in the decision.<\/p>\n<p>\u201cWe are unaware of such a warrant and nothing regarding this case was a factor,\u201d Biden\u2019s deputy press secretary Andrew Bates told The Daily Wire.<\/p>\n<p>Last month, Aimee Harris was sentenced to a month in prison and three years of probation after pleading guilty to taking the diary and selling it to Project Veritas for $40,000. Another man, Robert Kurlander, also pleaded guilty to involvement in a conspiracy involving the diary.<\/p>\n<p>In the diary published by Marco Polo, Ashley allegedly writes that she was \u201chyper-sexualized @ a young age,\u201d and references \u201cshowers\u201d with her dad that were \u201cprobably not appropriate.\u201d She writes this while contemplating her issues with sexual trauma, and said she was \u201cresentful\u201d of her father because of \u201c$, control.\u201d On September 16, 2019, she wrote, \u201cI\u2019m going to discontinue this journal after I leave here.\u201d<\/p>\n<p>Last month, Ashley Biden seemed to <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.585345\/gov.uscourts.nysd.585345.117.0.pdf\">acknowledge<\/a> that the diary was real in a victim impact statement that was originally filed under seal, but made public after the New York Times argued against its secrecy. In the statement, Ashley Biden says the private diary\u2019s publication has led to \u201cgrotesque lies\u201d and that her \u201cstream-of-consciousness thoughts\u201d were misconstrued.<\/p>\n<p>\u201cMy personal private journal was stolen and sold for profit,\u201d she wrote. \u201cI ask Your Honor to sentence Ms. Harris to time in prison followed by lengthy probation.\u201d<\/p>\n<p>Netburn is up for a lifetime appointment to the United States District Court for the Southern District of New York.
