They said the flag was raised in the summer of 2023, citing photos and interviews with neighbors, as well as a Google Street View photo from August 2023. Yet are they only now reporting on the flag\u2019s existence, nearly a year later.<\/p>\n<p>The Times conceded that the flag has roots in the Revolutionary War, yet ferociously concluded that the flag is controversial and represents loyalty to former President Trump and \u201ca push to remake American government in Christian terms.\u201d <\/p>\n<p>In reality, the \u201cAppeal to Heaven\u201d flag  (or \u201cPine Tree\u201d flag, as it is sometimes called) is far from a symbol of clandestine radicalism. The white flag with a large green pine tree placed in the center was originally designed by George Washington\u2019s secretary and flown by six ships Washington commissioned during the American Revolution. Besides the flag\u2019s connection to the American Revolution, the phrase \u201cappeal to heaven\u201d finds its origin in the writings of 17th-century political philosopher John Locke. The meaning of the phrase is that when a person feels defenseless and hopeless on earth, it is time to \u201cappeal to heaven,\u201d calling on a higher power to intercede in one\u2019s defense.<\/p>\n<p>The flag has been used widely in public and even in popular culture. For example, viewers can <a href=\"https:\/\/screenrant.com\/parks-rec-ron-swansons-office\/#:~:text=His%20Flags,Don't%20Tread%20on%20Me.\" target=\"_blank\" rel=\"noreferrer noopener\">notice<\/a> the \u201cAppeal to Heaven\u201d flag in the hit show \u201cParks and Recreation\u201d on lead character Ron Swanson\u2019s desk. Disneyland also <a href=\"https:\/\/disneyparks.disney.go.com\/blog\/2014\/07\/historic-american-flags-in-frontierland-at-disneyland-park\/\" target=\"_blank\" rel=\"noreferrer noopener\">displays<\/a> the flag in one of its theme park attractions. A user on the social media platform X even pointed out a past <a href=\"https:\/\/x.com\/stat_woman\/status\/1793668343708475724?s=12\">photo<\/a> showing the flag at a Black Lives Matter protest.<\/p>\n<div class=\"fdrlst__b89e9-ad901b45a4e1fc62412b7e01e460f3b8 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-ad901b45a4e1fc62412b7e01e460f3b8\"><\/div>\n<p>It it also worth noting that Alito is not the only government official to fly the \u201cAppeal to Heaven\u201d flag. Speaker of the House Mike Johnson has the flag placed outside of his office, one of three framing his door according to a <a href=\"https:\/\/www.nytimes.com\/2024\/05\/22\/us\/justice-alito-flag-appeal-to-heaven.html\">photo<\/a> obtained by The New York Times.<\/p>\n<p>Nevertheless, the Times said that the \u201cdisclosure about the new flag is troubling,\u201d asserting its own meaning and definition of the flag in an attempt to drum up an ethics violation that would in effect taint the conduct of Alito and the court in dealing with future cases regarding Jan. 6 and the upcoming election.<\/p>\n<p>This is exactly what the Times tried to do with another Alito flag <a href=\"https:\/\/www.nytimes.com\/2024\/05\/16\/us\/justice-alito-upside-down-flag.html\" target=\"_blank\" rel=\"noreferrer noopener\">story<\/a> just last week.\u00a0Jodi Kantor, one of the reporters on the \u201cAppeal to Heaven\u201d flag article, wrote a separate piece that also criticized Alito over a flag on his private property. In this case, an upside-down American flag was flown outside Alito\u2019s Virginia home in 2021. According to Alito, the upside-down flag was placed outside by his wife in response to a conflict with a neighbor over an anti-Trump sign in the neighbor\u2019s yard.<\/p>\n<p>The Federalist\u2019s Senior Legal Correspondent Margot Cleveland correctly pointed out that the Supreme Court\u2019s <a href=\"https:\/\/www.supremecourt.gov\/about\/Code-of-Conduct-for-Justices_November_13_2023.pdf\">code of <\/a><a href=\"https:\/\/www.supremecourt.gov\/about\/Code-of-Conduct-for-Justices_November_13_2023.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">conduct<\/a> does not apply to Alito\u2019s wife, and her hanging the flag does not call any ethics concerns into question. \u201cIt wasn\u2019t Justice Alito who hung the upside-down flag we are hypothesizing was instead a \u2018Stop the Steal\u2019 placard \u2014 it was Mrs. Alito,\u201d Cleveland <a href=\"https:\/\/thefederalist.com\/2024\/05\/20\/i-researched-judicial-ethics-rules-for-years-heres-why-the-alito-recusal-calls-are-ridiculous\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>. \u201cAnd the Code of Conduct does not govern a spouse\u2019s actions.\u201d<\/p>\n<div class=\"fdrlst__b89e9-d4f7d0287112b95ebd203fd4146d7890 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-d4f7d0287112b95ebd203fd4146d7890\"><\/div>\n<p>In its articles, the Times has cited the creation of the new <a href=\"https:\/\/www.supremecourt.gov\/about\/Code-of-Conduct-for-Justices_November_13_2023.pdf\">ethics code<\/a> for the Supreme Court, which was established in November of last year. However, even if the code applied to Mrs. Alito\u2019s hanging the U.S. flag upside-down, it was not created until two years after the incident. The \u201cAppeal to Heaven\u201d flag at Alito\u2019s beach home was reportedly flown during the summer of 2023, apparently placing it out of the scope of the new ethics code as well.<\/p>\n<p>But the reporters still suggest Alito should face scrutiny, and even possibly recuse himself from upcoming cases. The Times asserts that \u201cjudges are not supposed to give any impression of bias, yet the flag could be seen as telegraphing the Alitos\u2019 views \u2014 and at a time when the justices were\u00a0on the cusp\u00a0of adopting a\u00a0new ethics code.\u201d The phrasing implies that if the court were not \u201con the cusp of adopting a new ethics code,\u201d the consequences of the flags would not be as dire.<\/p>\n<p>Prior to the publishing of the two New York Times articles, the flags had been flown at the Alito family\u2019s homes without criticism or calls for recusal, and the articles appear to be a blatant attempt to instigate controversy about Alito as demonstrated by the fact that the Times now has an entire heading devoted to the \u201cAlito Flag Controversies.\u201d<\/p>\n<p>Republican Sen. Mike Lee rightly <a href=\"https:\/\/x.com\/BasedMikeLee\/status\/1793407808928456903\" target=\"_blank\" rel=\"noreferrer noopener\">derided<\/a> the Times article on social media: \u201cThis is paranoid fantasy. The obsession with the Alitos and their flags is laughable nonsense.\u201d<\/p>\n<p>But Democrat Rep. Alexandria Ocasio-Cortez, D-N.Y., is using the controversy as justification to call for more than just Alito\u2019s recusal from future cases.<\/p>\n<p>\u201cSamuel Alito has identified himself with the same people who raided the Capitol on Jan. 6, and is now going to be presiding over court cases that have deep implications over the participants of that rally,\u201d Ocasio-Cortez <a href=\"https:\/\/www.foxnews.com\/politics\/aoc-demands-senate-democrats-investigate-reports-jan-6-flags-flown-supreme-court-justice-alitos-home\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> in an interview with MSNBC. \u201cDemocrats have a responsibility for defending our democracy. And in the Senate, we have gavels. There should be subpoenas going out.
