Election Commission Chairman Bradley Smith has revealed the testimony he would have given in former President Donald Trump\u2019s so<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/georgia-appeals-court-gives-trump-great-news-in-his-fight-against-fani-willis\/\" title=\"Georgia Appeals Court Rules in Favor of Trump in Legal Battle with Fani Willis\">-called \u201chush money\u201d trial<\/a>, had Judge Juan Merchan allowed it.<\/p>\n<p>Smith was to testify for the defense earlier this week in the case brought by Manhattan District Attorney <a href=\"https:\/\/www.westernjournal.com\/alvin-braggs-top-trump-prosecutor-comes-official-investigation\/\" target=\"_blank\" rel=\"noopener\">Alvin Bragg<\/a>, but Trump\u2019s attorneys decided to pull him when Merchan denied him the opportunity to address a question at the core of the case: Was the payment made to porn star Stormy Daniels a campaign contribution?<\/p>\n<p>Keep in mind both the <a href=\"https:\/\/www.foxnews.com\/politics\/fec-drops-trump-stormy-daniels-hush-money-investigation\" target=\"_blank\" rel=\"noopener\">FEC<\/a> and the <a href=\"https:\/\/www.nytimes.com\/2023\/03\/31\/nyregion\/justice-dept-trump-indictment-charges.html\" target=\"_blank\" rel=\"noopener\">Department of Justice<\/a> had looked at the $130,000 payment made by then-Trump attorney Michael Cohen to Daniels and determined it wasn\u2019t, at least with regard to the 45th president.<\/p>\n<p>However, as part of a 2018 plea agreement, Cohen said he was guilty of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-president-trump-gives-pardons-to-73-individuals-and-commutes-another-70-sentences-steve-bannon-is-included\/\" title=\"BREAKING: President Trump Gives Pardons to 73 Individuals and Commutes Another 70 Sentences \u2013 Steve Bannon Is Included\">campaign finance violations<\/a>, in addition to tax evasion and making false statements to a bank to secure a home equity loan, according to a <a href=\"https:\/\/www.justice.gov\/usao-sdny\/pr\/michael-cohen-sentenced-3-years-prison#:~:text=%C2%A7%20515%2C%20announced%20that%20MICHAEL,U.S.%20District%20Judge%20William%20H.\" target=\"_blank\" rel=\"noopener\">news release<\/a> from the DOJ.<\/p>\n<p>The supposed campaign finance violation appears to be an add-on as part of the efforts to \u201cget Trump.\u201d <a href=\"https:\/\/www.westernjournal.com\/trumps-legal-team-just-called-killshot-witness-stand-law-professor-jonathan-turley-says\/\" target=\"_blank\" rel=\"noopener\">Legal experts<\/a>, including Smith, don\u2019t even believe the payment constituted a campaign contribution.<\/p>\n<p>Recall this was when the DOJ\u2019s Russian hoax probe, led by special counsel Robert Mueller, was ongoing and people in the president\u2019s orbit were being investigated and prosecuted left and right, like former campaign CEO <a href=\"https:\/\/www.westernjournal.com\/trump-announces-new-round-pardons-time-including-paul-manafort\/\" target=\"_blank\" rel=\"noopener\">Paul Manafort<\/a>, former national security advisor <a href=\"https:\/\/www.westernjournal.com\/reports-michael-flynn-pardon-emerge-adam-schiff-embarrasses\/\" target=\"_blank\" rel=\"noopener\">Michael Flynn<\/a> and former campaign advisor <a href=\"https:\/\/www.westernjournal.com\/exclusive-papadopoulos-predicts-muellers-congressional-testimony-will-backfire-dems\/\" target=\"_blank\" rel=\"noopener\">George Papadopoulos<\/a>.<\/p>\n<p>It seemed evident the DOJ was trying to get at least one of these guys, including <a href=\"https:\/\/www.westernjournal.com\/msnbc-legal-analyst-forced-admit-trumps-attorney-scored-moment-real-triumph-cohen-questioning\/\" target=\"_blank\" rel=\"noopener\">Cohen<\/a>, to flip on Trump and say he was guilty of some crime.<\/p>\n<p>Getting Cohen to plead to campaign finance violations looked like the first step to charging Trump with the crime, but the FEC and the DOJ, after taking a <a href=\"https:\/\/www.fec.gov\/files\/legal\/murs\/7313\/7313_28.pdf\" target=\"_blank\" rel=\"noopener\">close look<\/a>, could not get there.<\/p>\n<p>One reason was no doubt the result of former Democratic presidential candidate <a href=\"https:\/\/www.nytimes.com\/2012\/06\/01\/us\/edwards-jury-returns-not-guilty-verdict-on-one-count.html\" target=\"_blank\" rel=\"noopener\">John Edwards\u2019 case in 2012<\/a>, when a jury found him not guilty of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fec-drops-its-inquiry-into-trumps-payments-to-stormy-daniels\/\" title=\"FEC Drops Its Inquiry Into Trump\u2019s Payments To Stormy Daniels\">violating campaign finance law<\/a> on one count and a mistrial on five others in relation to payments made to his pregnant mistress during the 2008 campaign.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Is Trump being persecuted?<\/p>\n<\/p><\/div>\n<p>Smith, who <a href=\"https:\/\/www.thefire.org\/news\/podcasts\/so-speak-free-speech-podcast\/former-fec-chairman-bradley-smith\" target=\"_blank\" rel=\"noopener\">served<\/a> as FEC chairman in 2004 and as a commissioner from 2000 to 2005, explained in a thread Monday on X, the day he was to testify for Trump in court, what he would have said.<\/p>\n<p>First he noted that \u201cJudge Merchan has so restricted my testimony that defense has decided not to call me. Now, it\u2019s elementary that the judge instructs the jury on the law, so I understand his reluctance.<\/p>\n<p>\u201cBut the Federal Election Campaign Act is very complex. Even [former Supreme Court Justice] Antonin Scalia\u2014a pretty smart guy, even you hate him\u2014once said \u2018this [campaign finance] law is so intricate that I can\u2019t figure it out,&#8217;\u201d Smith wrote.<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">But the Federal Election Campaign Act is very complex. So effectively, the jury got its instructions on FECA from Michael Cohen!<\/p>\n<p>\u2014 Brad Smith (@CommishSmith) <a href=\"https:\/\/twitter.com\/CommishSmith\/status\/1792673058769289434?\">May 20, 2024<\/a><\/p>\n<\/blockquote>\n<p>He summarized, \u201cSo you\u2019ve got a judge who contributed to Trump\u2019s opponent presiding over a trial by a prosecutor who was elected on a vow to get Trump, for something DOJ and FEC chose not to prosecute, on a far-fetched legal theory \u2026 which the prosecution has been allowed to repeatedly misstate the law or elicit incorrect statements of law from witnesses (and unlike Cohen\u2019s, my testimony would not have gone to the ultimate legal issue). The judge\u2019s bias is very evident.\u201d<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">\/10\u2026 To repeatedly misstate the law or elicit incorrect statements of law from witnesses (and unlike Cohen\u2019s, my testimony would not have gone to the ultimate legal issue). It\u2019s in part because of farces like this trial.\u201d<\/p>\n<p>On Tuesday, Smith added, \u201cBragg\u2019s theory hinges on the claim that Trump tried to influence an election through \u2018unlawful means.\u2019 To do that, he\u2019ll have to show that Trump violated the Federal Election Campaign Act. But since neither the FEC nor DOJ sued Trump, he\u2019s got to show it on his own evidence.<\/p>\n<p>\u201cIf that\u2019s the case, isn\u2019t it entirely relevant (not dispositive, but relevant) to the jury\u2019s fact-finding on that question that neither DOJ nor FEC chose to prosecute? But Judge Merchan won\u2019t allow that in,\u201d Smith wrote.<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">If that\u2019s the case, isn\u2019t it entirely relevant (not dispositive, but relevant) to the jury\u2019s fact-finding on that question that neither DOJ nor FEC chose to prosecute? Rather, it\u2019s an objective test, in which things like polling, paying for staff, paying for headquarters, paying for advertisements and so on \u2014 those are campaign expenses,\u201d he said.<\/p>\n<p>\u201cThat\u2019s the problem that the DA has,\u201d Smith continued. \u201cHe\u2019s trying to allege that these payments to Stormy Daniels were campaign expenses, and I think, quite clearly, they exist from an obligation independent of Mr. Trump\u2019s campaign for president.\u201d<\/p>\n<p><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/RkTXzzwZfYo?si=gpKVlQXva2DbLRG-&#038;start=180\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p>In a Monday <a href=\"https:\/\/www.washingtonexaminer.com\/daily-memo\/3011093\/brad-smith-what-i-would-have-told-trump-jury\/\" target=\"_blank\" rel=\"noopener\">interview<\/a> with the Washington Examiner\u2019s Byron York, Smith said, \u201cI can tell you my personal belief is that clearly paying hush money, or paying for a nondisclosure agreement, does not constitute a campaign expense.\u201d<\/p>\n<p>He offered the example of a businessman who decides he wants to run for office and his companies are facing some employee sexual harassment lawsuits.<\/p>\n<p>Company lawyers advise him to go to court, because the cases are very winnable, but the businessman tells his lawyers to quietly settle the suits, because he does not want the bad press during his campaign.<\/p>\n<p>He can\u2019t use campaign funds to settle the lawsuits, because it\u2019s against the companies. But he has decided to settle the cases because of his candidacy.<\/p>\n<p>\u201cIt\u2019s kind of similar to what went on here,\u201d Smith contended, referring to Trump\u2019s payment to <a href=\"https:\/\/www.westernjournal.com\/judge-merchan-refuses-let-trump-fire-back-stormy-daniels-testimony-wont-modify-gag-order\/\" target=\"_blank\" rel=\"noopener\">Daniels<\/a>, which was also not paid with campaign funds.<\/p>\n<p>\u201cSo my personal belief is that this clearly would not have been a campaign expenditure, never had to be reported, and therefore was not misreported,\u201d he said.<\/p>\n<p>Hopefully, even a Manhattan jury will be able to see <a href=\"https:\/\/www.westernjournal.com\/judge-juan-merchan-hit-official-ethics-complaint-accused-judicial-misconduct\/\" target=\"_blank\" rel=\"noopener\">Merchan\u2019s bias<\/a>.
