The attacker&#8217;s federal appeal and state charges may lead to a severe \u200bpenalty, possibly a life sentence.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/news\/\">  News <\/a>   <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/rmoorhead\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/rmoorhead\/%20\"><span>Richard Moorhead<\/span><\/a> <\/span> <span>   May 23, 2024 at 1:11pm <\/span> <\/span>  <\/header>\n<section>\n<p>A sentencing error applied to the man convicted of attacking Paul Pelosi could potentially put his decades-long federal prison term in jeopardy.<\/p>\n<p>The government\u2019s case may have appeared straightforward, but its execution of basic procedures \u2014 or lack thereof \u2014 was anything but.<\/p>\n<p>The judge that sentenced David DePape failed to allow the convicted home invader the chance to speak before sentencing him earlier this month, according to <a href=\"https:\/\/www.politico.com\/news\/2024\/05\/22\/judges-error-scrambles-pelosi-attacker-case-00159516\" target=\"_blank\" rel=\"noopener\">Politico<\/a>.<\/p>\n<p>In a court hearing last week, U.S. District Judge Jacqueline Scott Corley admitted that she made an error in sentencing procedures.<\/p>\n<p>Due to that error, Corley has ordered that the sentencing hearing be redone next Tuesday.<\/p>\n<p>DePape was sentenced to thirty years in prison in the case, according to the <a href=\"https:\/\/www.justice.gov\/opa\/pr\/david-depape-sentenced-after-conviction-assault-and-attempted-kidnapping-charges\" target=\"_blank\" rel=\"noopener\">Department of Justice<\/a>.<\/p>\n<p>However, DePape\u2019s attorneys are pushing back against giving the judge a mulligan to sentence their client again.<\/p>\n<p>\u201cThe Court violated Mr. DePape\u2019s rights when it sentenced him without inviting him to allocute,\u201d <a href=\"https:\/\/www.westernjournal.com\/take-carlson-47-seconds-destroy-paul-pelosi-narrative-exactly-david-depape\/\" target=\"_blank\" rel=\"noopener\">DePape\u2019s<\/a> <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-defense-attorney-argues-in-support-of-free-political-speech\/\" title=\"Trump defense attorney argues in support of free political speech\">defense team argued<\/a> in a Wednesday court filing.<\/p>\n<p>The defense cited DePape\u2019s ongoing California <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/jailed-u-s-marine-is-arrested-and-put-behind-bars-after-criticizing-afghanistan-withdrawal\/\" title=\"Jailed! U.S. Marine is arrested and put behind bars after criticizing Afghanistan withdrawal\">state trial<\/a> in objecting to a repeat of the <a href=\"https:\/\/www.westernjournal.com\/illegal-immigrant-charged-pelosi-attack-faces-possible-deportation-biden-admin-says\/\" target=\"_blank\" rel=\"noopener\">Canadian illegal immigrant\u2019s<\/a> sentencing hearing.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Do DePape&#8217;s lawyers have a point?<\/p>\n<\/p><\/div>\n<p>\u201c[The court] cannot now cure that error by disrupting his state trial and asking Mr. DePape if he has anything to say,\u201d DePape\u2019s lawyers said.<\/p>\n<p>DePape\u2019s lawyers are arguing that their client has to be re-sentenced entirely, rather than merely repeating the hearing in which his chance to speak was denied.<\/p>\n<p>DePape was <a href=\"https:\/\/www.westernjournal.com\/jury-delivers-verdict-david-depapes-assault-case-paul-pelosi\/\" target=\"_blank\" rel=\"noopener\">convicted<\/a> of attempting to kidnap a federal official and committing assault against an immediate family member of a public official last year.<\/p>\n<p>The offender had sought former Speaker of the House Nancy Pelosi during a home invasion in which he brutally beat 82-year-old Paul Pelosi with a hammer.<\/p>\n<p>DePape has already appealed his federal conviction.<\/p>\n<p>Federal prosecutors have asserted that Corley has an additional 14 days to provide DePape with an allocution or sentencing statement.<\/p>\n<p>DePape\u2019s additional charges in state court could land him a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/harvey-weinstein-appeals-sex-crimes-conviction-in-new-york\/\" title=\"Harvey Weinstein Appeals Sex Crimes Conviction In New York\">de facto life sentence<\/a> if convicted.<\/p>\n<p>He\u2019s charged with attempted murder, assault with a deadly weapon, elder abuse, burglary and threats, according to the <a href=\"https:\/\/www.latimes.com\/california\/story\/2024-05-17\/depape-sentenced-30-years-paul-pelosi-hammer-attack\" target=\"_blank\" rel=\"noopener\">Los Angeles Times<\/a>.<\/p>\n<hr>\n<div>\n<p><b><i>A Note from Our Deputy Managing Editor:<\/i><\/b><\/p>\n<p><i><span>I heard a chilling comment the other day: \u201cWe don\u2019t even know if an election will be held in 2024.\u201d <\/span><\/i><\/p>\n<p><i><span>That wasn\u2019t said by a conspiracy theorist or a doomsday prophet.
