Justice Alito \u2064distinguished between\u2063 partisan and racial gerrymandering, underlining the \u2064plaintiffs&#8217;\u200b inability to demonstrate racial prejudice.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><span style=\"font-weight: 400\">The <a href=\"https:\/\/www.dailywire.com\/topic\/supreme-court\" target=\"_blank\" rel=\"noopener\">Supreme Court<\/a> upheld Republican-backed electoral maps in <a href=\"https:\/\/www.dailywire.com\/topic\/south-carolina\" target=\"_blank\" rel=\"noopener\">South Carolina<\/a> in a 6-3 decision on Thursday, arguing that those suing to overturn the maps had not proven they were racially drawn.<\/span><\/p>\n<p><span style=\"font-weight: 400\">A lower United States <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-legal-team-files-appeal-after-obama-judge-dismisses-lawsuit-seeking-to-block-pennsylvania-from-certifying-its-results\/\" title=\"Trump Legal Team Files Appeal After Obama Judge Dismisses Lawsuit Seeking to Block Pennsylvania From Certifying Its Results\">district court<\/a> <a href=\"https:\/\/www.foxnews.com\/politics\/supreme-court-upholds-gop-drawn-voting-map-south-carolina\" target=\"_blank\" rel=\"noopener\">previously<\/a> ruled that maps approved by the Republican-controlled South Carolina legislature were unconstitutional after they were challenged by a chapter of the NAACP and the ACLU. The majority opinion, written by Justice Samuel Alito, said that the district court had ruled wrongly and that the maps could stand.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cWhen partisanship and race correlate, it naturally follows that a map that has been gerrymandered to achieve a partisan end can look very similar to a racially gerrymandered map,\u201d Alito <a href=\"https:\/\/www.supremecourt.gov\/opinions\/23pdf\/22-807_3e04.pdf#&#038;_intcmp=fnhpbt3_1,hp1bt\" target=\"_blank\" rel=\"noopener\">wrote<\/a>. \u201cIn other words, the plaintiffs failed to meet the high bar for a racial-gerrymandering claim by failing to produce, among other things, an alternative map showing that a rational legislature sincerely driven by its professed partisan goals would have drawn a different map with greater racial balance.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">Alito\u2019s decision was joined by Justices John Roberts, Neil Gorsuch, Amy Coney Barret, and Brett Kavanugh, with Clarence Thomas adding a concurring opinion.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Thomas wrote that the court had no authority to be intervening in disputes over <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/new-york-times-ignored-own-fact-checker-in-attacking-sarah-palin-emails\/\" title=\"New York Times Ignored Own Fact-checker in Attacking Sarah Palin: Emails\">electoral districts<\/a>.<\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cIn my view, the Court has no power to decide these types of claims,\u201d he wrote in his concurrence. \u201cDrawing political districts is a task for politicians, not federal judges.
