The\u200c board justifies these actions\u200d by delegating \u2063responsibilities to the Election Director. Adams&#8217; requests for access have\u200d been \u200ddenied, leading to a\u2064 legal dispute seeking disclosure of election materials.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><\/p>\n<div class=\"article-content\">\n<p>Fulton County\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-president-trump-and-gop-senator-thom-tillis-win-north-carolina-decision-desk-hq\/\" title=\"BREAKING: President Trump and GOP Senator Thom Tillis Win North Carolina: Decision Desk HQ\">election board<\/a> and director are unlawfully withholding election records from a GOP board member, a new lawsuit alleges.<\/p>\n<p>Filed on Tuesday by Fulton County Board of Registration and Elections (BRE) member Julie Adams, a Republican, the suit contends that the board and Elections Director Nadine Williams are preventing Adams from \u201cperforming her statutory duties as a BRE member\u201d by denying her \u201caccess to essential election materials and processes by which elections in Fulton County are conducted.\u201d Adams was appointed to the position in January and took office the following month.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-520115273\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-e2969946d6402350926c53391695d626 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-e2969946d6402350926c53391695d626\"><\/div>\n<p>\u201cPlaintiff swore an oath to \u2018prevent fraud, deceit, and abuse\u2019 in Fulton County elections and to \u2018make a true and perfect return,&#8217;\u201d the lawsuit reads. \u201cThese obligations are frustrated by the repeated and continuing refusal to allow Plaintiff access to, and direct knowledge of, the information Plaintiff reasonably believes she needs to execute her duties faithfully and thoroughly.\u201d<\/p>\n<p>Adams has sought access to various \u201cElections Materials and Processes\u201d relevant to her position on the BRE since taking office. Among these are the county\u2019s qualified voter list and absentee ballot records. The former is a \u201clist of all lawfully registered electors that are eligible to cast a ballot within a voting jurisdiction,\u201d and the latter includes the list \u201cof all electors who requested, received, and\/or returned an Absentee Ballot\u201d and all \u201cAbsentee Ballot applications and ballot envelopes.\u201d<\/p>\n<p>According to the suit, Georgia\u2019s Authorization Act provides the BRE with the \u201cexclusive power to certify the results of Fulton County elections.\u201d The statute specifies that there \u201cshall be a chief administrative officer of the board who shall be appointed by the governing authority of the county upon the recommendation of the board and shall be designated [the] \u2018elections supervisor.&#8217;\u201d This individual \u201cshall have such duties and functions in regard to elections as may be prescribed by the board.\u201d<\/p>\n<p>The board attempts to justify denying Adams access to the aforementioned election materials she says she needs to execute her duties because \u201cthe Board has purportedly\u00a0delegated core BRE responsibilities to\u00a0an appointed Election Director,\u201d the suit explains. Defendants, according to the lawsuit, \u201chave taken the position the BRE delegated the statutorily assigned duties and powers of the Fulton County election superintendent to the Director via adoption of the bylaws,\u201d and therefore, argue that \u201cBRE members are not entitled to access to the Election Materials and Processes necessary for the performance of their duties.\u201d<\/p>\n<div class=\"fdrlst__b89e9-e851523577902bfee26d5029a5e1b2fd fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-e851523577902bfee26d5029a5e1b2fd\"><\/div>\n<p>According to Adams, however, \u201cdespite the request of BRE members, neither the counsel nor the BRE\u2019s staff have been able to produce an official version of the Bylaws, in a form or on a date on which the bylaws were passed.\u201d<\/p>\n<p>\u201cAs a consequence of this delegation (which, as noted above, is unsupported by any official records of the Bylaws being formally adopted by the BRE), the current and former Chairs of the BRE and the Director have refused to allow Plaintiff access to the Election Materials and Processes,\u201d the suit reads. <\/p>\n<p>Emails included in the lawsuit show that Adams contacted Williams and then-BRE Chair Patrise Perkins-Hooker on March 7, requesting the county\u2019s Election Materials and Processes be provided to her so she could review them before the board certified the results of the upcoming March 12 Presidential Preference Primary. Williams responded to Adams later that day, \u201cnoting that most of the documents requested would not be created until after the primary, and that \u2018review of these documents is not required for certification,\u2019 and that \u2018reconciliation is diligently conducted and completed\u2019 by her office before certification.\u201d<\/p>\n<p>Perkins-Hooker sent a follow-up email that same evening, in which she instructed Williams to \u201ctake no action\u201d on Adams\u2019 request \u201cuntil the board approves making any changes in our existing certification process.\u201d The then-BRE chair further told Adams she would need to seek approval from the entire elections board before accessing the requested records.<\/p>\n<div class=\"fdrlst__b89e9-d9ee4e6b84723ac7b36b8b4e8078c037 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-d9ee4e6b84723ac7b36b8b4e8078c037\"><\/div>\n<p>Adams ultimately voted against certification of the primary results on March 19, arguing that the board\u2019s decision to deny her access to the sought-after materials prevented her from fulfilling her role in \u201cinspect[ing] systematically and thoroughly the conduct of primaries and elections \u2026 to the end that primaries and elections may be honestly, efficiently, and uniformly conducted.\u201d<\/p>\n<p>Subsequent attempts by Adams to obtain the aforementioned records in the weeks that followed were similarly denied by Williams. The Democrat Party of Georgia also issued a letter to the board claiming \u201ccertification of election results is a ministerial\u00a0task \u2026 not subject to [board members\u2019] discretion\u201d and suggesting <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/president-trump-please-pardon-jon-woods-a-victim-of-process-crimes-like-michael-flynn\/\" title=\"President Trump, Please Pardon Jon Woods, a Victim of Process Crimes Like Michael Flynn\">board members<\/a> could be held criminally liable for not voting to certify.<\/p>\n<p>Adams has asked the Fulton County Superior Court to issue a declaration asserting that BRE members\u2019 duties are \u201cdiscretionary, not ministerial, in nature,\u201d and that they are authorized to have complete access to the Election Materials and Processes. She also requested that injunctions be issued barring defendants from withholding such materials from board members and mandating their disclosure \u201cduring and after\u201d Georgia\u2019s May 21 statewide primaries.<\/p>\n<p>It\u2019s not the first time Fulton County has been accused of misconduct. As my colleague Brianna Lyman previously <a href=\"https:\/\/thefederalist.com\/2024\/05\/09\/board-refuses-to-have-fulton-county-investigated-for-double-scanning-3000-ballots-in-2020-recount\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, the BRE was recently chastised by the Georgia State Election Board for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/maricopa-county-scrapping-voting-machines-used-in-gop-audit\/\" title=\"Maricopa County Scrapping Voting Machines Used In GOP Audit\">violating election law<\/a> during the 2020 contest.<\/p>\n<p>In a 2-1 decision, the state board ruled \u201cthat Fulton County must have an independent election monitor to oversee its elections after it found more than 3,000 ballots were scanned twice during the 2020 presidential recount,\u201d as Lyman summarized.
