The nominee, Judge Sarah Netburn, faced scrutiny over a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nurses-fired-for-questioning-nhs-transgender-polices-parliament-told\/\" title=\"Nurses Fired for Questioning NHS Transgender Polices, Parliament Told\">male sex offender<\/a> \u200bbeing transferred\u2064 to a women&#8217;s prison. Cruz challenged Netburn on prioritizing rights over political ideology, highlighting concerns about individuals&#8217; rights. This contentious exchange raised\u2063 issues of prison safety \u2063and rights \u200cviolations.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p>Sen. <a href=\"https:\/\/www.dailywire.com\/topic\/ted-cruz\" target=\"_blank\" rel=\"noopener\">Ted Cruz<\/a> (R-TX) grilled one of President Joe Biden\u2019s judicial nominees on Thursday for allowing a male prisoner convicted of sex crimes to be transferred to a women\u2019s prison.<\/p>\n<p>Cruz questioned U.S. Magistrate Judge Sarah Netburn, who was nominated by Biden to serve on the U.S. District Court for the Southern District of New York, about the incident during a Senate Judiciary Committee hearing.<\/p>\n<p>\u201cIn your court, what matters more: the rights of individuals or your political ideology?\u201d Cruz asked.<\/p>\n<p>She claimed that her political ideology \u201cdoesn\u2019t matter at all,\u201d to which Cruz responded: \u201cOkay, so I don\u2019t believe you. And I think this case demonstrates that you are willing to subjugate the rights of individuals to satisfy your political ideology.\u201d<\/p>\n<p>Netburn acknowledged that the defendant admitted to raping a nine-year-old boy and a 17-year-old girl and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/middle-school-teacher-in-texas-arrested-on-possession-of-child-pornography-charges\/\" title=\"Middle School Teacher In Texas Arrested On Possession Of Child Pornography Charges\">distributing child pornography<\/a> that showed adults violently raping children.<\/p>\n<p>The judicial candidate used the criminal\u2019s pronouns and claimed that he was \u201chormonally a female.\u201d<\/p>\n<p>\u201cSo you took a six-foot-two <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sen-reed-pushes-for-legislation-on-sexual-assaults-in-military\/\" title=\"Sen. Reed Pushes For Legislation on Sexual Assaults in Military\">serial rapist<\/a>, serial child rapist with male genitalia, and he said, \u2018You know, I\u2019d like to be in a women\u2019s prison,&#8217;\u201d Cruz said. \u201cAnd your answer was, \u2018that sounds great to me.&#8217;\u201d<\/p>\n<p>\u201cThe other women in that prison, do they have any rights?\u201d Cruz asked.<\/p>\n<p>Netburn asked if Cruz was asking her a question, and then acknowledged that they do have rights.<\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1700760801843000&#038;usg=AOvVaw2PQrVSrJfhxNb4LcARqniG\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p>\u201cSenator Cruz, I considered the facts presented to me and I reached a decision based on what the law is,\u201d she claimed. \u201cEvery person who\u2019s incarcerated has the right to be safe in their space.\u201d<\/p>\n<p>Cruz tore into Netburn, saying that her order was not the type of order that a judge issues, but rather the type of order that a judicial activist would write.<\/p>\n<p>\u201cThe Bureau of Prisons argued what I\u2019m saying right now, that if you put this person in a female prison, there will be a risk of sexual assault to the women, and you know what you did? You said you didn\u2019t care about the women,\u201d Cruz said. \u201cI\u2019m gonna quote what you wrote. You wrote, quote, \u2018The Bureau of Prisons claimed penological interest in protecting female prisoners from sexual violence and trauma. This interest is legitimate. But there are no signs that petitioner is at risk of reoffending. The record is devoid of evidence of incidents of violence or assault during petitioner\u2019s incarceration when she was the perpetrator, only the victim. A theoretical risk of sexual assault by the prisoner without more cannot support the BOPs position.
