District Judge Aileen Cannon uncovered numerous documents linked to Trump&#8217;s 40-count federal indictment\u2063 in Florida for mishandling \u200dsensitive records from his Mar-a-Lago residence. The prosecution&#8217;s request for redactions sparked\u2063 concerns during\u2062 this \u200bongoing legal saga.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/justice-department\/\" target=\"_blank\" rel=\"noopener\" title>Justice Department<\/a> under the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/biden-administration\/\" target=\"_blank\" rel=\"noopener\" title=\"Biden administration\">Biden administration<\/a> was more aggressive when pursuing former President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\/\" target=\"_blank\" rel=\"noopener\" title>Donald Trump<\/a> in the classified documents case than previously known, according to newly released court filings.<\/p>\n<p>U.S. District Judge Aileen Cannon on Tuesday unsealed hundreds of documents related to Trump\u2019s 40-count federal indictment in <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/florida\/\" target=\"_blank\" rel=\"noreferrer noopener\">Florida<\/a> over his handling of sensitive records retrieved from his <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/mar-a-lago\/\" target=\"_blank\" rel=\"noopener\" title>Mar-a-Lago<\/a> resort home after he left the White House in January 2021. Cannon <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/3010343\/judge-scolds-doj-stagnant-trump-documents-case\/\" target=\"_blank\" rel=\"noopener\" title=\"even dinged Smith by expressing \" concern>even dinged Smith by expressing \u201cconcern\u201d<\/a> the special counsel\u2019s office had sought redactions of information in the newly unsealed filings after previously giving the green light for that information to be published in an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/new-documents-suggest-democrats-sicced-the-cia-on-their-domestic-enemy-the-president\/\" title=\"New Documents Suggest Democrats Sicced The CIA On Their Domestic Enemy, The President\">earlier court filing<\/a>.<\/p>\n<p>A <em>Washington Examiner <\/em>review of <a href=\"https:\/\/www.courtlistener.com\/docket\/67490070\/united-states-v-trump\/?filed_after=&#038;filed_before=&#038;entry_gte=&#038;entry_lte=&#038;order_by=desc\" target=\"_blank\" rel=\"noopener\" title=\"hundreds of freshly unsealed federal court records\">hundreds of freshly unsealed federal court records<\/a> paints a picture of a far more aggressive effort than previously known by both the National Archives Records Administration and the DOJ to crack down on Trump\u2019s alleged mishandling of classified documents despite direct and continued correspondence between Trump lawyers and NARA officials.<\/p>\n<p>For example, <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.648653\/gov.uscourts.flsd.648653.561.1_1.pdf\" target=\"_blank\" rel=\"noopener\" title=\"Trump lawyers submitted copies email exchanges with NARA\">Trump lawyers submitted copies of email exchanges with NARA<\/a> general counsel Gary M. Stern on June 30, 2021, just five months after Trump left the White House.<\/p>\n<p>Stern said it had been \u201cthree weeks\u201d since a Trump lawyer provided an update about sensitive documents Trump kept about North Korea at Mar-a-Lago, and that then-Archivist David Ferriero, who was appointed under former President Barack Obama, pushed him to \u201cseek assistance of the Department of Justice.\u201d<\/p>\n<figure><figcaption>Response from NARA Gen. Counsel Gary Stern to Trump attorneys on Jun. 30, 2021.<\/figcaption><\/figure>\n<p>Stern\u2019s emails to Trump attorneys were attached to the former president\u2019s latest motion to dismiss the classified documents case based on prosecutorial abuse and denial of due process. Trump has repeatedly accused the Biden White House of colluding with NARA to bring about the criminal case, and the new emails suggest Ferriero may be a conduit to that theory.<\/p>\n<p>Trump lawyers wrote that NARA\u2019s \u201cpolitically motivated malicious intent is demonstrated by Ferriero\u2019s August 2022 social media post congratulating his former agency for its role in the Mar-a-Lago raid.\u201d<\/p>\n<p>Eleven days after the unprecedented FBI raid on Mar-a-Lago, Ferreiro <a href=\"https:\/\/www.facebook.com\/search\/posts?q=David%20Ferriero%20don%27t%20mess%20with%20the%20archivists&#038;filters=eyJycF9jcmVhdGlvbl90aW1lOjAiOiJ7XCJuYW1lXCI6XCJjcmVhdGlvbl90aW1lXCIsXCJhcmdzXCI6XCJ7XFxcInN0YXJ0X3llYXJcXFwiOlxcXCIyMDIyXFxcIixcXFwic3RhcnRfbW9udGhcXFwiOlxcXCIyMDIyLTFcXFwiLFxcXCJlbmRfeWVhclxcXCI6XFxcIjIwMjJcXFwiLFxcXCJlbmRfbW9udGhcXFwiOlxcXCIyMDIyLTEyXFxcIixcXFwic3RhcnRfZGF5XFxcIjpcXFwiMjAyMi0xLTFcXFwiLFxcXCJlbmRfZGF5XFxcIjpcXFwiMjAyMi0xMi0zMVxcXCJ9XCJ9In0%3D\" target=\"_blank\" rel=\"noopener\" title=\"posted to Facebook\">posted to Facebook<\/a> a link to an article published by UNC-Chapel Hill titled: \u201cDon\u2019t Mess with the Archivists.\u201d <\/p>\n<figure><figcaption>Former NARA Archivist David Ferriero reposted this story to his Facebook profile on Aug. 19, 2022.<\/figcaption><\/figure>\n<p>The newly released documents also revealed a Dec. 22, 2022 grand jury transcript from an interview with former Trump attorney Timothy Parlatore, who accused prosecutors at the time of not following the rules of attorney-client privilege.<\/p>\n<p>DOJ lawyers Julie Edelstein, Brett Reynolds and Anne McNamara pressed Parlatore about why Trump didn\u2019t allow him to discuss their private conversations if he was cooperating with their\u00a0investigations.<\/p>\n<p>\u201cThe question you just asked seems to indicate that, for somebody to be cooperative, they should waive their attorney-client privilege, which is absolutely wrong,\u201d Parlatore said, after objecting to the line of questioning.<\/p>\n<p>Reynolds chimed in to remind Parlatore that he was the witness to the grand jury, and Edelstein argued it was her obligation to ask that line of questioning.<\/p>\n<p>\u201cYou made a representation to this grand jury about what was said at a meeting,\u201d Edelstein said, \u201cand I asked you the basis of that representation.\u201d Parlatore again said the question was improper, and his testimony ended a short time later.<\/p>\n<p>The classified documents trial against Trump, his aide Walt Nauta, and Mar-a-Lago property manager Carlos De Oliveira was supposed to get underway this week at the federal courthouse in Miami, but Cannon indefinitely delayed the trial earlier this month because she needed more time to handle pretrial motions.<\/p>\n<figure><figcaption>Pictured is the Alto Lee Adams, Sr. U.S. Courthouse where U.S. District Court Judge Aileen Cannon held a pretrial conference to discuss procedures for handling classified information in the case against former President Donald Trump, Tuesday, July 18, 2023, in Fort Pierce, Fla.(AP Photo\/Lynne Sladky)<\/figcaption><\/figure>\n<p>Cannon also has yet to determine which classified evidence will be presented at the trial, or how to do so in a way that protects the sensitive materials. Due to the number of delays, some legal experts have said the public may not know exactly when a trial could be underway until late July or sometime in August.<\/p>\n<p>Nauta, 41, is accused of taking dozens of boxes from a storage room at Trump\u2019s property to Trump\u2019s residential quarters as investigators sought to retrieve all the classified documents from the property, along with allegations he planned to delete security footage to obstruct the investigation. He has pleaded not guilty to the eight charges he faces.<\/p>\n<p>The newly released documents from Tuesday included a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.648652\/gov.uscourts.flsd.648652.566.3.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">fresh images of Nauta<\/a> carrying boxes around Trump\u2019s Florida property. The photos are dated June 1, 2022, shortly before a Trump lawyer was scheduled to canvas the storage room for any documents with classified markings to be returned to the federal government.
