The case has raised concerns about judicial impartiality and fairness.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/news\/\">  News <\/a>   <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/russdavis\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/russdavis\/%20\"><span>Jack Davis<\/span><\/a> <\/span> <span>   May 22, 2024 at 8:05am <\/span> <\/span>  <\/header>\n<section>\n<p>The judge hearing the case in which former President Donald Trump is charged with falsifying business records has been slapped with an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/cruz-hawley-to-face-secretive-senate-ethics-committee-panel\/\" title=\"Cruz, Hawley To Face \u2018Secretive\u2019 Senate Ethics Committee Panel\">official ethics complaint<\/a>.<\/p>\n<p>Republican Rep. <a href=\"https:\/\/www.westernjournal.com\/gop-rep-stefanik-files-ethics-complaint-judge-engoron-alleging-bizarre-behavior-anti-trump-bias\/\" target=\"_blank\" rel=\"noopener\">Elise Stefanik<\/a>, whose congressional district covers a vast swath of northern and central New York state, <a href=\"https:\/\/x.com\/EliseStefanik\/status\/1793029871586754778\" target=\"_blank\" rel=\"noopener\">posted her complaint on social media platform X<\/a>.<\/p>\n<p>\u201cI just filed an official judicial complaint with the New York State Commission on Judicial Conduct against Acting Supreme Court Justice Juan Merchan for his clear violation of the Rules of Judicial Conduct for the New York State Unified Court System due to his family directly enriching itself off this sham trial against President Trump,\u201d she wrote.<\/p>\n<p>\u201cThe idea that he is in a position to preside over this trial fairly would be laughable if it weren\u2019t so dangerous,\u201d she added.<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">\ud83d\udea8\ud83d\udea8\ud83d\udea8 I just filed an official judicial complaint with the New York State Commission on Judicial Conduct against Acting Supreme Court Justice Juan Merchan for his clear violation of the Rules of Judicial Conduct for the New York State Unified Court System due to his family\u2026 <a href=\"https:\/\/t.co\/6JjIv7XpTP\">pic.twitter.com\/6JjIv7XpTP<\/a><\/p>\n<p>\u2014 Elise Stefanik (@EliseStefanik) <a href=\"https:\/\/twitter.com\/EliseStefanik\/status\/1793029871586754778?\">May 21, 2024<\/a><\/p>\n<\/blockquote>\n<p>  \u201cThe naked corruption on display in Judge Merchan\u2019s courtroom isn\u2019t only a threat to President Trump, but a threat to our <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/president-trump-please-pardon-jon-woods-a-victim-of-process-crimes-like-michael-flynn\/\" title=\"President Trump, Please Pardon Jon Woods, a Victim of Process Crimes Like Michael Flynn\">justice system<\/a> and democracy. It is election interference for financial gain and cannot be tolerated. Judge Merchan should have recused himself, but since he\u2019s refused, he must be held accountable for his judicial misconduct,\u201d she wrote.<\/p>\n<p>The text of the complaint noted that <a href=\"https:\/\/www.westernjournal.com\/watch-trump-sidesteps-judges-gag-order-reads-cnns-news-report-trial\/\" target=\"_blank\" rel=\"noopener\">Merchan\u2019s daughter<\/a> is president of Authentic Campaigns, which represents Democratic politicians and has sought to use the trial over which her father presides as a vehicle for raising money for Democrats.<\/p>\n<p>\u201cHis family\u2019s wealth is directly tied to attacking President Trump,\u201d Stefanik alleged.<\/p>\n<p>Stefanik cited court system rules that say \u201ca judge is disqualified from a case when the judge knows that a person known by the judge to be within the sixth degree of relationship to him \u2018has an interest that could be substantially affected by the proceeding.\u2019\u201d<\/p>\n<div id=\"firefly-poll-container\">\n<p>Should Judge Merchan be removed from the Trump trial?<\/p>\n<\/p><\/div>\n<p>She noted that if Trump is acquitted, it will hurt the clients for whom Merchan\u2019s daughter works, while if he is convicted, the clients of Merchan\u2019s daughter benefit.<\/p>\n<p>The complaint noted that the state Commission on Judicial Conduct \u201cprivately cautioned him in July over his illegal political donations to Biden and other Democrats in 2020. This private caution has not deterred Judge Merchan\u2019s judicial misconduct, as evidenced by this current complaint. Judge Merchan appears driven by Democrat partisanship and financial gain for his daughter.<\/p>\n<p>\u201cIt is imperative that New Yorkers and all Americans have confidence that justice is being dispensed fairly in New York. This is especially true in politically sensitive cases where bias is most likely to rear its ugly head,\u201d she wrote.<\/p>\n<p>\u201cJudge Merchan\u2019s clear conflict of interest, based upon his adult daughter\u2019s financial state in this <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trumps-mugshot-backfires-massively-on-the-left\/\" title=\"Trump's mugshot causes major backlash from the left.\">unprecedented criminal trial<\/a>, has badly damaged the court\u2019s appearance of impartiality. Given Judge Merchan\u2019s daughter\u2019s clientele\u2014and the vast sums of money that these individuals have raised and will continue to raise off of President Trump\u2019s charges\u2014 Judge Merchan\u2019s daughter stands to benefit the more legally imperiled President Trump is,\u201d she wrote, adding that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/republican-coalition-decries-treatment-of-jan-6-defendants-in-dc-gulag\/\" title=\"Republican Coalition Decries Treatment of Jan. 6 Defendants in \"DC Gulag\"\">court system\u2019<\/a>s rules required Merchan to recuse himself.<\/p>\n<p>As noted by <a href=\"https:\/\/www.axios.com\/2024\/05\/21\/stefanik-ethics-complaint-judge-merchan-trump\" target=\"_blank\" rel=\"noopener\">Axios<\/a>, in August Merchan refused to step down due to his daughter\u2019s job, using as a basis for his decision guidance from the state court system\u2019s Advisory Committee on Judicial Ethics.<\/p>\n<p>Testimony in <a href=\"https:\/\/www.westernjournal.com\/prosecutor-paid-democratic-national-committee-political-consulting-taking-trump-trial-report\/\" target=\"_blank\" rel=\"noopener\">Trump\u2019s trial<\/a> wrapped up Tuesday, according to <a href=\"https:\/\/www.foxnews.com\/politics\/trump-touts-defense-team-has-won-manhattan-case-he-calls-merchan-dismiss\" target=\"_blank\" rel=\"noopener\">Fox News<\/a>. The next step is for closing arguments. which will take place next week after Memorial Day.<\/p>\n<p>\u201cWe have a phenomenal case. We\u2019ve won the case by any standard; any other judge would have thrown this case, any other judge would have thrown this case out. And I think that Juan Merchan would do himself and the state and the city a great service by doing what everybody knows should be done,\u201d Trump said Tuesday.<\/p>\n<p>Trump defense attorney Todd Blanche has called for a motion to <a href=\"https:\/\/www.westernjournal.com\/trumps-legal-team-just-called-killshot-witness-stand-law-professor-jonathan-turley-says\/\" target=\"_blank\" rel=\"noopener\">dismiss the case<\/a>, saying the prosecution never proved that business records or filings connected to the case were false.
