Notably, President Joe Biden also retained classified documents following his tenure as vice president but was <a href=\"https:\/\/thefederalist.com\/2024\/03\/12\/hur-biden-white-house-pressured-me-to-change-my-report-findings\/\" target=\"_blank\" rel=\"noreferrer noopener\">not charged<\/a> by his own Justice Department because prosecutors said he would likely \u201cpresent himself to the jury, as he did during our interview with him, as a sympathetic, well-meaning, elderly man with a poor memory.\u201d<\/p>\n<p>A newly unsealed <a href=\"https:\/\/www.declassified.live\/p\/fbi-authorized-use-of-deadly-force?r=4yy1i&#038;utm_campaign=post&#038;utm_medium=web\" target=\"_blank\" rel=\"noreferrer noopener\">operations order<\/a> reveals the FBI was authorized to use deadly force against the former president if need be, Kelly reported.<\/p>\n<p>\u201cAccording to an \u2018Operations Order\u2019 produced in discovery, the FBI believed its objective for the Mar-a-Lago raid was to seize \u2018classified information, NDI [national defense information], and US Government records as described in [the] search warrant,&#8217;\u201d the filing by Trump\u2019s legal team states.<\/p>\n<p>\u201cThe Order contained a \u2018Policy Statement\u2019 regarding \u2018Use Of Deadly Force,\u2019 which stated, for example, \u2018Law enforcement officers of the Department of Justice may use deadly force when necessary \u2026\u2019,\u201d according to the filing. \u201cThe agents planned to bring \u2018Standard Issue Weapon[s],\u2019 \u2018Ammo,\u2019 \u2018Handcuffs,\u2019 and \u2018medium and large sized bolt cutters,\u2019 but they were instructed to wear \u2018unmarked polo or collared shirts\u2019 and to keep \u2018law enforcement equipment concealed.&#8217;\u201d<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<div lang=\"en\" dir=\"ltr\">\n<p>Tons of new unsealed filings on classified docs case\u2013I will try to post as much as I can (there goes the workout) but this is mind-blowing.<\/p>\n<p>FBI authorized the use of deadly force at Mar-a-Lago <a href=\"https:\/\/t.co\/f0lR6UifAH\">pic.twitter.com\/f0lR6UifAH<\/a><\/p>\n<\/div>\n<p>\u2014 Julie Kelly \ud83c\uddfa\ud83c\uddf8 (@julie_kelly2) <a href=\"https:\/\/twitter.com\/julie_kelly2\/status\/1792969008657948733?ref_src=twsrc%5Etfw\">May 21, 2024<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>The FBI also provided \u201ccoordinating instructions\u201d on the use of deadly force.<\/p>\n<figure>\n<p><span><\/p>\n<blockquote data-width=\"500\" data-dnt=\"true\">\n<div lang=\"en\" dir=\"ltr\">\n<p>Here is the use of deadly force instructions attached to the FBI&#8217;s operational instructions.<\/p>\n<p>Head of Washington FBI field office when this was executed: Steven D&#8217;Antuono.<\/p>\n<p>Recall who authorized the raid: Merrick Garland<\/p>\n<p>The FBI risked the lives of Donald Trump, his family, his\u2026 <a href=\"https:\/\/t.co\/XHHLDYqWgV\">pic.twitter.com\/XHHLDYqWgV<\/a><\/p>\n<\/div>\n<p>\u2014 Julie Kelly \ud83c\uddfa\ud83c\uddf8 (@julie_kelly2) <a href=\"https:\/\/twitter.com\/julie_kelly2\/status\/1792972717781586109?ref_src=twsrc%5Etfw\">May 21, 2024<\/a><\/p><\/blockquote>\n<p><\/span> <\/p>\n<\/figure>\n<p>Screenshots of the filing posted by Kelly suggest agents were prepared to confront Trump and his Secret Service agents if the need arose.<\/p>\n<p>\u201cShould [former President of the United States] arrive at [Mar-a-Lago], FBI MM EM and OSCs will be prepared to engage with FPOTUS and USSS Security Team,\u201d <a href=\"https:\/\/x.com\/julie_kelly2\/status\/1792970849861116080\" target=\"_blank\" rel=\"noreferrer noopener\">read<\/a> a \u201cContingencies\u201d list from the filing. (MM may be a reference to the Miami FBI office, and OSC appears to refer to the office of Special Counsel Jack Smith.) The list also included instructions in case the Secret Service were to \u201cprovide resistance or interfere with FBI timeline or accesses.\u201d<\/p>\n<p>The filings also included exhibits indicating agents searched both Melania and Barron Trump\u2019s rooms, and were prepared to go door-to-door throughout Mar-a-Lago \u201cto determine occupation status\u201d of each room if the staff did not provide \u201ca list of occupied guest rooms.\u201d<\/p>\n<p>Earlier this month, U.S. District Judge Aileen Cannon indefinitely <a href=\"https:\/\/thefederalist.com\/2024\/05\/08\/judge-halts-trumps-classified-docs-trial-after-doj-admits-to-evidence-tampering\/\" target=\"_blank\" rel=\"noreferrer noopener\">postponed<\/a> the trial in Smith\u2019s lawfare case against the former president after the DOJ admitted it tampered with evidence.
