Will it backfire once more\">intense legal scrutiny<\/a> and \u200dstrategic testimonies.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/news\/\">  News <\/a>   <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/russdavis\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/russdavis\/%20\"><span>Jack Davis<\/span><\/a> <\/span> <span>   May 21, 2024 at 8:22am <\/span> <\/span>  <\/header>\n<section>\n<p>Fox News contributor and legal scholar Jonathan Turley said testimony from Michael Cohen\u2019s former legal adviser Robert Costello could finish off the prosecution\u2019s case against former President Donald Trump.<\/p>\n<p>Trump has been charged with <a href=\"https:\/\/www.westernjournal.com\/legal-expert-says-alvin-braggs-first-choice-witness-trump-trial-telling\/\" target=\"_blank\" rel=\"noopener\">falsifying business records<\/a> in connection with payments made to porn star Stormy Daniels in 2016.<\/p>\n<p>Turley, a professor of law at George Washington University, said he believed Trump\u2019s defense is winning, and Costello\u2019s Monday testimony should seal the deal, according to <a href=\"https:\/\/www.foxnews.com\/media\/jonathan-turley-robert-costello-killshot-witness?intcmp=tw_fnc\" target=\"_blank\" rel=\"noopener\">Fox News<\/a>.<\/p>\n<p>\u201cIf I think I\u2019m going to win a case, I\u2019m going to stop. And I think they have won this case. The problem is that this is not an ordinary case,\u201d he said during the Fox News show \u201cThe Story.\u201d<\/p>\n<p>\u201cSo my view is that even if there\u2019s a conviction, it would have to be overturned at this point. But this is a man running for president. Quite frankly, Costello is a killshot witness,\u201d he said.<\/p>\n<p>\u201cYou only call him if you want to killshot at trial, that you feel that you need to make sure this doesn\u2019t result in a conviction, even though I think it\u2019s going very well for the defense. And it went very well today for the defense,\u201d he said.<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">\u2026Committing major larceny is not a particularly appealing pitch for taking an office with the power over the purse. Judge Juan Merchan allowed some, but not all, of what the defense wanted, according to <a href=\"https:\/\/www.washingtonpost.com\/politics\/2024\/05\/21\/robert-costello-trump-trial-transcript\/\" target=\"_blank\" rel=\"noopener\">The Washington Post<\/a>.<\/p>\n<p>\u201cI will give you some latitude to explore the pressure campaign so that you can elicit some inconsistencies, so you can offer some rebuttal of Mr. Cohen\u2019s testimony. But I\u2019m not going to allow this to become a trial within a trial as to whether or not there was, in fact, this pressure campaign and how it affected Cohen. That\u2019s not the purpose of this trial, and I don\u2019t want it to become that,\u201d Merchan said.<\/p>\n<p data-testid=\"drop-cap-letter\" data-el=\"text\">During Costello\u2019s time on the stand Monday, Merchan sustained at least 14 prosecution objections that blocked questions from Trump\u2019s defense.<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">When the press was thrown out of the Trump trial, the judge told Robert Costello, the witness, he was acting contemptuously and threatened to strike his testimony and remove him from the stand.
