Texas Attorney \u2064General Ken Paxton praised the decision.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/news\/\">  News <\/a>   <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/russdavis\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/russdavis\/%20\"><span>Jack Davis<\/span><\/a> <\/span> <span>   May 20, 2024 at 11:25am <\/span> <\/span>  <\/header>\n<section>\n<p>A Biden administration rule that would have vastly expanded background check requirements for people who sell guns has been shot down by a federal judge.<\/p>\n<p>U.S. District Court Judge Matthew Kacsmaryk granted an injunction to Texas and several gun rights groups preventing the Bureau of Alcohol, Tobacco, Firearms and Explosives from implementing the rule in Texas, according to <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4674214-federal-judge-in-texas-blocks-bide-rule-expanding-gun-background-checks\/\" target=\"_blank\" rel=\"noopener\">The Hill<\/a>.<\/p>\n<p>Kacsmaryk, an appointee of former President <a href=\"https:\/\/www.westernjournal.com\/trump-ignites-controversy-claiming-buying-glock-gun-shop-visit\/\" target=\"_blank\" rel=\"noopener\">Donald Trump<\/a>, ruled that Louisiana, Mississippi and Utah, which joined Texas in the suit, did not have standing to sue.<\/p>\n<p>However, members of several gun rights groups, including the 2-million-member strong <a href=\"https:\/\/www.gunowners.org\/about-goa\/\" target=\"_blank\" rel=\"noopener\">Gun Owners of America<\/a>, are covered by the ruling.<\/p>\n<p>Other groups covered by the ruling were the Gun Owners Foundation, the Tennessee Firearms Association and the Virginia Citizens Defense League, according to the <a href=\"https:\/\/www.texasattorneygeneral.gov\/sites\/default\/files\/images\/press\/ATF%20Rule%20TRO.pdf\" target=\"_blank\" rel=\"noopener\">ruling<\/a>.<\/p>\n<p>The rule was scheduled to take effect Monday. It required anyone who <a href=\"https:\/\/www.westernjournal.com\/biden-admin-launches-new-rule-targeting-ghost-guns\/\" target=\"_blank\" rel=\"noopener\">sells a gun<\/a> to be licensed and conduct the same background checks as gun stores.<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">The ATF saying \u201cjust trust us\u201d is akin to those scary words \u201cI\u2019m from the government and I\u2019m here to help.\u201d<\/p>\n<p>We don\u2019t trust you. Kacsmaryk\u2019s ruling did not address the Second Amendment claim, but said the rule proposed by ATF was in violation of the law.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Should Biden\u2019s background check measure be declared unconstitutional?<\/p>\n<\/p><\/div>\n<p>He found the ATF rule unjustly applied to those who buy and sell guns for their \u201cpersonal collection.\u201d<\/p>\n<p>The ruling said that the presumptions upon which the <a href=\"https:\/\/www.westernjournal.com\/bidens-newly-proposed-budget-calls-nearly-2-billion-towards-federal-crackdown-guns\/\" target=\"_blank\" rel=\"noopener\">final ATF rule<\/a> was based \u201care highly problematic for at least two reasons. First, they flip the statute on its head by requiring that firearm owners prove innocence rather than the government prove guilt.\u201d<\/p>\n<p>The ruling also found conflicts between the rule in question and the law it was supposedly enforcing.<\/p>\n<p>\u201cPlaintiffs understandably fear that these presumptions will trigger civil or criminal penalties for conduct deemed lawful just yesterday. Nevertheless, ATF avers that its \u2018knowledge of existing case law\u2019 and \u2018subject-matter expertise\u2019 will prevent misuse or abuse of the presumptions. \u2026 In other words, \u2018just trust us,\u2019\u201d the ruling said.<\/p>\n<p>\u201cThe absurdity that the statute\u2019s safe harbor provision provides no safe harbor at all for the majority of gun owners,\u201d Kacsmaryk wrote.<\/p>\n<p>The ATF rule is in limbo until a June 2 hearing, <a href=\"https:\/\/www.reuters.com\/world\/us\/us-judge-blocks-biden-backed-rule-expanding-gun-background-checks-2024-05-20\/\" target=\"_blank\" rel=\"noopener\">Reuters<\/a> reported.<\/p>\n<p>Texas Attorney General Ken Paxton proclaimed victory in a news release on his website.<\/p>\n<p>\u201cThe Final Rule was arbitrary and capricious and flagrantly violated the Second Amendment. Despite Congress having recognized the legality of private firearms sales by non-dealers, the Biden Administration issued a new regulation that would subject hundreds of thousands of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/utah-axes-gun-permit-requirement\/\" title=\"Utah Axes Gun-Permit Requirement\u00a0\">law-abiding gun owners<\/a> to presumptions of criminal guilt for engaging in constitutionally protected activities,\u201d <a href=\"https:\/\/www.texasattorneygeneral.gov\/news\/releases\/attorney-general-ken-paxton-secures-temporary-restraining-order-against-biden-administration\" target=\"_blank\" rel=\"noopener\">Paxton\u2019s release<\/a> said.<\/p>\n<p>\u201cI am relieved that we were able to secure a restraining order that will prevent this illegal rule from taking effect,\u201d he said. \u201cThe Biden Administration cannot unilaterally overturn Americans\u2019 constitutional rights and nullify the Second Amendment.\u201d<\/p>\n<hr>\n<div>\n<p><b><i>A Note from Our Deputy Managing Editor:<\/i><\/b><\/p>\n<p><i><span>I heard a chilling comment the other day: \u201cWe don\u2019t even know if an election will be held in 2024.\u201d <\/span><\/i><\/p>\n<p><i><span>That wasn\u2019t said by a conspiracy theorist or a doomsday prophet.
