The ICC, \u2063targeting \u200bgenocide and crimes against humanity, relies\u200b on member\u2063 nations for arrests,\u200d potentially affecting travel for accused individuals.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The prosecutor of the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/international-criminal-court\" target=\"_blank\" rel=\"noopener\" title>International Criminal Court<\/a> announced on Monday that he had <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/israeli-officials-blast-icc-move-to-arrest-netanyahu-gallant-huge-boost-to-global-jihadi-terror\/\" title=\"Israeli authorities strongly criticize the ICC's decision to arrest Netanyahu and Gallant, labeling it a significant boost to global jihadi terrorism\">requested arrest warrants<\/a> for Israeli Prime Minister <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/benjamin-netanyahu\" target=\"_blank\" rel=\"noopener\" title>Benjamin Netanyahu<\/a>, Defense Minister Yoav Gallant, and three leaders of Hamas.<\/p>\n<h2>Why has the ICC pursued arrest warrants?<\/h2>\n<p>Chief prosecutor Karim Khan said he\u2019s pursuing arrest warrants for Netanyahu and Gallant because he believes they were responsible for war crimes and crimes against humanity, including the starvation of civilians as a weapon of war and \u201cintentionally directing attacks against a civilian population.\u201d<\/p>\n<p>The warrants have not yet been issued because judges from the court must approve them.<\/p>\n<p>Several Israeli leaders objected to the ICC\u2019s announcement, arguing that its leaders and the conduct of the Israeli military should not be compared to the U.S.-designated terrorist organization <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/hamas\" target=\"_blank\" rel=\"noopener\" title>Hamas<\/a> that carried out the Oct. <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/israel-conducts-limited-raid-into-gaza-ahead-of-ground-incursion\/\" title=\"Israel launches small-scale raid into Gaza before planned ground invasion.\">7 terrorist attacks<\/a>. The United States shared that sentiment.<\/p>\n<p>\u201cThe ICC prosecutor\u2019s application for arrest warrants against Israeli leaders is outrageous,\u201d President Joe Biden said in a statement.\u00a0\u201cAnd let me be clear: whatever this prosecutor might imply, there is no equivalence \u2014 none \u2014 between Israel and Hamas.\u00a0We will always stand with Israel against threats to its security.\u201d<\/p>\n<p>Hamas\u2019s attack resulted in the deaths of roughly 1,200 people and the kidnapping of approximately 250 more. Israel\u2019s retaliation, with the intent of eliminating Hamas, has included the deaths of around 14,000 militants and about 16,000 civilians, according to Netanyahu, the displacement of most of Gaza, and has pushed every Palestinian living in the strip to the brink of famine. The Hamas-controlled Gaza Health Ministry has said the death toll is near 35,000 and does not distinguish between civilians and combatants.<\/p>\n<p>Khan is also seeking warrants for Yahya Sinwar, the head of Hamas in Gaza; Mohammed Deif, the head of the military; and Ismail Haniyeh, the head of their political bureau, for their roles in the Oct. 7 terrorist attack.<\/p>\n<p>\u201cThe suggestion of moral equivalence between a democracy trying to defend its citizens and minimize civilian casualties in Gaza versus a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/it-begins-israel-calls-up-thousands-of-troops-positions-heavy-machinery-for-ground-offensive\/\" title=\"IT BEGINS: Israel Calls Up Thousands Of Troops, Positions Heavy Machinery For Ground Offensive\">terror organization deliberately<\/a> trying to murder civilians and use its own people as human shields is deeply misguided and dangerous,\u201d Bradley\u00a0Bowman, a director at the Foundation for Defense of Democracies, told the <em>Washington Examiner<\/em>.<\/p>\n<p>On Monday, Israeli Foreign Minister Israel Katz said he had ordered the immediate establishment of a special committee aimed at fighting the decision, which he claimed \u201cwas intended first and foremost to tie the hands of the state of Israel and deny it the right of self-defense.\u201d<\/p>\n<figure><figcaption>Karim Khan, prosecutor of the International Criminal Court, addresses a Security Council meeting on the situation in Sudan, Thursday, July 13, 2023, at United Nations headquarters. (AP Photo\/Mary Altaffer)<\/figcaption><\/figure>\n<h2>What is the ICC?<\/h2>\n<p>The ICC, which was created in 2002, is the world\u2019s only permanent international court that can prosecute people accused of war crimes, genocide, and crimes against humanity, though Israel is not among the 124 member nations. Palestine has been a member of the ICC since 2015.<\/p>\n<p>The court cannot try defendants in absentia and relies on its members to make arrests. So, Netanyahu and Gallant could be arrested, if the warrants are in fact issued, if they travel to one of the countries that is a member of the court.<\/p>\n<p>\u201cAny attempt to draw parallels between these atrocious terrorists and a democratically elected government of Israel, working to fulfill its duty to defend and protect its citizens entirely in adherence to the principles of international law, is outrageous and cannot be accepted by anyone,\u201d Israeli President Isaac Herzog said. \u201cWe will not forget who started this war and who raped, butchered, burned, brutalized, and kidnapped innocent citizens and families.\u201d<\/p>\n<h2>Does the U.S. acknowledge the ICC?<\/h2>\n<p>The U.S. is not a member state of the court.<\/p>\n<p>U.S. Secretary of State <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/antony-blinken\" target=\"_blank\" rel=\"noopener\" title>Antony Blinken<\/a>, in his first comments about the ICC\u2019s pursuit of arrest warrants, said in a statement, \u201cThe United States has been clear since well before the current conflict that that ICC has no jurisdiction over this matter.\u201d<\/p>\n<p>\u201cThe ICC was established by its state parties\u00a0as a court of limited jurisdiction,\u201d he added.\u00a0\u201cThose limits are rooted in principles\u00a0of complementarity, which do not appear to have\u00a0been applied here amid the\u00a0Prosecutor\u2019s rush to seek these arrest warrants rather than allowing the Israeli legal system\u00a0a full and timely opportunity to proceed.\u00a0In\u00a0other\u00a0situations, the Prosecutor\u00a0deferred to national investigations and\u00a0worked with\u00a0states\u00a0to\u00a0allow\u00a0them time\u00a0to investigate.\u00a0The Prosecutor did not afford the same opportunity to Israel, which has ongoing investigations into allegations against its personnel.\u201d<\/p>\n<p>He also raised questions about the way the investigation was conducted, in part because Israel has investigations ongoing and in other cases\u00a0the prosecutor\u00a0has deferred to national investigations and\u00a0worked with\u00a0states\u00a0to\u00a0allow\u00a0them time\u00a0to investigate. Khan was supposed to travel to Israel next week to meet with Israeli leaders about the investigation.<\/p>\n<p>State Department spokesman Matthew Miller acknowledged that the U.S. does not believe the ICC has the jurisdiction to issue arrest warrants for either the Israeli or Hamas leaders.<\/p>\n<h2>Is it likely Israelis would be arrested?<\/h2>\n<p>ICC judges have approved the arrest warrants for 46 people, and most of them have not been tried. Only 10 of these people have been convicted, and four have been acquitted. Charges against seven people have been dropped due to their deaths. Seventeen people who have ICC warrants for their arrest remain at large.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\" target=\"_blank\" rel=\"noopener\" title>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong><\/p>\n<p>In March 2023, the ICC issued an arrest warrant for Russian President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/vladimir-putin\" target=\"_blank\" rel=\"noopener\" title>Vladimir Putin<\/a>, whom the court deemed responsible for the forced deportation of thousands of Ukrainian children to Russia, and a couple of months later, he <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2580901\/putin-to-skip-johannesburg-summit-next-month-following-icc-arrest-warrant\/\" target=\"_blank\" rel=\"noopener\" title>skipped<\/a> an\u00a0economic summit next month in Johannesburg, South Africa, because it is a member of the court.<\/p>\n<p>Other leaders whom the ICC has <a href=\"https:\/\/www.nytimes.com\/live\/2024\/05\/20\/world\/israel-gaza-war-hamas-rafah\/here-are-some-other-leaders-for-whom-the-international-criminal-court-has-issued-arrest-warrants?smid=url-share\" target=\"_blank\" rel=\"noopener\" title>issued<\/a> arrest warrants for include former Sudanese President Omar Hassan al Bashir and other officials in 2009 and 2010;\u00a0Libya\u2019s then-leader Col.
