Judge Kacsmaryk found \u2064violations of the Administrative\u200c Procedure Act, shielding individuals from penalties. The decision impacts certain groups, with some states lacking standing to contest the rule.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><span style=\"font-weight: 400\">Texas and a group of gun rights organizations won a legal victory on Sunday after a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/house-republicans-accuse-biden-of-playing-political-game-over-border-crisis\/\" title=\"House Republicans Accuse Biden of Playing \u2018Political Game\u2019 Over Border Crisis\">federal judge temporarily blocked<\/a> a <a href=\"https:\/\/www.dailywire.com\/topic\/gun-control\" target=\"_blank\" rel=\"noopener\">gun control<\/a> rule from the Biden administration regulating private firearm sales. <\/span><\/p>\n<p><span style=\"font-weight: 400\">Federal Judge Matthew Kacsmaryk said that the Biden administration could not implement a policy against Texas or members of multiple gun rights groups that require individuals who \u201cearn a profit\u201d selling guns to conduct background checks and have a federal firearms license <\/span><a href=\"https:\/\/www.dailywire.com\/news\/kamala-harris-announces-new-rule-all-gun-dealers-must-conduct-background-checks\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">no matter<\/span><\/a><span style=\"font-weight: 400\">  where or how they sell their merchandise.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In his 14-page <a href=\"https:\/\/www.texasattorneygeneral.gov\/sites\/default\/files\/images\/press\/ATF%20Rule%20TRO.pdf\" target=\"_blank\" rel=\"noopener\">ruling<\/a>, Kacsmaryk said that the rule likely violates the Administrative Procedure Act (APA) and was not in alignment with the \u201cBipartisan Safer Communities Act,\u201d (BSCA) which the Justice Department cited in its justifications for implementing the policy. He said that because of this determination, evaluating the other arguments made against the rule was unnecessary. <\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cPlaintiffs understandably fear that these presumptions will trigger civil or criminal penalties for conduct deemed lawful just yesterday,\u201d the judge wrote. \u201cOther Plaintiffs face both civil and criminal enforcement actions for engaging in conduct that the BSCA permits but the Final Rule impermissibly forbids.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">The decision applies to Texas, the Gun Owners of America, the Gun Owners Foundation, the Tennessee Firearms Association, and the Virginia Citizens Defense League. The judge ruled that Louisiana, Mississippi, and Utah failed to demonstrate standing and did not issue the temporary injunction in their favor. <\/span><\/p>\n<p><span style=\"font-weight: 400\">Republicans have argued that the <\/span><a href=\"https:\/\/www.regulations.gov\/document\/ATF-2023-0002-0001#:~:text=921(a)(21)(C)%20as%20%E2%80%9Ca%20person,makes%20occasional%20sales%2C%20exchanges%2C%20or\"><span style=\"font-weight: 400\">regulations<\/span><\/a><span style=\"font-weight: 400\">  infringe on Second Amendment rights and would make it a felony for family members and friends to sell guns to each other without conducting background checks or having a federal license. <\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cI am relieved that we were able to secure a restraining order that will prevent this illegal rule from taking effect,\u201d Texas Attorney General Ken Paxton <a href=\"https:\/\/www.texasattorneygeneral.gov\/news\/releases\/attorney-general-ken-paxton-secures-temporary-restraining-order-against-biden-administration\" target=\"_blank\" rel=\"noopener\">said<\/a> in response to the ruling. \u201cThe Biden Administration cannot unilaterally overturn Americans\u2019 constitutional rights and nullify the Second Amendment.\u201d<\/span><\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1714657703188000&#038;usg=AOvVaw0-8IzS3B7axoRMsynY0m75\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p><span style=\"font-weight: 400\">Gun Owners of America President Erich Pratt praised the decision. <\/span><\/p>\n<p><span style=\"font-weight: 400\">\u201cPresident Biden and his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-judge-blocks-biden-administrations-new-gun-restriction-hours-before-it-was-to-take-effect\/\" title=\"Biden's new gun restriction blocked by federal judge just before implementation.\">anti-gun administration<\/a> have aggressively pursued an agenda meant to harass, intimidate, and criminalize gun owners and dealers at every turn,\u201d he said. \u201cThis ruling is a compelling rebuke of their tyrannical and unconstitutional actions that purposely misinterpreted federal law to ensure their preferred policy outcome.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">The rule broadly goes into effect on Monday after it faced a flurry of <a href=\"https:\/\/www.dailywire.com\/news\/red-states-challenge-biden-admins-blatantly-unconstitutional-regulations-on-private-gun-sales\" target=\"_blank\" rel=\"noopener\">lawsuits<\/a>.
