The commentary by Samuel Short on May \u206320, 2024, delves into the scrutiny directed \u2064at special counsel Jack Smith\u2062 in \u2063the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/former-rudy-giuliani-employee-files-explosive-lawsuit-against-him-seeks-10-million\/\" title=\"Ex-employee of Rudy Giuliani sues him for  million.\">legal battle involving<\/a> former \u200bPresident Donald Trump.\u2063 U.S. District Judge\u2064 Aileen Cannon voiced apprehensions regarding Smith&#8217;s management of confidential documents, drawing \u2062attention \u200cto discrepancies and casting\u200d doubt \u200don the procedural \u200bintegrity.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/commentary\/\">  Commentary <\/a>   <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/sshort\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/sshort\/%20\"><span>Samuel Short<\/span><\/a> <\/span> <span>   May 20, 2024 at 10:18am <\/span> <\/span>  <\/header>\n<section>\n<p>As lawfare against former President Donald Trump continues, special counsel Jack Smith is facing backlash for his actions in Trump\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-asks-supreme-court-to-reject-trump-request-in-fbi-classified-documents-case\/\" title=\"DOJ Asks Supreme Court to Reject Trump Request in FBI Classified Documents Case\">classified documents case<\/a>.<\/p>\n<p><a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.648653\/gov.uscourts.flsd.648653.552.0.pdf\" target=\"_blank\" rel=\"noopener\">In a filing posted Sunday<\/a>, U.S. District Judge Aileen Cannon for the Southern District of Florida said, \u201cThe Court deems it necessary to express concern over the Special Counsel\u2019s treatment of certain sealed materials in this case.\u201d Smith, working as special counsel for the <a href=\"https:\/\/www.westernjournal.com\/department-justice-conducting-criminal-investigation-squad-congresswoman-report\/\" target=\"_blank\" rel=\"noopener\">Department of Justice<\/a>, is prosecuting Trump for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-launches-2024-presidential-bid\/\" title=\"Trump Launches 2024 Presidential Bid\">allegedly mishandling classified documents<\/a> that he took to his Mar-a-Lago estate in Palm Beach, Florida, after leaving office in January 2021.<\/p>\n<p>Trump faces 40 felony counts in the case.<\/p>\n<p>The aforementioned \u201cconcern\u201d from Cannon \u2014 a Trump appointed judge \u2014 stemmed from Smith\u2019s asking her to keep information from the public in order to protect the secrecy of the grand jury and protect witnesses in the case. She stated Smith ignored those issues at other points in the case.<\/p>\n<p>Cannon\u2019s filing said, \u201c[C]ounsel explained that the <a href=\"https:\/\/www.westernjournal.com\/biden-asserts-executive-privilege-block-release-damaging-special-counsel-audio\/\" target=\"_blank\" rel=\"noopener\">Special Counsel<\/a> took the position on unsealing in order to publicly and transparently refute defense allegations of prosecutorial misconduct raised in pretrial motions. Fair enough.\u201d<\/p>\n<p>She continued, \u201cnowhere in that explanation is there any basis to conclude that the Special Counsel could not have defended the integrity of his Office while simultaneously preserving the witness-safety and Rule6(e) concerns he has repeatedly told the Court, and maintains to this day, are of serious consequence, and which the Court has endeavored with diligence to accommodate in its multiple Orders on sealing\/redaction. The Court is disappointed in these developments.\u201d<\/p>\n<p>Cannon put her in filing that Smith had \u2014 during two separate filings \u2014 shown no objection to a full unsealing of docket entries.<\/p>\n<p>Cannon said, \u201cIn light of that repeated representation, and in the absence of any defense objection, <a href=\"https:\/\/www.westernjournal.com\/federal-court-rejects-parents-attempt-shield-children-lgbt-reading-assignments\/\" target=\"_blank\" rel=\"noopener\">the Court<\/a> unsealed those materials consistent with the general presumption in favor of public access.\u201d<\/p>\n<p>\u201cThe sealing and redaction rules should be applied consistently and fairly upon a sufficient factual and legal showing,\u201d she concluded.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Should Jack Smith be formally investigated?<\/p>\n<\/p><\/div>\n<p>Let\u2019s clarify that sequence of events.<\/p>\n<p>Smith \u2014 in two filings \u2014 did not have a problem with unsealing documents, and the defense had no problem with it. Now Smith is reversing course and asking Cannon to keep information from the public.<\/p>\n<p>Smith thought it was a good idea to let the public see what\u2019s happening so that, as Cannon put it, the prosecution can, \u201crefute defense allegations of prosecutorial <a href=\"https:\/\/www.westernjournal.com\/services-first-openly-transgender-military-chaplain-suspended-sexual-misconduct-report\/\" target=\"_blank\" rel=\"noopener\">misconduct <\/a>raised in pretrial motions.\u201d Now he appears to be going the other way.<\/p>\n<p>One would not be remiss in finding this entire case and Smith\u2019s actions to be a complete head scratcher. Further, Cannon can\u2019t be blamed for visible frustration with Smith\u2019s inconsistency.<\/p>\n<p>The DOJ has been weaponized against Trump to throw a wrench in his re-election bid. Smith has been brought in to do just that, but he can\u2019t seem to devise a winning strategy.<\/p>\n<p>Lawfare against Trump doesn\u2019t cease here as he is currently sitting through a trial in Manhattan where he <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-attends-n-y-court-hearing-after-judge-orders-criminal-trial-to-proceed-in-march\/\" title=\"Trump goes to court in NY after judge orders criminal trial to start in March\">faces 34 felony charges<\/a> of falsifying business records by Manhattan District Attorney <a href=\"https:\/\/www.westernjournal.com\/alvin-braggs-team-begs-judge-pile-even-punishment-trump\/\" target=\"_blank\" rel=\"noopener\">Alvin Bragg<\/a>.<\/p>\n<p>Some may accuse Cannon of favoritism as a Trump appointee, but that contradicts her actions in rejecting his request to redact multiple witness statements from his motions. It doesn\u2019t appear that anyone in their right mind would accuse the system of being biased <em>for <\/em>Trump.<\/p>\n<p>What\u2019s the endgame for Smith and Bragg?<\/p>\n<p>Without a hint of hyperbole, it is to undermine the electoral process in <a href=\"https:\/\/www.westernjournal.com\/good-news-trump-2024-election-looking-like-1968-5-ways\/\" target=\"_blank\" rel=\"noopener\">November<\/a>.<\/p>\n<p>The DOJ, Bragg, Smith, and the entire mishmash of anti-Trump legal activists fear his re-election and do not feel confident that he can be stopped by the voter.<\/p>\n<p>They must defeat him in the courtroom because there is little hope of beating him at the polls.<\/p>\n<hr>\n<div>\n<p><b><i>A Note from Our Deputy Managing Editor:<\/i><\/b><\/p>\n<p><i><span>\u201cWe don\u2019t even know if an election will be held in 2024.\u201d Those 12 words have been stuck in my head since I first read them. <\/span><\/i><\/p>\n<p><i><span>Former Lt.
