Despite citing\u2062 existing legislation, legal experts argue that this move may surpass permissible boundaries outlined in the Higher \u2062Education Act. The issue\u2064 raises \u200cconcerns \u200cabout the legality and\u200b scope of such initiatives.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>President <a href=\"http:\/\/washingtonexaminer.com\/tag\/joe-biden\/\" target=\"_blank\" rel=\"noopener\" title>Joe Biden\u2019s<\/a> administration\u2019s efforts to infuse campus workers with cash to help with get-out-the-vote efforts might have been illegal.<\/p>\n<p>Several lawyers are warning that the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/department-of-education\/\" target=\"_blank\" rel=\"noopener\" title>Department of Education<\/a>\u2019s <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2021-03-10\/pdf\/2021-05087.pdf\" target=\"_blank\" rel=\"noopener\" title>decision<\/a> to pay students to register voters with funds earmarked for work-study programs for students who work part-time on-campus jobs could be against the law. <\/p>\n<p>The Education Department based its decision on Biden\u2019s Executive Order 14019 that was signed in March 2021. The order encouraged \u201cthe federal government to expand access to, and education about, voter registration and election information, and to combat misinformation, in order to enable all eligible Americans to participate in our democracy.\u201d <\/p>\n<p>The Biden administration pointed to the Higher Education Act of 1965 and the Higher Education Opportunity Act of 2008, which permit the use of federal funds to pay students who \u201cincrease civic participation.\u201d <\/p>\n<p>However, Hans von Spakovsky, senior legal fellow in the Heritage Foundation\u2019s Edwin Meese III Center for Legal and Judicial Studies, told the <em><a href=\"https:\/\/www.thecollegefix.com\/biden-strong-arming-colleges-to-pay-students-to-collect-votes-likely-illegal-lawyers-say\/\" target=\"_blank\" rel=\"noopener\" title>College Fix<\/a> <\/em>that the Higher Education Act \u201csimply says that universities should do their best to distribute voter registration information to their own students.\u201d<\/p>\n<p>\u201cIt does not authorize the use of federal funds to pay students to engage in such activities, particularly to pay them to go outside of their college community to register voters who are not students,\u201d he said. \u201cThat is unprecedented.\u201d <\/p>\n<p>Von Spakovsky also noted that Section 487(a)(23) of the Higher Education Act \u201cdoes not apply in any state that either has same<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/republican-state-lawmakers-to-introduce-new-bills-to-limit-vote-by-mail-require-photo-id-to-vote-clean-dirty-voter-rolls\/\" title=\"Republican State Lawmakers to Introduce New Bills to Limit Vote-by-Mail, Require Photo ID to Vote, Clean Dirty Voter Rolls\">-day voter registration<\/a> or does not <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/democrat-senator-raphael-warnock-under-investigation-for-voter-registration-misconduct-reports\/\" title=\"Democrat Senator Raphael Warnock Under Investigation For Voter Registration Misconduct: Reports\">require voter registration<\/a>.\u201d<\/p>\n<p>\u201cThus, even under its mistaken interpretation of the law, the Department of Education has no authority to require colleges in those 23 states and the District of Columbia to engage in any voter registration activities of any kind,\u201d he said.<\/p>\n<p>Robert Eitel, a lawyer with the Defense of Freedom Institute for Policy Studies, said the Biden administration\u2019s decision is engaging in partisan activity as college campuses typically possess a higher Democratic voter demographic. <\/p>\n<p>\u201c\u200b\u200bThe responsibility of colleges and universities that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/court-upholds-religious-schools-title-ix-exemption\/\" title=\"Court Upholds Religious Schools Title IX Exemption\">receive federal financial aid<\/a> to \u2018make a good faith effort\u2019 to provide voter registration forms to students has been a relatively uncontroversial requirement of federal student aid compliance for decades, but leave it to the Biden administration to politicize the most generic of requirements,\u201d Eitel said.<\/p>\n<p>The lawyers argue the get-out-the-vote initiative on college campuses pushed by the Biden administration could be in violation of the Antideficiency Act, which prohibits the use of federal funds for purposes beyond their appropriation, and the Hatch Act, which limits the political activities of people paid by the federal government. <\/p>\n<p><a href=\"http:\/\/washingtonexaminer.com\/\" target=\"_blank\" rel=\"noopener\" title><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>In April, nearly 20 Republican state attorneys general called on the Department of Education to reverse its guidance calling on school administrators to use federal funds to pay students for get-out-the-vote efforts. <\/p>\n<p>\u201cIn other words, laudable activities like <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/virginia-democrats-arent-campaigning-against-youngkin-ahead-of-tuesday-elections\/\" title=\"Virginia Democrats are not actively campaigning against Youngkin before Tuesday's elections.\">encouraging voter turnout<\/a> and registering voters have to happen somewhere, and that somewhere decides elections,\u201d they <a href=\"https:\/\/ago.wv.gov\/Documents\/Correspondence%20re%20Work%20Study%20Guidance.pdf\" target=\"_blank\" rel=\"noopener\" title>said<\/a>. \u201cYour guidance effectively licenses colleges and universities to subsidize this activity\u2014and potentially swing elections by choosing where to direct these funds\u2014with taxpayer money.\u201d<\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>President Biden&#8217;s push to fund campus workers for voter turnout initiatives may have crossed legal boundaries.
