The legislation from Cruz and Britt comes as Republicans have tried to distance themselves from a recent <a href=\"http:\/\/washingtonexaminer.com\/tag\/alabama\/\" target=\"_blank\" rel=\"noopener\" title>Alabama<\/a> Supreme Court\u00a0ruling that created a <a href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/2867944\/how-alabama-ivf-ruling-cause-political-chaos-for-gop\/\" target=\"_blank\" rel=\"noopener\" title>political headache for Republicans<\/a> that risks alienating swing voters ahead of the November election and in the aftermath of the overturning of <em>Roe v. Wade.<\/em><\/p>\n<\/div>\n<p>The legislation does not prevent states from setting up \u201chealth and safety standards to govern IVF,\u201d but the senators say by placing funding conditions on the practice, it simply \u201censures that access to IVF is fully protected by federal law.\u201d<\/p>\n<p>\u201cWhile the Alabama Legislature after the court\u2019s decision promptly reiterated that IVF is protected, federal legislation would eliminate any ambiguity that might arise from future state-level judicial interpretations,\u201d the senators wrote in a Sunday <a href=\"https:\/\/www.wsj.com\/articles\/well-protect-both-life-and-ivf-81e2bf1f\" target=\"_blank\" rel=\"noopener\" title>op-ed<\/a> to the <em>Wall Street Journal<\/em>. \u201cOur goal is to make sure that any family\u2019s path to bringing a child into the world isn\u2019t compromised by preventable legal confusion.\u201d<\/p>\n<p>In February, Alabama\u2019s top court ruled that\u00a0frozen embryos are legally children and that the destruction of embryos constitutes a crime under the state\u2019s \u201cwrongful death of a minor\u201d law. <\/p>\n<p>Many GOP lawmakers <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2870481\/republicans-blast-alabama-ivf-ruling-as-decision-causes-political-upheaval-for-party\/\" target=\"_blank\" rel=\"noopener\" title>came out against the Alabama ruling<\/a> in the week following the court\u2019s decision. Kellyanne Conway, former adviser to former President Donald Trump, traveled to Capitol Hill in December and shared polling that 86% of <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2641915\/kellyanne-conway-warns-republicans-to-promote-contraception-or-risk-2024-defeat\/\" target=\"_blank\" rel=\"noopener\" title=\"voters support IVF\">voters support IVF<\/a>, even those who regard themselves as \u201cpro-life\u201d and evangelicals, at 78% and 83%, respectively.<\/p>\n<p>A Cruz aide told reporters ahead of the op-ed\u2019s release that a motivator of the bill stems from the \u201cfear-mongering tactic\u201d Democrats are using to paint Republicans as anti-IVF. <\/p>\n<p>\u201cI think the bigger thing here as we see Democrats across the country making this an election issue, [Cruz] is hoping, with Katie Britt, to take that off the table,\u201d a Cruz aide told reporters.<\/p>\n<p>\u201cThe goal of this bill is to sort of lay that hypocrisy bare]and you know, force Democrats to take a vote on it,\u201d the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/rashida-tlaib-confronted-biden-over-support-for-israel-demanded-end-of-aid-to-right-wing-netanyahu-report\/\" title=\"Rashida Tlaib Confronted Biden Over Support For Israel, Demanded End Of Aid To \u2018Right Wing\u2019 Netanyahu: Report\">aide continued<\/a>.<\/p>\n<p>The Republicans\u2019 bill is separate from a <a href=\"https:\/\/x.com\/SenDuckworth\/status\/1760413207695409379?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1760413207695409379%7Ctwgr%5Ec2fdcc87bbfa53ebb6dcaddbdb3d87c3a64b261d%7Ctwcon%5Es1_&#038;ref_url=https%3A%2F%2Fwww.washingtonexaminer.com%2Fpolicy%2Fhealthcare%2F2867802%2Falabamas-ivf-reality-and-its-far-reaching-impacts-everything-you-need-to-know%2F\" target=\"_blank\" rel=\"noopener\" title>bill<\/a> introduced by Sen. Tammy Duckworth (D-IL), which was introduced in January and would protect IVF access. Many Republicans have pushed back against Duckworth\u2019s bill, arguing its broad language could allow a backdoor into possible abortion protections. <\/p>\n<p>In a <a href=\"https:\/\/www.usccb.org\/resources\/Letter_Access_to_Family_Building_Act_2024.pdf\" target=\"_blank\" rel=\"noopener\" title>letter<\/a> to Republicans sent shortly after the Alabama ruling, the United States Conference of Catholic Bishops wrote to GOP senators arguing against Duckworth\u2019s Access to Family Building Act, calling federal protection of IVF a \u201cthreat to the most vulnerable of human beings.\u201d<\/p>\n<p>\u201cContrary to what some have claimed, a position that supports legal enshrinement of IVF, however well-intended, is neither pro-life nor pro-child,\u201d the bishops wrote. \u201cApproaches such as investing in life affirming research on infertility, or strengthening support for couples who desire to adopt, would be better to explore.\u201d<\/p>\n<p><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>\u201cAmong those to whom we and our parishes minister, we know well the deep yearning<br \/>and even suffering of families struggling with infertility.
