If used, the envelopes \u201cwould cause voters to falsely certify that the ballot envelope itself is an original or a copy of the ballot request generated through MyVote when it is not in any way.\u201d<\/p>\n<p>\u201cBy forcing people to falsely certify that the return envelope itself is a copy of a completely different document, WEC created a situation where people who requested absentee ballots through MyVote were either committing election fraud by making a false statement in conjunction with voting a ballot, or were forced to not vote absentee \u2014 a Hobson\u2019s choice,\u201d Scott said in comments to The Federalist. <\/p>\n<div class=\"fdrlst__b89e9-4e5cebdb2be37457c7e3c5ff506ca4ae fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-4e5cebdb2be37457c7e3c5ff506ca4ae\"><\/div>\n<p>It would appear the six feckless commissioners \u2014 <a href=\"https:\/\/www.wpr.org\/politics\/republican-bill-would-abolish-wisconsin-elections-commission\" target=\"_blank\" rel=\"noreferrer noopener\">three Democrats and three Republicans<\/a> \u2014 again took questionable advice from the agency attorneys. <\/p>\n<h2 class=\"wp-block-heading\">\u2018Foment Election Fraud\u2019<\/h2>\n<p>In a <a href=\"https:\/\/www.gmtoday.com\/news_graphic\/news\/ozaukee-county-court-rules-in-favor-of-wisconsin-elections-commission\/article_c7aebe00-0a3b-57fc-a88e-a3eb49f83b56.html\">case<\/a> earlier this year in Ozaukee County, a voter challenged the commission\u2019s legal authority to operate <a href=\"https:\/\/myvote.wi.gov\/en-us\/\" target=\"_blank\" rel=\"noreferrer noopener\">MyVote<\/a>, an online portal for voters to request absentee ballots. WEC argued that all requests made through the website are \u201cemail\u201d requests, an allowable method of requesting an absentee ballot under Wisconsin election law. <\/p>\n<p>WEC officials submitted sworn testimony stating that when an elector seeks an absentee ballot through MyVote the \u201crequest\u201d for the ballot is a form generated by the system once the individual completes the online process. The argument is a stretch, to be sure, but <a href=\"https:\/\/www.ozaukeecounty.gov\/directory.aspx?EID=29\" target=\"_blank\" rel=\"noreferrer noopener\">Ozaukee County Judge Steven Cain<\/a> bought it. Cain held that all requests made through MyVote were \u201cemail\u201d requests, and allowable under the statute. The plaintiff is appealing that ruling. <\/p>\n<p>But the allowance seems to have created a snag for WEC. If an applicant requests an absentee ballot by email, Wisconsin <a href=\"https:\/\/docs.legis.wisconsin.gov\/statutes\/statutes\/6\/iv\/86\/6\" target=\"_blank\" rel=\"noreferrer noopener\">statutes<\/a> require the elector to include \u201cin the envelope\u201d a copy of the \u201crequest\u201d for the ballot \u201cbearing an original signature.\u201d  <\/p>\n<div class=\"fdrlst__b89e9-1546ea72b83883da9cd7e941cd82627f fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-1546ea72b83883da9cd7e941cd82627f\"><\/div>\n<p>WEC, according to the lawsuit, provided no guidance indicating any of that. More so, while the Ozaukee County case was proceeding, WEC created the new, <a href=\"https:\/\/elections.wi.gov\/sites\/default\/files\/documents\/ICYMI%20Absentee%20Envelopes%20Get%20an%20Upgrade.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">color-coded<\/a> <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/infographic-the-states-that-changed-mail-in-voting-rules-for-2022\/\" title=\"INFOGRAPHIC: The States That Changed Mail-In Voting Rules for 2022\">absentee ballot return envelopes<\/a>. Agency officials designated the envelopes as \u201c<a href=\"https:\/\/allvotingislocal.org\/wp-content\/uploads\/EL-12220Standard20Absentee20Ballot20Certificate-portrait2028rev.202020-0829.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Forms EL-122<\/a>,\u201d and required election clerks to use them. The envelopes contained a new requirement that applicants certify under penalty of law that they requested the ballot and that the EL-122 is \u201can original or a copy of\u201d the \u201crequest.\u201d  <\/p>\n<p>\u201cThis language found in the new EL-122 ran directly contrary to the sworn testimony provided in the [Ozaukee County] case upon which Judge Cain relied,\u201d Scott said. And it opened up the Hobson\u2019s choice to <a href=\"https:\/\/pbswisconsin.org\/news-item\/wisconsins-2022-voter-registrations-up-from-2018-absentee-ballots-down-from-2020\/\" target=\"_blank\" rel=\"noreferrer noopener\">hundreds of thousands<\/a> of electors who prefer voting by absentee ballot. <\/p>\n<p>While voting is a constitutional right, voting by absentee ballot is a \u201cprivilege exercised wholly outside the traditional safeguards of the polling place,\u201d <a href=\"https:\/\/docs.legis.wisconsin.gov\/statutes\/statutes\/6\/iv\/86\/1\/a\" target=\"_blank\" rel=\"noreferrer noopener\">state law<\/a> asserts. Accordingly, absentee voting must be carefully regulated to prevent the potential for fraud or abuse. Ballots cast in violation of the law cannot be counted. The lawsuit argues the state regulator in charge of enforcing Wisconsin\u2019s election law is demanding clerks and voters use a \u201cform\u201d that is a contravention of the law. <\/p>\n<p>\u201c\u2026 WEC has approved the use of new absentee ballot return envelopes that exacerbate and foment election fraud \u2014 as defined by Wisconsin Statutes \u2014 by coercing a voter returning an absentee ballot requested through MyVote to falsely certify <em>that the envelope itself<\/em> is a \u2018copy\u2019 of the absentee ballot request,\u201d the complaint states. \u201cThe new WEC envelope is <strong>not a replacement <\/strong>for a signed copy of the ballot request to be included \u2018in the envelope\u2019 in which the ballot is returned as required by section 6.87(4).\u201d<\/p>\n<p>\u201cThe new envelope is an inducement to commit voter fraud.\u201d<\/p>\n<h2 class=\"wp-block-heading\">\u2018Prevent Mistakes\u2019<\/h2>\n<p>In an apparent move to convince the Ozaukee County judge of its position on MyVote, the Elections Commission approved the design of the new \u201cAbsentee Certificate Envelope\u201d forms in August, according to the complaint. WEC alerted the public in a <a href=\"https:\/\/www.wispolitics.com\/2023\/wisconsin-election-commission-absentee-envelopes-get-an-upgrade\/\" target=\"_blank\" rel=\"noreferrer noopener\">press release <\/a>titled \u201cAbsentee Envelopes Get an Upgrade.\u201d The new-and-improved envelopes \u201cwill provide voters with a more user-friendly way to vote absentee in upcoming elections,\u201d the press release heralded. Some clerks claimed the new envelopes would <a href=\"https:\/\/www.wpr.org\/politics\/wisconsin-election-clerks-absentee-ballot-envelopes-mistakes-votes-count\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cprevent mistakes,\u201d<\/a> according to a sympathetic story by Wisconsin Public Radio. <\/p>\n<p>Applauding the redesign was <a href=\"https:\/\/thefederalist.com\/2024\/05\/08\/shady-milwaukee-elections-chief-ousted-six-months-before-election-but-will-her-successor-be-worse\/\" target=\"_blank\" rel=\"noreferrer noopener\">Claire Woodall<\/a> (Claire Woodall-Vogg at the time). Milwaukee\u2019s former shady election administrator was a key player in Wisconsin\u2019s 2020 Zuckerbucks scandal, and her lieutenant was <a href=\"https:\/\/apnews.com\/article\/former-milwaukee-election-official-fined-sentenced-cd376bd2df01a4e49c7a6300e0385f8c\" target=\"_blank\" rel=\"noreferrer noopener\">convicted of misconduct in office and fraud<\/a> for using the MyVote system to send fake absentee ballots. One of the ballots was delivered to <a href=\"https:\/\/www.wpr.org\/news\/jury-former-milwaukee-election-official-guilty-election-fraud-zapata\" target=\"_blank\" rel=\"noreferrer noopener\">State Rep. Janel Brandtjen<\/a>, R-Menomonee Falls, who as chairwoman of the Assembly\u2019s elections committee investigated the many irregularities and election law infractions surrounding the 2020 presidential election. <\/p>\n<p>Milwaukee Mayor Cavalier Johnson recently <a href=\"https:\/\/thefederalist.com\/2024\/05\/08\/shady-milwaukee-elections-chief-ousted-six-months-before-election-but-will-her-successor-be-worse\/\">relieved Woodall of her duties.<\/a> <\/p>\n<h2 class=\"wp-block-heading\">\u2018Height of Irony\u2019<\/h2>\n<p>Not noted in the lawsuit is the fact that WEC used <a href=\"https:\/\/elections.wi.gov\/sites\/default\/files\/documents\/Open%20Session%203.3.23-AMENDED.pdf\">$600,000<\/a> in a nearly <a href=\"https:\/\/www.eac.gov\/sites\/default\/files\/paymentgrants\/Election%20Security\/fundsrequest2023\/WI_2023_ES_Funding_Request_Letter.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">$1.2 million U.S. Election Assistance Commission HAVA (Help America Vote Act) grant<\/a> for the new absentee ballot envelopes. The grant funds were designated for <a href=\"https:\/\/www.eac.gov\/sites\/default\/files\/Grants\/FY23_Hava_App_Packet\/FY23%20Program%20Narrative%20Instructions.pdf\">\u201celection security\u201d<\/a> funding. States were required to provide the federal commission with a <a href=\"https:\/\/www.eac.gov\/sites\/default\/files\/Grants\/FY23_Hava_App_Packet\/FY23%20Program%20Narrative%20Instructions.pdf\">\u201cprogram narrative\u201d<\/a> describing how the federal grant and required matching funds would be spent. WEC <a href=\"https:\/\/www.eac.gov\/sites\/default\/files\/paymentgrants\/Election%20Security\/narrative2023\/WI_2023_ES_State_Narrative_Budget.pdf\">claimed<\/a> the \u201ccertificate envelope performs several functions \u2014 each essential \u2026 to the integrity of the wider electoral process. A successful transition to the new design is therefore in the interest of all participants.\u201d<\/p>\n<p>At a March 3, 2023, meeting, the commissioners <a href=\"https:\/\/elections.wi.gov\/sites\/default\/files\/documents\/Open%20Session%20-June%201%2C%202023.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">approved<\/a> the\u00a0grant request,\u00a0and on\u00a0April 28 they <a href=\"https:\/\/elections.wi.gov\/sites\/default\/files\/documents\/Open%20Session%20Minutes%20April%2028%2C%202023%20APPROVED.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">adopted<\/a> a\u00a0timeline\u00a0for the envelope redesign and directed staff to come up with a final design for approval. Under a <a href=\"https:\/\/elections.wi.gov\/sites\/default\/files\/documents\/Open%20Session%20-June%201%2C%202023.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">subgrant program<\/a>, WEC would distribute the federal funds for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-zuckerberg-broke-law-with-dropboxes\/\" title=\"Trump: Zuckerberg 'Broke Law' with Dropboxes\">local election offices<\/a> to purchase the new envelopes. The clerks would have to enter into a <a href=\"https:\/\/elections.wi.gov\/sites\/default\/files\/documents\/Open%20Session%203.3.23-AMENDED.pdf\">memorandum<\/a> of understanding with WEC. <\/p>\n<p>The commission on multiple occasions <a href=\"https:\/\/elections.wi.gov\/sites\/default\/files\/documents\/ICYMI%20Absentee%20Envelopes%20Get%20an%20Upgrade.pdf\">communicated<\/a> that clerks were <a href=\"https:\/\/elections.wi.gov\/sites\/default\/files\/documents\/2023%20Absentee%20Envelope%20Design%20Approval%20Announcement.pdf\">required <\/a>to use the new envelopes in all subsequent elections. <\/p>\n<p>\u201cI think it\u2019s the height of irony that federal election security funds given to WEC are being utilized to coerce Wisconsin voters into making false statements in regard to voting,\u201d Scott said. \u201cAnd there are serious concerns about whether these funds were used properly under EAC [Election Assistance Commission].\u201d <\/p>\n<p>The lawsuit appears to be another self-induced wound by a <a href=\"https:\/\/www.wpr.org\/politics\/republican-bill-would-abolish-wisconsin-elections-commission\" target=\"_blank\" rel=\"noreferrer noopener\">\u201cbipartisan\u201d<\/a> state elections regulator that has run into all kinds of legal entanglements since its creation eight years ago. WEC has been at the center of scores of election integrity lawsuits, criticized by conservatives for its loose interpretations of Wisconsin election law \u2014 and outright violating it. <\/p>\n<p>From allowing the use of <a href=\"https:\/\/will-law.org\/wec-complies-with-judges-order-removes-unlawful-form-from-its-website\/\" target=\"_blank\" rel=\"noreferrer noopener\">unlawful voter registration forms<\/a> to <a href=\"https:\/\/www.wispolitics.com\/2022\/elections-commission-withdraws-guidance-on-curing-of-absentee-ballot-envelopes\/\" target=\"_blank\" rel=\"noreferrer noopener\">invalid guidance on curing absentee ballot envelopes<\/a> to endorsing the<a href=\"https:\/\/www.npr.org\/2022\/07\/08\/1100696685\/wisconsin-supreme-court-ballot-drop-boxes-disability-assistance\" target=\"_blank\" rel=\"noreferrer noopener\"> illegal use of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/house-republicans-urge-dismissal-of-doj-lawsuit-against-georgia-election-law\/\" title=\"House Republicans Urge Dismissal Of DOJ Lawsuit Against Georgia Election Law\">absentee ballot drop boxes<\/a>,<\/a> the election commission has repeatedly failed to abide by the laws it is charged to enforce. <\/p>\n<p>Meagan Wolfe, the commission\u2019s top bureaucrat, has been effectively squatting in the office since September, when the Republican-controlled State Senate tried in vain to<a href=\"https:\/\/apnews.com\/article\/wisconsin-senate-meagan-wolfe-elections-firing-62a0ec656530c740934b03083b3e3b11\"> fire her.<\/a> <a href=\"https:\/\/spectrumnews1.com\/wi\/milwaukee\/news\/2024\/01\/18\/wisconsin--impeachment--top-elections-official--meagan-wolfe\">Impeachment efforts<\/a> and a <a href=\"https:\/\/www.wpr.org\/politics\/republican-bill-would-abolish-wisconsin-elections-commission\">bill<\/a> to abolish the commission have gone nowhere.  <\/p>\n<p>\u201cThis is a real problem,\u201d Eastman said. \u201cIt\u2019s a real problem when an administrator is consistently violating the law. No other state agency has this problem.\u201d <\/p>\n<p>\u201cAnd the commission didn\u2019t step in and supervise her. They just let her go,\u201d the attorney added. <\/p>\n<p>A spokesman for WEC did not return The Federalist\u2019s request for comment. <\/p>\n<p>Attorneys for the plaintiff in the ballot envelope lawsuit want the court to quickly rule on a permanent injunction against WEC\u2019s use of the envelope.
