Fahrenkopf hinted at potential legal action citing a breach of\u2062 FEC rules. The third-party candidate, a former Democratic primary contender against Biden, aims to meet\u2062 the CNN debate criteria before the \u200bdeadline. The third-party candidate, a former Democratic primary rival of Biden, is striving to fulfill the CNN debate requirements \u2062before the cutoff.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>Commission on Presidential Debates co-founder Frank Fahrenkopf claimed that President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/joe-biden\/\" target=\"_blank\" rel=\"noopener\" title>Joe Biden\u2019s<\/a> campaign urged <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/cnn\/\" target=\"_blank\" rel=\"noopener\" title>CNN<\/a> to \u201cpromise that they wouldn\u2019t let[[<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/rfk-jr\/\" target=\"_blank\" rel=\"noopener\" title>Robert F Kennedy Jr.<\/a>]in regardless\u201d to its June 27 debate.<\/p>\n<p>Fahrenkopf also implied that Kennedy could file a lawsuit given a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/oregon-governor-encourages-people-to-call-police-on-neighbors-violating-covid-orders\/\" title=\"Oregon Governor Encourages People To Call Police On Neighbors Violating COVID Orders\">potential violation<\/a> of Federal Election Commission rules.<\/p>\n<p>When asked if this constituted a violation, Fahrenkopf <a href=\"https:\/\/www.politico.com\/news\/magazine\/2024\/05\/17\/debate-commission-chief-trump-00158689\" target=\"_blank\" rel=\"noopener\" title>told<\/a> <em>Politico<\/em>, \u201cIt could, but my lawyering days are over. I\u2019ll leave that to the lawyers on both sides. But it\u2019s an issue certainly to raise. I\u2019m surprised. When this thing went down yesterday I said, \u2018Boy, I bet Kennedy is going to file some lawsuit somewhere.&#8217;\u201d<\/p>\n<p>The third<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hillary-clinton-gave-biden-a-warning-during-private-meeting-at-wh\/\" title=\"Hillary Clinton warned Biden during private meeting at the White House.\">-party candidate entered<\/a> the presidential race as an independent after dropping out of the Democratic primary against Biden. Some have<a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/elections\/2024\/05\/17\/rfk-jr-debate-stage-biden-trump\/73712743007\/\" target=\"_blank\" rel=\"noopener\" title> called<\/a> Kennedy a \u201cspoiler\u201d for Biden, speculating he may draw enough votes for former President Donald Trump to win the election.<\/p>\n<p>Both candidates have escalated their attacks against Kennedy in recent months, with Trump calling <a href=\"https:\/\/apnews.com\/article\/robert-kennedy-jr-trump-independent-third-party-7512ce6c2537453ea400f6dfaae87282\" target=\"_blank\" rel=\"noopener\" title>him<\/a> a \u201cDemocrat plant\u201d and Biden <a href=\"https:\/\/www.politico.com\/news\/2024\/04\/18\/biden-kennedy-rfk-campaign-00153032\" target=\"_blank\" rel=\"noopener\" title>currying<\/a> favor among the Kennedy family, who endorsed Biden over their own family member.<\/p>\n<p>Kennedy previously announced he \u201cwill meet the criteria to participate in the CNN debate before the June 20 deadline.\u201d<\/p>\n<figure>\n<div>\n<blockquote data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">I\u2019m happy to report that I will meet the criteria to participate in the <a href=\"https:\/\/twitter.com\/CNN?ref_src=twsrc%5Etfw\">@CNN<\/a> debate before the June 20 deadline. Kennedy Jr (@RobertKennedyJr) <a href=\"https:\/\/twitter.com\/RobertKennedyJr\/status\/1790862504647606553?ref_src=twsrc%5Etfw\">May 15, 2024<\/a><\/p><\/blockquote><\/div>\n<\/figure>\n<p>He doesn\u2019t currently meet CNN debate\u2019s requirements, which state that each candidate must win at least 15% in four different <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-great-politically-for-republicans-to-talk-arizona-election-audit\/\" title=\"Trump: 'Great Politically' for Republicans to Talk Arizona Election Audit\">national polls<\/a> and qualify for enough state ballots to reach 270 electoral votes. <\/p>\n<p>CNN declined to comment on Fahrenkopf\u2019s assertions for this article. <\/p>\n<p>Kennedy\u2019s national polling <a href=\"https:\/\/projects.fivethirtyeight.com\/polls\/president-general\/2024\/national\/\" target=\"_blank\" rel=\"noopener\" title>average<\/a> is 9.7% as of May 17, though CNN had him at a 13% average <a href=\"https:\/\/www.cnn.com\/2024\/04\/22\/politics\/polls-rfk-jr-third-party-independent\/index.html\" target=\"_blank\" rel=\"noopener\" title>across<\/a> prominent national polls. His campaign website says petitioning has been <a href=\"https:\/\/www.kennedy24.com\/ballot-access\" target=\"_blank\" rel=\"noopener\" title>completed<\/a> to account for 201 electoral votes so far. <\/p>\n<p>According to Fahrenkopf, only seven states have completed their work on who can be on the ballot in the fall, for a total of 110 electoral votes.<\/p>\n<p>He said most states don\u2019t say who is on their ballot until Sept. 6, making it impossible for Kennedy to fulfill the ballot requirement before the June 27 debate.<\/p>\n<p>Fahrenkopf speculated that Kennedy could circumvent the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/rfk-jr-has-spent-hundreds-of-thousands-of-dollars-and-is-only-on-the-ballot-in-three-states\/\" title=\"RFK Jr spent big but only on three ballots\">ballot access restriction<\/a> by joining the Libertarian Party as its nominee, which would automatically grant him ballot access to every state. <\/p>\n<p>That would only leave the 15% polling cutoff, which the third-party candidate is gaining on but only has about a month left to meet.
