Greg Abbott <a href=\"https:\/\/gov.texas.gov\/uploads\/files\/press\/PARDON_2024-0001_SGT_DANIEL_PERRY_IMAG_05-16-2024.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">pardoned<\/a> him for defending himself against an unruly rioter who brandished an AK-47 at him during the Black Lives Matter chaos in Austin in July 2020.<\/p>\n<p>The pardon, the Lone Star State\u2019s Attorney General Ken Paxton <a href=\"https:\/\/x.com\/KenPaxtonTX\/status\/1791196189179687112\" target=\"_blank\" rel=\"noreferrer noopener\">confirmed<\/a>, was a \u201cunanimous recommendation by the Texas Board of Pardons and Paroles,\u201d the body of appointees charged with reviewing the state\u2019s clemency applications.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1007815169\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-2dc85ebc637c4bc3b2ad132591337325 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-2dc85ebc637c4bc3b2ad132591337325\"><\/div>\n<p>The New York Times, however, <a href=\"https:\/\/www.nytimes.com\/2024\/05\/16\/us\/texas-abbott-pardon-daniel-perry.html?campaign_id=190&#038;emc=edit_ufn_20240516&#038;instance_id=123593&#038;nl=from-the-times%C2%AEi_id=41776995&#038;segment_id=166878&#038;te=1&#038;user_id=fdd9488c7657bf391bdf276b5c392eb9\" target=\"_blank\" rel=\"noreferrer noopener\">framed<\/a> Perry\u2019s newfound freedom as the outcome of a partisan pressure campaign fueled by Abbott \u201cfulfilling a promise he made last year amid pressure from conservatives,\u201d rather than a just pardon.<\/p>\n<p>\u201cTexas Governor Pardons Man in Fatal Shooting of Protester in 2020,\u201d the NYT\u2019s headline about the proclamation reads. <\/p>\n<p>The \u201cprotestor\u201d in question, Garrett Foster, was among the crowd of George Floyd-inspired agitators <a href=\"https:\/\/gov.texas.gov\/uploads\/files\/press\/PARDON_2024-0001_SGT_DANIEL_PERRY_IMAG_05-16-2024.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">blocking<\/a> Austin\u2019s busy Congress Avenue on July 25, 2020. The rowdy group not only held up traffic, but attempted to intimidate drivers like Perry by assaulting his vehicle.<\/p>\n<p>Perry shot Foster with his handgun when the bandannaed 28-year-old confronted him with what Abbott\u2019s proclamation described as a \u201cKalashnikov-style rifle in the low-ready firing position.\u201d Seconds after the shooting, Perry called law enforcement to report his act of self-defense.<\/p>\n<div class=\"fdrlst__b89e9-39e214bf4e9e380b756ba39d251d274f fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-39e214bf4e9e380b756ba39d251d274f\"><\/div>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\"> <span class=\"tnE9TYsLJnHetZ2XseqvSPxpuO3G9xwRSpXaNKguovrQRWq7CrU2453cybiDEd8iBmI8l16GzjdhMlwaHK4Fc6YVP\"><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Footage shows the moments leading up to the shooting death of of 28-year-old Garrett Foster. Authorities detained and later released both shooters, whose names were not released, with no charges.<\/p>\n<p>Read more about the shooting: <a href=\"https:\/\/t.co\/SlyIRzbTCz\">https:\/\/t.co\/SlyIRzbTCz<\/a> <a href=\"https:\/\/t.co\/s4HVNkyeGF\">pic.twitter.com\/s4HVNkyeGF<\/a><\/p>\n<p>\u2014 Austin Statesman (@statesman) <a href=\"https:\/\/twitter.com\/statesman\/status\/1288096948642287617?ref_src=twsrc%5Etfw\">July 28, 2020<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/span> <\/div>\n<\/figure>\n<p>The fact that Foster pointed an AK-47 at Perry does not appear in the Times\u2019 coverage of the pardon until the 12th paragraph. <\/p>\n<p>Instead, what dominates the first half of the article are not-so-subtle suggestions from the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/border-patrol-arrests-two-illegal-immigrants-from-yemen-on-fbi-terror-watch-list\/\" title=\"Border Patrol Arrests Two Illegal Immigrants From Yemen On FBI Terror Watch List\">corporate media outlet<\/a> and Foster\u2019s family that the weapon-wielding man was an innocent bystander who became a victim of a motivated murder. <\/p>\n<p>The article relies heavily on comment from Foster\u2019s mom, who suggested her son was \u201cout there protecting people from people like Perry.\u201d The publication was also quick to note that Foster\u2019s family \u201csaw a political motivation\u201d in Abbott\u2019s decision<\/p>\n<p>NYT also amplified the prosecutors\u2019 assertion that Perry made \u201cracist online comments\u201d\u00a0that may have fueled the killing (even though Foster was white) and their claim that \u201cpsychological experts had found him to be \u2018basically a loaded gun.\u2019\u201d<\/p>\n<div class=\"fdrlst__b89e9-01d88b69efcc8dbfe2a84db43fec809b fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-01d88b69efcc8dbfe2a84db43fec809b\"><\/div>\n<p>At one point, the Times reported that \u201cprosecutors showed evidence before the shooting of Mr. Perry\u2019s <a href=\"https:\/\/www.fox7austin.com\/news\/daniel-perry-murder-garrett-foster-wife-friend\" target=\"_blank\" rel=\"noreferrer noopener\">animosity toward protesters on social media<\/a>.\u201d<\/p>\n<p>Despite the Lone Star State\u2019s sweeping protections for Texans defending themselves against perceived threats, an Austin jury <a href=\"https:\/\/thefederalist.com\/2023\/04\/10\/perry-verdict-shows-urgency-to-confront-blue-city-prosecutors\/\" target=\"_blank\" rel=\"noreferrer noopener\">convicted Perry in April 2023<\/a>. By May 2023, a judge <a href=\"https:\/\/www.youtube.com\/watch?v=h2F28-mtl7w\" target=\"_blank\" rel=\"noreferrer noopener\">sentenced the ex-sergeant<\/a> to 25 years in prison.<\/p>\n<p>Abbott <a href=\"https:\/\/x.com\/GregAbbott_TX\/status\/1644778789493243907?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">immediately signaled<\/a> his intent to pardon Perry if the case earned the favor of the state board.<\/p>\n<p>One year later, Abbott <a href=\"https:\/\/gov.texas.gov\/uploads\/files\/press\/PARDON_2024-0001_SGT_DANIEL_PERRY_IMAG_05-16-2024.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">noted<\/a> in his proclamation that Perry is free to go thanks to the Second Amendment, Texas law \u2014 which \u201cprovides one of the clearest self-defense protections in the United States\u201d \u2014 and a specific statute allowing the use of deadly force.<\/p>\n<p>He also noted that Travis County\u2019s District Attorney Jos\u00e9 Garza was so hellbent on \u201creducing access to guns\u201d that he <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/serious-disregard-for-these-childrens-welfare-biden-admin-policies-could-place-migrant-kids-in-homes-with-sex-offenders\/\" title=\"\u2018Serious Disregard For These Children\u2019s Welfare\u2019: Biden Admin Policies Could Place Migrant Kids in Homes With Sex Offenders\">ordered law enforcement<\/a> to \u201cwithhold exculpatory evidence from the Grand Jury considering whether to report an indictment.\u201d<\/p>\n<p>\u201cGarza has not sought \u2018to see that justice is done\u2019 \u2026 but has instead demonstrated unethical and biased misuse of his office in prosecuting Daniel Scott Perry,\u201d Abbott wrote.<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\"> <span class=\"lpQCDjKFTiZdJyBm6YUMLzE1Li9bxDBK5348rGvOWP2s28n0103uOnYhGToQoA7xWSItgfRNPS5gVVaFJq\"><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">My statement regarding the pardon of Sgt. The Times, however, framed Abbott\u2019s concerns as an \u201cattack\u201d on the Travis County prosecutor. The outlet also made sure to note that Garza\u2019s removal would be made possible \u201cunder a new <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/recalling-governor-newsom-can-restore-californias-promise\/\" title=\"Recalling Governor Newsom Can Restore California\u2019s Promise\">law signed<\/a> by the governor aimed at limiting the discretion of local prosecutors.\u201d<\/p>\n<p>Undeterred by the corporate media\u2019s repeated insistence that his client should suffer for defending himself, Perry\u2019s attorney Doug O\u2019Connell celebrated the pardon. <\/p>\n<p>\u201cHe is thrilled and elated to be free. Daniel is also optimistic for his future.
