The upside-down flag has historically been a symbol of distress for the country and has also been associated with the \u201cStop the Steal\u201d movement spearheaded by former President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\/\" target=\"_blank\" rel=\"noopener\" title>Donald Trump<\/a> to overturn the results of the 2020 election. <\/p>\n<p>\u201cI had no involvement whatsoever in the flying of the flag,\u201d Alito <a href=\"https:\/\/www.nytimes.com\/2024\/05\/16\/us\/justice-alito-upside-down-flag.html\" target=\"_blank\" rel=\"noopener\" title>said<\/a>. \u201cIt was briefly placed by Mrs. Alito in response to a neighbor\u2019s use of objectionable and personally insulting language on yard signs.\u201d<\/p>\n<p>According to the outlet, neighbors took photographs of Alito\u2019s house in Alexandria, Virginia, with the upside-down flag. Alito flew the flag beginning Jan. 17, 2021, and it flew like that for several days after, according to eyewitnesses.<\/p>\n<p>While flying the flag upside down is not against the law, experts have said Alito\u2019s action could be a violation of<a href=\"https:\/\/www.supremecourt.gov\/about\/Code-of-Conduct-for-Justices_November_13_2023.pdf\" target=\"_blank\" rel=\"noopener\" title> judicial ethics rules<\/a>, in which justices are supposed to appear apolitical and unbiased.<\/p>\n<p>\u201cIt might be his spouse or someone else living in his home, but he shouldn\u2019t have it in his yard as his message to the world,\u201d said Amanda Frost, a law professor at the University of Virginia. She continued to say this was \u201cthe equivalent of putting a \u2018Stop the Steal\u2019 sign in your yard, which is a problem if you\u2019re deciding election-related cases.\u201d<\/p>\n<p>The Supreme Court has rules about its employees displaying signs of partisanship, including prohibiting them from displaying signs or bumper stickers touting partisan positions. However, it\u2019s unclear whether the court\u2019s rules apply to justices or their families.<\/p>\n<p>At the time, the Supreme Court was considering whether to hear a case that would have overturned the results of the 2020 election in Pennsylvania and direct the state legislator to appoint electors. Alito and Justice Clarence Thomas wrote that they wanted to bring the case forward in their dissent to the majority opinion.<\/p>\n<p><a href=\"http:\/\/washingtonexaminer.com\/\" target=\"_blank\" rel=\"noopener\" title><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>As the Supreme Court is set to <a href=\"https:\/\/www.washingtonexaminer.com\/news\/supreme-court\/2978885\/supreme-court-open-middle-ground-trump-immunity\/\" target=\"_blank\" rel=\"noopener\" title>decide a case<\/a> about whether Trump has presidential immunity from his actions on Jan. 6, critics of Republican-appointed justices have asked Alito to recuse himself from the case. Thomas is also being asked to recuse himself due to his wife\u2019s direct involvement in attempts to overturn the results of the 2020 election.<\/p>\n<p>\u201cIt really is a question of appearances and the potential impact on public confidence in the court,\u201d Jeremy Fogel, a former federal judge and the director of the Berkeley Judicial Institute, told the outlet. \u201cI think it would be better for the court if he weren\u2019t involved in cases arising from the 2020 election.
