By invoking Second and 14th\u2064 Amendment rights, the lawsuit seeks to tackle these constitutional \u200bconcerns.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/commentary\/\">  Commentary <\/a>  <\/p>\n<h2>Conservatives File Suit Against Democratic Governor Over What&#8217;s Happening to Citizens Buying Firearms<\/h2>\n<p> <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/sshort\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/sshort\/%20\"><span>Samuel Short<\/span><\/a> <\/span> <span>   May 16, 2024 at 1:58pm <\/span> <\/span>  <\/header>\n<section>\n<p>The National Rifle Association is teaming up with the Mountain State Legal Fund to challenge a New Mexico law that puts a seven-day waiting period on firearms purchases.<\/p>\n<p>On Wednesday, the NRA announced on <a href=\"https:\/\/www.nraila.org\/articles\/20240515\/nra-files-legal-challenge-to-new-mexico-waiting-period-law\" target=\"_blank\" rel=\"noopener\">its website<\/a>, \u201cNew Mexico\u2019s \u2018Unlawful Sale of a Firearm Before Required Waiting Period Ends Act\u2019 requires the purchaser of a firearm to wait seven calendar days before taking possession of the firearm \u2014 even if the purchaser immediately passes a background check. While it provides an exception for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fbi-conducted-over-38-8-million-gun-background-checks-in-2021\/\" title=\"FBI Conducted over 38.8 Million Gun Background Checks in 2021\">concealed carry permit holders<\/a>, it provides no exception for urgent circumstances, such as when an individual has received an imminent threat of bodily harm.\u201d<\/p>\n<p><a href=\"https:\/\/www.nmlegis.gov\/Sessions\/24%20Regular\/final\/HB0129.pdf\" target=\"_blank\" rel=\"noopener\">The law in question<\/a> \u2014 which also went into effect Wednesday \u2014 was signed by <a href=\"https:\/\/www.westernjournal.com\/148-house-democrats-vote-detain-deport-illegal-aliens-assault-cops-act\/\" target=\"_blank\" rel=\"noopener\">Democrat<\/a> New Mexico Gov. Michelle Lujan Grisham in March.<\/p>\n<p><a href=\"https:\/\/www.foxnews.com\/politics\/nra-conservative-legal-group-sue-democrat-governor-7-day-waiting-period-buy-guns\" target=\"_blank\" rel=\"noopener\">Fox News reported<\/a> that upon signing the bill, Grisham declared its intent in saying, \u201cWe are losing far too many lives when guns get into the wrong hands and violent criminals are allowed to recommit again and again. This legislation addresses both.\u201d<\/p>\n<p>Randy Kozuch, Executive Director of the NRA Institute for Legislative Action, said regarding the law, \u201cThe State of New Mexico\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-ducks-emergency-appeal-in-tennessee-abortion-case\/\" title=\"Supreme Court Ducks Emergency Appeal in Tennessee Abortion Case\">waiting period law<\/a> is a clear violation of its citizens\u2019 Second Amendment rights \u2013 needlessly delaying their ability to acquire a firearm for self-defense or sporting purposes. With this legal challenge, NRA is committed to seeing that this unconstitutional law be wiped from the state statutes.\u201d<\/p>\n<p>The lawsuit, filed in the District Court of New Mexico, challenges the law on Second and 14th Amendment grounds.<\/p>\n<p>A copy of the filing can be found <a href=\"https:\/\/www.nraila.org\/media\/3015\/2024-05-15-nm-complaint.pdf\" target=\"_blank\" rel=\"noopener\">here<\/a>.<\/p>\n<p>The plaintiffs hope New York State Rifle and Pistol Association v. Bruen, decided by the <a href=\"https:\/\/www.westernjournal.com\/az-supreme-court-unanimously-overturns-sanctions-gop-bringing-2020-election-suit\/\" target=\"_blank\" rel=\"noopener\">Supreme Court<\/a> in 2022, will help their case.<\/p>\n<p>That case established a standard of the government needing to show a \u201chistorical tradition of firearm regulation\u201d to support the law in question.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Are firearm purchase waiting periods unconstitutional?<\/p>\n<\/p><\/div>\n<p>The law is just the latest development in blue states\u2019 <a href=\"https:\/\/www.westernjournal.com\/federal-judge-bad-news-hunter-biden-says-zero-evidence-charges-politically-motivated\/\" target=\"_blank\" rel=\"noopener\">war on the Second Amendment<\/a>.<\/p>\n<p>Waiting periods do not help buyers who might be in danger and decide to purchase a firearm.<\/p>\n<p>Mike McCoy, director of the Center to Keep and Bear Arms at MSLF mentioned domestic violence victims. \u201cForcing domestic violence victims in need of a firearm to protect themselves to wait seven days to acquire one is wrong,\u201d he told Fox News Digital. \u201cLet\u2019s hope their abusers \u2018wait a week\u2019 too, before they attack again.\u201d<\/p>\n<p>New Mexico is an extremely bad place to find yourself unarmed and a potential victim.<\/p>\n<p><a href=\"https:\/\/www.forbes.com\/advisor\/legal\/criminal-defense\/crime-rate-by-state\/\" target=\"_blank\" rel=\"noopener\">According to Forbes<\/a>, New Mexico is the most dangerous state in the country, with a <a href=\"https:\/\/www.westernjournal.com\/democratic-senator-blocks-bill-require-detainment-illegal-immigrants-charged-violent-crimes\/\" target=\"_blank\" rel=\"noopener\">violent crime<\/a> rate of 7.80 per 1,000 residents.<\/p>\n<p>Looking at the numbers, is the \u201cLand of Enchantment\u201d really the place you want to find yourself waiting to buy a firearm?<\/p>\n<p>Criminals do not wait to harm you, nor do they wait to find weapons to do so. Waiting periods only hurt law-abiding citizens.<\/p>\n<p>While the law has just taken effect, hopefully this lawsuit will stop it in its tracks before things can get even worse for New Mexico.<\/p>\n<hr>\n<div>\n<p><b><i>An Important Message from Our Staff:<\/i><\/b><\/p>\n<p><i><span>In just a few months, the world is going to change forever.
