Dissent argues\u200d it infringes on religious freedom, \u2063while majority supports the board&#8217;s\u200c decision. Controversy surrounds \u200dthe\u2062 inclusion of LGBT-inclusive \u200cbooks \u2064in the curriculum.\u2062 The right\u2063 to opt-out is denied, sparking debate among parents and judges.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/news\/\">  News <\/a>   <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/anazarian\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/anazarian\/%20\"><span>Adelle Nazarian<\/span><\/a> <\/span> <span>   May 16, 2024 at 11:31am <\/span> <\/span>  <\/header>\n<section>\n<p>A group of three sets of parents \u2014 who are Jewish, Muslim, and Christian \u2014 in Maryland\u2019s Montgomery County Public Schools are being forced to subject their children to lessons that involve LGBT-inclusive materials after a divided three-judge panel on a federal appeals court on Wednesday rejected their bid to opt out of having their kids exposed to the materials, which directly go against their religious beliefs.<\/p>\n<p>According to <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4667019-court-rejects-parents-attempt-to-opt-kids-out-of-lgbtq-inclusive-reading-assignments\/\" target=\"_blank\" rel=\"noopener\">The Hill<\/a>, the parents argued that the LGBT-inclusive materials \u201ccontradict their <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/house-republicans-push-bill-aimed-at-balancing-lgbt-rights-and-religious-freedom\/\" title=\"House Republicans Push Bill Aimed at Balancing LGBT Rights and Religious Freedom\">sincerely held religious beliefs<\/a> about marriage, human sexuality, and gender\u201d and that the lack of an opt-out policy violates their children\u2019s First Amendment right to freely exercise their religion.<\/p>\n<p>However, the <a href=\"https:\/\/www.fox4news.com\/news\/maryland-parents-must-accept-lgbtq-inclusive-curriculum-appeals-court-decides\" target=\"_blank\" rel=\"noopener\">2-1 panel<\/a> of the 4th U.S. Circuit Court of Appeals in Richmond, Virginia upheld a lower court\u2019s decision to <a href=\"https:\/\/www.westernjournal.com\/sanity-prevails-florida-miami-dade-school-board-ends-lgbtq-month-recognition\/\" target=\"_blank\" rel=\"noopener\">deny<\/a> a preliminary injunction and ruled that Maryland parents cannot opt their children out of LGBT-inclusive book curricula in classrooms .<\/p>\n<p>According to them, the parents had not yet demonstrated how the school board\u2019s book policy would infringe on their right to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/conservatives-say-biden-supreme-court-pick-will-be-a-radical-left-activist\/\" title=\"Conservatives Say Biden Supreme Court Pick Will Be a Radical-Left Activist\">free religious expression<\/a>.<\/p>\n<p>The case is <a href=\"https:\/\/law.justia.com\/cases\/federal\/appellate-courts\/ca4\/23-1890\/23-1890-2024-05-15.html#:~:text=A%20group%20of%20parents%20in,of%20exposure%20to%20these%20books.\" target=\"_blank\" rel=\"noopener\">Mahmoud v. McKnight<\/a>, 4th U.S. Circuit Court of Appeals, No. 23-1890.<\/p>\n<p>The controversy centered around a set of LGBT-inclusive storybooks that the Montgomery County Board of Education approved for use in the public school curriculum in 2022.<\/p>\n<p>According to <a href=\"https:\/\/www.fox4news.com\/news\/maryland-parents-must-accept-lgbtq-inclusive-curriculum-appeals-court-decides\" target=\"_blank\" rel=\"noopener\">KDFW<\/a>, these books include \u201cPride Puppy\u201d by Robin Stevenson, an alphabet book about a dog who gets lost during a \u201cpride\u201d parade and \u201cBorn Ready: The True Story of a Boy Named Penelope\u201d by Jodie Patterson, which recounts her \u201ctransgender\u201d daughter\u2019s experiences.<\/p>\n<p>Another of the books was \u201c<a href=\"https:\/\/amazon.com\/Uncle-Bobbys-Wedding-Sarah-Brannen\/dp\/1499810083#:~:text=Book%20overview&#038;text=Chloe's%20favorite%20uncle%20is%20getting,an%20uncle%2C%20but%20gaining%20one.\" target=\"_blank\" rel=\"noopener\">Uncle Bobby\u2019s Wedding<\/a>,\u201d which is about Chloe who is upset after finding out her favorite Uncle Bobby is getting married.<\/p>\n<p>\u201cBut after a magical day with Uncle Bobby and his boyfriend, Jamie, Chloe realizes she\u2019s not losing an uncle, but gaining one,\u201d a description of the book said.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Would you send your child to public school today?<\/p>\n<\/p><\/div>\n<p>The lone dissenting vote came from former President Donald Trump appointee U.S. Circuit Judge A. Marvin Quattlebaum, Jr., who argued that the board violated parents\u2019 right to influence their children\u2019s religious upbringing.<\/p>\n<p>\u201cThe parents have shown the board\u2019s decision to deny religious opt-outs burdened these parents\u2019 right to exercise their religion and direct the religious upbringing of their children by putting them to the choice of either compromising their religious beliefs or foregoing a public education for their children,\u201d Quattlebaum wrote, according to <a href=\"https:\/\/www.foxnews.com\/us\/parents-cant-opt-k-5-children-lgbtq-curriculum-appeals-court\" target=\"_blank\" rel=\"noopener\">Fox News<\/a>.<\/p>\n<p>\u201cI also find that the board\u2019s actions, at least under this record, were neither neutral nor generally applicable. Finally, I find the parents have established the other requirements for a preliminary injunction.<\/p>\n<p>\u201cSo, I would reverse the district court and enjoin the Montgomery County School Board of Education from denying religious opt-outs for instruction to K-5 children involving the texts,\u201d Quattlebaum concluded.<\/p>\n<p>The two judges who voted in favor of denying the Maryland parents <a href=\"https:\/\/www.westernjournal.com\/dems-now-trying-force-transgenderism-curriculum-onto-whole-nation\/\" target=\"_blank\" rel=\"noopener\">the right to opt-out<\/a> of having their children exposed to the public school system\u2019s LGBT-inclusive curriculum were former President George W. Bush and President Joe Biden appointees.<\/p>\n<p>President Bush appointed U.S. Circuit Judge G. Steven Agee, who writing for the majority in the opinion said, \u201cWe take no view on whether the Parents will be able to present evidence sufficient to support any of their various theories once they have the opportunity to develop a record as to the circumstances surrounding the Board\u2019s decision and how the challenged texts are actually being used in schools.\u201d<\/p>\n<p>\u201cAt this early stage, however, given the Parents\u2019 broad claims, the very high burden required to obtain a preliminary injunction, and the scant record before us, we are constrained to affirm the district court\u2019s order denying a preliminary injunction,\u201d he continued, in the opinion, which was joined by President Biden appointee U.S. Circuit Judge DeAndrea Benjamin.<\/p>\n<p>Prior to the 2023-2024 school year, parents had the option to opt their children out of reading the LGBT-inclusive books. However, the board abandoned the opt-out option this year, which prompted the lawsuit against Maryland County\u2019s Public Schools.<\/p>\n<hr>\n<div>\n<p><b><i>An Important Message from Our Staff:<\/i><\/b><\/p>\n<p><i><span>In just a few months, the world is going to change forever.
