The race, contested by Tami Pierce and DaSean\u2064 Jones, requires a\u2062 new vote \u2064as the true outcome is indeterminable. Invalid votes,\u200d totaling 1,430, could not be attributed to a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/former-democratic-staffer-charged-with-voter-fraud-conspiracy\/\" title=\"Former Democratic Staffer Charged With Voter Fraud Conspiracy\">specific candidate<\/a>, \u2062leading to the election&#8217;s annulment. Pierce&#8217;s claims of out-of-county\u200b and\u200d incomplete residency statements\u200b were validated by the court.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<div>\n<div>\n<figure>                         <\/figure>\n<\/p><\/div>\n<p>A judge ordered that a 2022 Texas judicial election must be redone after finding more than a thousand illegal ballots were cast, far exceeding the margin of victory.<\/p>\n<p>Judge David Peeples <a href=\"https:\/\/texasscorecard.com\/wp-content\/uploads\/2024\/05\/pierce-v-jones-election-contest-judgment-5-15-24.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> Wednesday that the 2022 race between Republican Tami Pierce and Democrat DaSean Jones for the 180th District Court in Harris County must be held again after finding \u201cthe true outcome [of the election] cannot be determined.\u201d<\/p>\n<p>Pierce contested the race after losing by just 449 votes to incumbent Jones. Jones, however, filed a motion to dismiss \u2014 which was later rebuked by Peebles as being \u201cfrivolous.\u201d <\/p>\n<p>Peeples ultimately found 1,430 invalid votes were cast, and declared it was \u201cnot realistic or feasible to determine which candidate received those votes.\u201d<\/p>\n<p>\u201cThe court has also found that a net margin of 321 votes (1146 to 825) were cast for Jones over Pierce in the extended one hour of voting on Election Day, which the court has found resulted from an official mistake by the Harris County Elections Administration Office,\u201d Peeples wrote.<\/p>\n<p>Pierce argued, in part, that 953 votes were cast by \u201cout-of<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/poll-democrats-prefer-defending-ukrainians-over-american-border\/\" title=\"Poll: Democrats Prefer Defending Ukrainians over American Border\">-county residents<\/a> whose [Statement of Residence forms] show on their face a residence other than Harris County\u201d and that 245 voters \u201csubmitted incomplete [Statements of Residence], which gave <em>no <\/em>information about their <em>residence.<\/em>\u201d If a voter has changed residences but still lives in Harris County, he must submit a Statement of Residence testifying that he still meets the residency requirements for voting there.<\/p>\n<p>The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/president-trump-please-pardon-jon-woods-a-victim-of-process-crimes-like-michael-flynn\/\" title=\"President Trump, Please Pardon Jon Woods, a Victim of Process Crimes Like Michael Flynn\">judge found<\/a> both of Pierce\u2019s arguments were true, though the totals he reached were slightly different. Peeples found there were 606 votes cast by voters whose Statement of Residence showed a location outside the county and an additional 146 ballots were counted from voters who listed their residence as being in a \u201cnearby town or city <em>without stating any county of residence.<\/em>\u201c<\/p>\n<p>\u201cThe 752 votes resting on these [Statements of Residence] were not lawful and should not be counted,\u201d Peeples wrote. <\/p>\n<p>Additionally, \u201c231 [Statement of Residence forms] were filled out by the voter so incompletely \u2014 with the spaces for former residence and current residence <em>totally blank<\/em> \u2014 that it was not lawful to approve them and they should not be counted.\u201d<\/p>\n<p>In total, the judge found that 983 votes were \u201ccast by persons whose residence is outside Harris County\u201d and therefore were \u201cillegal votes\u201d that never should have been counted.<\/p>\n<p>In addition to the votes that should have been disqualified for residency issues, Peeples found another 445 votes were cast by voters who failed to meet a voter ID requirement. And dozens of mail-in ballots should have been rejected, Peeples concluded, for lacking the required signature and for not being returned on time.<\/p>\n<p>A date for the redo has not been scheduled. Jones was also ordered to pay Pierce\u2019s attorney fees. <\/p>\n<p>Harris County was the subject of multiple other election challenges filed by Republicans, such as one in which GOP candidate Erin Lunceford <a href=\"https:\/\/www.texastribune.org\/2023\/11\/10\/harris-county-2022-election-results-upheld\/\" target=\"_blank\" rel=\"noreferrer noopener\">challenged<\/a> the outcome of a race she lost to Democrat Tamika Craft. Peeples, who also presided over that case, <a href=\"https:\/\/www.documentcloud.org\/documents\/24157062-judicial-ruling-in-gop-election-lawsuit-against-harris-county\">acknowledged<\/a> that \u201cillegal conduct\u201d by the Harris County Elections Administration Office regarding ballot paper likely disenfranchised \u201c250 to 850 lawful voters\u201d and that \u201cthere were 2041 <em>illegal<\/em> votes\u201d in that election.
