Attorney General Merrick Garland also supports the decision.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/news\/\">  News <\/a>   <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/johnathanjones\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/johnathanjones\/%20\"><span>Johnathan Jones<\/span><\/a> <\/span> <span>   May 16, 2024 at 7:37am <\/span> <\/span>  <\/header>\n<section>\n<p>President Joe Biden will assert executive privilege to keep audio and video recordings from his interview with special counsel Robert Hur private.<\/p>\n<p>Hur recommended that no charges should be filed against Biden during the conclusion of <a href=\"https:\/\/www.westernjournal.com\/5-damning-joe-biden-quotes-hur-interview-not-senility\/\" target=\"_blank\" rel=\"noopener\">his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fbi-conducts-search-of-mike-pences-indiana-home-in-classified-documents-investigation\/\" title=\"FBI Conducts Search of Mike Pence's Indiana Home in Classified Documents Investigation\">classified documents investigation<\/a><\/a> of the president in February.<\/p>\n<p>But the <a href=\"https:\/\/www.westernjournal.com\/doj-says-boeing-now-subject-criminal-prosecution-failing-fulfill-obligations-wake-fatal-crashes\/\" target=\"_blank\" rel=\"noopener\">Justice Department<\/a> official raised questions about Biden\u2019s cognitive health and memory in his final report on Biden\u2019s mishandling of sensitive materials during his time as vice president.<\/p>\n<p>Hur concluded that although Biden was in his opinion guilty of having been loose with the country\u2019s secrets, he believed a jury would be sympathetic to him, viewing him as an \u201celderly man with a poor memory.\u201d<\/p>\n<p>Republican Reps. <a href=\"https:\/\/www.westernjournal.com\/fani-willis-throws-tantrum-jim-jordan-contempt-deadline-arrives\/\" target=\"_blank\" rel=\"noopener\">Jim Jordan<\/a> of Ohio and <a href=\"https:\/\/www.westernjournal.com\/icymi-james-comer-made-special-addition-hearing-chamber-just-hunter-biden\/\" target=\"_blank\" rel=\"noopener\">James Comer<\/a> of Kentucky demanded the release of Hur\u2019s interviews with Biden, but according to <a href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/biden-asserts-executive-privilege-robert-hurs-classified-documents-pro-rcna152550\" target=\"_blank\" rel=\"noopener\">NBC News<\/a>, the DOJ said Biden would invoke executive privilege to keep the recordings private in <a href=\"https:\/\/www.documentcloud.org\/documents\/24664105-20240516-out-jordan-and-comer-letter\" target=\"_blank\" rel=\"noopener\">a Thursday letter<\/a>.<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">\ud83d\udea8Wow<\/p>\n<p>Joe Biden asserted executive privilege over the audio of his interview with the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/media-reactions-to-bombshell-durham-report-liberals-just-have-no-idea-about-any-of-this\/\" title=\"Media Reactions To Bombshell Durham Report: Liberals \u2018Just Have No Idea About Any Of This\u2019\">special counsel investigating<\/a> his handling of classified documents.<\/p>\n<p>The same interview that led the special counsel to describe Biden as an \u201celderly man with a poor memory.\u201d<\/p>\n<p>What\u2019s he hiding? <a href=\"https:\/\/t.co\/nFKQpUwYcd\">pic.twitter.com\/nFKQpUwYcd<\/a><\/p>\n<p>\u2014 Steve Cortes (@CortesSteve) <a href=\"https:\/\/twitter.com\/CortesSteve\/status\/1791085267941482617?\">May 16, 2024<\/a><\/p>\n<\/blockquote>\n<p>\u201cIt is the longstanding position of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-asserts-executive-privilege-over-tapes-in-docs-probe\/\" title=\"Biden claims executive privilege on tapes in documents probe\">executive branch held<\/a> by administrations of both parties that an official who asserts the President\u2019s claim of executive privilege cannot be prosecuted for criminal contempt of Congress,\u201d DOJ official Carlos Felipe Uriarte\u00a0stated.<\/p>\n<p>Additionally, Attorney General <a href=\"https:\/\/www.westernjournal.com\/ag-merrick-garland-announces-end-biden-classified-documents-investigation\/\" target=\"_blank\" rel=\"noopener\">Merrick Garland<\/a> stated separately that Biden\u2019s conversations with Hur \u201cfall within the scope of executive privilege.\u201d<\/p>\n<p>Garland added releasing the interviews \u201cwould raise an unacceptable risk of undermining the Department\u2019s ability to conduct similar high-profile criminal investigations \u2014 in particular, investigations where the voluntary cooperation of White House officials is exceedingly important.\u201d<\/p>\n<p>Hur\u2019s Feb. 5 <a href=\"https:\/\/www.justice.gov\/storage\/report-from-special-counsel-robert-k-hur-february-2024.pdf\" target=\"_blank\" rel=\"noopener\">final repor<\/a>t on Biden\u2019s mishandling of classified materials was damaging politically for the president.<\/p>\n<p>Hur opined that if Biden went to trial, he would \u201clikely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory.\u201d<\/p>\n<p>Hur continued: \u201cBased on our direct interactions with and observations of him, he is someone for whom many jurors will want to identify reasonable doubt.<\/p>\n<p>\u201cIt would be difficult to convince a jury that they should convict him \u2014 by then a former president well into his eighties \u2014 of a serious felony that requires a mental state of willfulness.\u201d<\/p>\n<p>Hur also said <a href=\"https:\/\/www.westernjournal.com\/special-counsel-hur-devastates-biden-house-testimony-president-willfully-retained-classified-materials\/\" target=\"_blank\" rel=\"noopener\">Biden\u2019s<\/a> memory had significantly declined in the years since he had earlier interviewed him in 2017.<\/p>\n<p>The special counsel also claimed in the report that Biden could not recall the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/new-details-revealed-on-when-john-fetterman-will-be-released-from-hospital\/\" title=\"New details revealed on when John Fetterman will be released from hospital\">exact time frame<\/a> when his son <a href=\"https:\/\/www.westernjournal.com\/transcript-bidens-infamous-special-counsel-interview-released-even-worse-previously-thought\/\" target=\"_blank\" rel=\"noopener\">Beau Biden<\/a> died from cancer.<\/p>\n<p>According to Hur\u2019s transcript, two people with Biden during an interview last year informed him Beau had passed away in 2015 from brain cancer.<\/p>\n<p>\u201cWas it 2015 he had died?\u201d Biden asked, <a href=\"https:\/\/abcnews.go.com\/US\/transcript-documents-probe-contradicts-bidens-account-exchange-hur\/story?id=108033689\" target=\"_blank\" rel=\"noopener\">ABC News<\/a> reported.<\/p>\n<p>Another person with the president said, \u201cIt was May of 2015.\u201d<\/p>\n<hr>\n<div>\n<p><b><i>An Important Message from Our Staff:<\/i><\/b><\/p>\n<p><i><span>In just a few months, the world is going to change forever.
