House \u2062Bill 1633, introduced by Rep. Dan Frankel, would render such agreements void, \u200cenabling more freedom for\u200d health professionals. The bill highlights\u200d the importance of\u2064 access to healthcare, cost reduction, and fairness for all parties involved. If \u200dpassed, it will align Pennsylvania with states like California, North Dakota, Minnesota, and Oklahoma \u200dthat have already fully\u200c outlawed non-competes in healthcare.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>(The Center Square) \u2014 Pennsylvania may ban non-compete agreements for health care workers, ridding the commonwealth of most restrictions on where doctors and nurses can work.<\/p>\n<p>The legislation passed the House in May and awaits action in the Senate.<\/p>\n<p><strong><a href=\"https:\/\/www.legis.state.pa.us\/cfdocs\/billinfo\/billinfo.cfm?syear=2023&#038;sind=0&#038;body=H&#038;type=B&#038;bn=1633\">House Bill 1633<\/a><\/strong>, sponsored by Rep. Dan Frankel, D-Pittsburgh, would make non-competes void and unenforceable for anyone authorized to practice in health care. <\/p>\n<p>\u201cIt\u2019s important in terms of improving or maintaining access for individuals to health care, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/star-of-sen-mark-kelly-campaign-ad-called-white-men-single-greatest-domestic-terrorist-group\/\" title=\"Star of Sen. Mark Kelly Campaign Ad Called White Men 'Single Greatest Domestic Terrorist Group'\">reducing health care costs<\/a>, and a general sense of fairness to both providers and patients,\u201d Frankel said.<\/p>\n<p>California, North Dakota, Minnesota, and Oklahoma <strong><a href=\"https:\/\/eig.org\/state-noncompete-map\/\">fully ban non-competes<\/a><\/strong> in health care. Others, like Colorado, Virginia, Maryland, Washington, Oregon, Maine, and Rhode Island, restrict non-competes below certain income limits.<\/p>\n<p>Currently, Pennsylvania is one of a dozen states with no restrictions on non-compete agreements.<\/p>\n<p>\u201cHealth care workers, whether you\u2019re a physician, nurse, physician\u2019s assistant, whatever, they have so many options, they\u2019re in such demand. And if we\u2019re going to retain that workforce, we\u2019ve gotta make that working environment as attractive as possible,\u201d Frankel said. \u201cIt\u2019s really a disincentive for Pennsylvania for these valuable, important workers to be able to have the best work environment possible. One of those issues is clearly having the flexibility to make their own employment decisions.\u201d<\/p>\n<p>The bill makes some exceptions. Non-competes would be permissible in counties of the 6th, 7th, and 8th class (which include <strong><a href=\"https:\/\/www.pacounties.org\/who-we-are\/pennsylvania-county-by-class\">34 counties<\/a><\/strong> in the state) where the geographic restriction is less than a 45-mile radius and the non-compete is in effect for two years or less.<\/p>\n<p>It would also require employers to notify patients when their provider leaves and how to continue treatment under them or switch to a new provider.<\/p>\n<p>Frankel is hopeful that his bill will get through the Senate, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/conservative-actor-jon-voight-promises-to-show-trumps-beautiful-side-in-upcoming-documentary\/\" title=\"Conservative Actor Jon Voight Promises to Show Trump\u2019s \u201cBeautiful Side\u201d in Upcoming Documentary\">noting bipartisan support<\/a> in the House when it passed 150-50 (though Republicans were split). The problem can be a live one in Pennsylvania; anecdotally, he noted hearing of cases where a doctor lives in Pittsburgh but commutes to West Virginia due to a non-compete barring them from working in the commonwealth.<\/p>\n<p>\u201cThe public is unaware unless they face a situation where they lose access to a trusted provider,\u201d he said. \u201cOnce that happens, we hear about it as legislators, but people need to understand that in this current environment, the ability with these restrictive covenants, losing access to that trusted provider is a reality and a possibility.\u201d<\/p>\n<p>Non-compete agreements have attracted national attention since the Federal Trade Commission <strong><a href=\"https:\/\/www.thecentersquare.com\/national\/article_45b3ad7a-8d3a-11ed-b8c3-63164b87d893.html\">proposed a ban<\/a><\/strong> in January and then <strong><a href=\"https:\/\/www.thecentersquare.com\/national\/article_94afe118-01b6-11ef-b226-f32f03c5526b.html\">issued a rule<\/a><\/strong> doing so in April, sparking legal challenges.<\/p>\n<p>\u201cIt seems to me, each state has to look at the circumstances,\u201d said Alden Abbott, a senior research fellow at the Mercatus Center of George Mason University and a former general counsel for the FTC. \u201cBased on the way they carved out the protection for physicians, what Pennsylvania\u2019s trying seems not unreasonable to me and seems to be striking some kind of balance.\u201d<\/p>\n<p>Laws allowing or banning non-competes, he noted, aim to strike a balance between excessive restrictions that could limit worker mobility and allowing agreements that could mean higher pay or better training for workers in exchange for limitations in the future.<\/p>\n<p>The high levels of regulation in the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/california-republican-assemblyman-calls-for-corruption-investigation-into-newsom\/\" title=\"California Republican Assemblyman Calls for Corruption Investigation Into Newsom\">health care industry<\/a>, on both the state and federal levels, though, create some bigger issues.<\/p>\n<p>\u201cThere\u2019s no shortage of serious problems that could be attacked and I would argue that some of those are more serious for the welfare of workers and patients than non-competes,\u201d Abbott said.<\/p>\n<\/p><\/div>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Pennsylvania poised to outlaw non-compete deals for healthcare staff, lifting barriers on their workplace choices.
