Instead, \u2064those accused of retaliating against \u2064them are under \u200bscrutiny. Delaware U.S. Attorney David Weiss&#8217;s filings revealed a focus on the \u2063alleged retaliators. The whistleblowers&#8217; legal team urged \u200binvestigations into Weiss&#8217;s alleged deception\u200d and OSC&#8217;s probe \u200binto retaliation claims, not involving the whistleblowers.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><\/p>\n<div class=\"article-content\">\n<p>The IRS agents who blew the whistle on the Delaware U.S. Attorney\u2019s Office for protecting President Joe Biden\u2019s son are not under investigation, but those who allegedly retaliated against the whistleblowers are. This shocking revelation follows court filings by Delaware U.S. Attorney-cum-Special Prosecutor David Weiss which indicated the whistleblowers\u2019 \u201cconduct\u201d was the subject of a possible investigation.<\/p>\n<p>On Tuesday, the legal team for IRS whistleblowers Gary Shapley and Joseph Ziegler sent a letter to the Department of Justice\u2019s Inspector General and the Office of Professional Responsibility, requesting they investigate Special Counsel Weiss\u2019s office \u201cfor falsely suggest[ing] to the public that some unnamed agency was investigating the conduct of the whistleblowers\u201d when in fact, it was the individuals who allegedly retaliated against the whistleblowers that are the target of the investigation. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1735768034\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-8f98323bec4f589b4ed5afafb1172b6e fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-8f98323bec4f589b4ed5afafb1172b6e\"><\/div>\n<p>Accompanying the referral to the DOJ IG and Office of Professional Responsibility, was a five-page letter that detailed the context of Weiss\u2019s alleged deception. That five-page letter was sent by Shapley and Ziegler\u2019s lawyers to the entity investigating the whistleblowers\u2019 claims of retaliation, namely the U.S. Office of Special Counsel, or \u201cOSC\u201d \u2014 a separate office charged with investigating retaliation claims, not to be confused with Weiss\u2019 Office of Special Counsel. <\/p>\n<p>As the letter to the OSC detailed, in a response to a motion filed by Hunter Biden in his pending criminal tax fraud case, Special Counsel Weiss wrote that \u201cIRS agents, Gary Shapley and Joseph Ziegler, . . . . have <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/exclusive-house-republicans-file-ethics-complaint-against-democrats-who-made-unsubstantiated-claims-that-gop-led-reconnaissance-tours-before-capitol-riot\/\" title=\"EXCLUSIVE: House Republicans File Ethics Complaint Against Democrats Who Made Unsubstantiated Claims That GOP Led \u2018Reconnaissance\u2019 Tours Before Capitol Riot\">made unsubstantiated claims<\/a> that prosecutors\u2019 decision-making in this investigation was infected by politics.\u201d The response filed by the Special Counsel\u2019s office in the Biden criminal case continued: \u201c[A]s described in the attached declaration, Exhibit 2 (filed under seal), the IRS has taken responsible steps to address Shapley\u2019s and Ziegler\u2019s <strong>conduct<\/strong>.\u201d (Emphasis added.)<\/p>\n<p>The accompanying motion to seal Exhibit 2 and two other exhibits explained that the public filing included \u201ca partially redacted paragraph that references a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/exclusive-grassley-demands-doj-irs-come-clean-about-targeting-hunter-biden-whistleblowers\/\" title=\"Exclusive: Grassley Calls on DOJ and IRS to Disclose Details on Targeting Whistleblowers Related to Hunter Biden\">potential ongoing investigation<\/a>(s).\u201d <\/p>\n<p>\u201cThree exhibits (Exhibits 2, 4, and 5) reference a potential ongoing investigation(s),\u201d Special Counsel Weiss further explained, adding: <\/p>\n<div class=\"fdrlst__b89e9-83802dedaf85b7970d167f2930e78fe5 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-83802dedaf85b7970d167f2930e78fe5\"><\/div>\n<blockquote class=\"wp-block-quote\">\n<p>The government was advised by the Office of IRS Chief Counsel that the investigating entity referenced in each of Exhibits 2, 4, and 5 agreed that the documents could be provided to the government and used in a filing with the court provided that the government asked the court to seal these exhibits and certain references to those exhibits in order to protect the integrity of the potential ongoing investigation(s).<\/p>\n<\/blockquote>\n<p>Special Counsel Weiss\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-attends-florida-hearing-as-arguments-over-classified-documents-intensify\/\" title=\"Trump attends Florida hearing amid escalating dispute over classified documents\">legal team added<\/a> that \u201cthe potential investigation(s) may involve allegations of wrongdoing, and the potential investigation(s) could be frustrated, not served, if the public were allowed access to these materials in the midst of the potential investigation(s).\u201d Prosecutors then stressed: \u201cTo be clear, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/is-bidens-irs-meddling-in-the-ig-investigation-of-hunter-biden-whistleblowers\/\" title=\"Is the IRS interfering with the IG investigation of Hunter Biden whistleblowers under Biden's administration?\">aforementioned potential ongoing investigations<\/a> are not references to any investigation of the defendant conducted by the U.S. Department of Justice.\u201d<\/p>\n<p>Given that Special Counsel Weiss argued \u201cthe attached declaration, Exhibit 2 (filed under seal),\u201d established \u201cthe IRS has taken responsible steps to address Shapley\u2019s and Ziegler\u2019s <strong>conduct,\u201d <\/strong>the clear implication was that Shapely and Ziegler were the target of a potential investigation. But on Monday, attorneys for the whistleblowers learned that OSC was the \u201cinvestigating agency\u201d that had \u201cspecifically requested that the government request that the court seal the exhibits . . . in order to protect the integrity of the potential ongoing investigation(s).\u201d<\/p>\n<p>In other words, and as the whistleblowers\u2019 Empower Oversight legal team stressed in its letter to OSC \u2014 calling the information \u201cshocking\u201d \u2014 that means the IRS and Special Counsel Weiss\u2019s office \u201chid and twisted\u201d the fact that the OSC\u2019s was investigating \u201c<em>the whistleblowers\u2019 own allegations<\/em>\u201d of retaliation, to create the false impression that the whistleblowers were under investigation for potential wrongdoing.<\/p>\n<p>Empower Oversight asked the OSC to correct the record and make clear that the referenced investigation was of the whistleblowers\u2019 claims of retaliation and <strong>not<\/strong> of the whistleblowers for any supposed misconduct. The Empower Oversight legal team also suggested that Special Counsel Weiss\u2019s efforts \u201cto generate a false public relations narrative\u201d i.e., that Shapley and Ziegler were under investigation, was \u201cfurther reprisal\u201d for their protected whistleblower disclosures.<\/p>\n<div class=\"fdrlst__b89e9-be04388fd5f2c40af28215aba5e97fdd fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-be04388fd5f2c40af28215aba5e97fdd\"><\/div>\n<p>The false impression the special counsel\u2019s office created that Shapley and Ziegler were under investigation didn\u2019t merely affect the whistleblowers, however. Rather, with the misleading court filings, the special counsel\u2019s office potentially impacted the criminal case against Hunter Biden.<\/p>\n<p>The entire reason Weiss referenced the sealed documents and the potential \u201cinvestigation\u201d was to counter Hunter Biden\u2019s claim that the government had done nothing in response to whistleblowers\u2019 alleged misconduct. Weiss should have refuted Hunter Biden\u2019s charges on the merits, by stressing Shapley and Ziegler had only engaged in protected whistleblower activities. But Weiss apparently couldn\u2019t bring himself to do that, leaving the special counsel\u2019s office to instead suggest the duo were under investigation.<\/p>\n<p>The question remains whether Hunter Biden knew of Weiss\u2019 ploy or was blindsided by today\u2019s revelations that the investigation mentioned by Special Counsel Weiss in the court filing was not an investigation of the whistleblowers, but those who had allegedly retaliated against Shapley and Ziegler.
