Furthermore, it touches on legal aspects of transgender rights, including court rulings on pronoun usage \u2063and workplace \u200cpolicies.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><?xml encoding=\"utf-8\" ?><\/p>\n<div class=\"article-content\">\n<p>New federal regulations that would effectively force employers and employees to use transgender pronouns are illegal, says a lawsuit filed by 18 states against the Democrat-run executive agency. <\/p>\n<p>Filed on Monday in the U.S. District Court for the Eastern District of Tennessee, the <a href=\"https:\/\/www.tn.gov\/content\/dam\/tn\/attorneygeneral\/documents\/pr\/2024\/pr24-43-complaint.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">lawsuit<\/a> brought by Tennessee Attorney General Jonathan Skrmetti and 17 other attorneys general contends that the Equal Employment Opportunity Commission\u2019s (EEOC\u2019s) unilateral move to extend the 1964 Civil Rights Act\u2019s Title VII protections to include so-called \u201cgender identity\u201d represents an unlawful attempt to \u201censhrine sweeping gender-identity mandates without congressional consent.\u201d<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-733920440\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-2088cd0e39b25149e3c787ae43b4d417 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-2088cd0e39b25149e3c787ae43b4d417\"><\/div>\n<p>\u201cIn America, the Constitution gives the power to make laws to the people\u2019s elected representatives, not to unaccountable commissioners, and this EEOC guidance is an attack on our constitutional separation of powers,\u201d Skrmetti said in a <a href=\"https:\/\/www.tn.gov\/attorneygeneral\/news\/2024\/5\/13\/pr24-43.html\">state<\/a><a href=\"https:\/\/www.tn.gov\/attorneygeneral\/news\/2024\/5\/13\/pr24-43.html\" target=\"_blank\" rel=\"noreferrer noopener\">m<\/a><a href=\"https:\/\/www.tn.gov\/attorneygeneral\/news\/2024\/5\/13\/pr24-43.html\">ent<\/a>.\u00a0\u201cWhen, as here, a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/tennessee-leads-18-states-suing-biden-administration-for-new-gender-identity-rules-for-employers\/\" title=\"Tennessee Heads Lawsuit Against Biden Administration Over New Gender Identity Rules\">federal agency engages<\/a> in government <em>over <\/em>the people instead of government <em>by<\/em> the people, it undermines the legitimacy of our laws and alienates Americans from our legal system.\u201d<\/p>\n<p>According to the suit, the \u201cEnforcement Document\u201d the EEOC released on April 29 \u201crequires all covered employers and employees to use others\u2019 preferred pronouns; allow transgender individuals to use the shower, locker room, or restroom that corresponds to their gender identity; and refrain from requiring employees to adhere to the dress code that corresponds to their biological sex.\u201d <\/p>\n<p>The agency justified its new guidance by citing the U.S. Supreme Court\u2019s 2020 decision in <em><a href=\"https:\/\/www.oyez.org\/cases\/2019\/17-1618\" target=\"_blank\" rel=\"noreferrer noopener\">Bostock v. Clayton County<\/a><\/em>, <a href=\"https:\/\/thefederalist.com\/2021\/07\/13\/thanks-to-neil-gorsuch-the-biden-administration-is-forcing-employers-everywhere-to-end-free-speech-and-put-men-in-womens-bathrooms\/\">written <\/a>by Associate Justice Neil Gorsuch and joined by Chief Justice John Roberts along with the court\u2019s four unwavering Constitution-rejecters. Justices Clarence Thomas, Samuel Alito, and Brett Kavanaugh dissented, predicting <em>Bostock <\/em>would set off decades of litigation about sex and gender.<\/p>\n<p>In that case, the high court arbitrarily <a href=\"https:\/\/www.tn.gov\/content\/dam\/tn\/attorneygeneral\/documents\/pr\/2024\/pr24-43-complaint.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> that firing an employee \u201csimply for being homosexual or transgender\u201d constitutes prohibited \u201csex\u201d discrimination under Title VII. While Gorsuch claimed women and men are interchangeable and thus \u201csex\u201d discrimination includes \u201cgender\u201d discrimination, the attorneys general note in their suit against the EEOC that SCOTUS \u201cexpressly declined to \u2018prejudge\u2019 issues like \u2018bathrooms, locker rooms, and dress codes\u2019 under Title VII\u2019s anti discrimination provision.\u201d<\/p>\n<div class=\"fdrlst__b89e9-d8ea8016074e385b782f2d4e258be0c3 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-d8ea8016074e385b782f2d4e258be0c3\"><\/div>\n<p>The recently released EEOC regulations are similar to <a href=\"https:\/\/www.eeoc.gov\/laws\/guidance\/protections-against-employment-discrimination-based-sexual-orientation-or-gender\" target=\"_blank\" rel=\"noreferrer noopener\">rules<\/a> the agency previously issued in June 2021 that argued, \u201cin certain circumstances,\u201d an employer or fellow employee\u2019s \u201cuse of pronouns or names that are inconsistent with an individual\u2019s gender identity\u201d could be \u201cconsidered harassment.\u201d The agency also used SCOTUS\u2019s <em>Bostock<\/em> decision to justify that regulation.<\/p>\n<p>The U.S. District Court for the Northern District of Texas struck down the EEOC\u2019s rules in October 2022. In his decision, Judge Matthew J. Kacsmaryk <a href=\"https:\/\/www.shrm.org\/topics-tools\/news\/inclusion-equity-diversity\/federal-judge-strikes-eeocs-lgbtq-guidance\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> the agency\u2019s guidance misapplied the <em>Bostock<\/em> decision and violated numerous federal laws and its own regulations by \u201cissuing substantive, legislative rules through improper procedures.\u201d<\/p>\n<p>\u201cThe June 15 guidance\u00a0imposes dress-code, bathroom and pronoun accommodations as \u2018existing requirements under the law\u2019 and \u2018established legal positions\u2019 in light of <em>Bostock<\/em> and prior EEOC decisions interpreting Title VII [of the Civil Rights Act of 1964],\u201d Kacsmaryk <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txnd.353372\/gov.uscourts.txnd.353372.74.0_2.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>. \u201cBut Title VII\u2014as interpreted in <em>Bostock<\/em>\u2014does not require such accommodations.\u201d<\/p>\n<p>The ruling came months after the U.S. District Court for the Eastern District of Tennessee \u201c<a href=\"https:\/\/www.tn.gov\/content\/dam\/tn\/attorneygeneral\/documents\/pr\/2021\/pr21-31-complaint.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">temporarily blocked<\/a> the guidance because it interfered with states\u2019 sovereign authority to enforce their state laws,\u201d the <a href=\"https:\/\/www.shrm.org\/topics-tools\/news\/inclusion-equity-diversity\/federal-judge-strikes-eeocs-lgbtq-guidance\" target=\"_blank\" rel=\"noreferrer noopener\">Society for Human Resource Management<\/a> reported. Unlike the Texas court, however, the Tennessee court did not address \u201cthe substantive flaws with EEOC\u2019s reading of Title VII,\u201d only concluding \u201cthat EEOC needed to subject its novel gender-identity guidance to notice-and-comment procedures,\u201d according to Skrmetti and his fellow attorneys general. <\/p>\n<div class=\"fdrlst__b89e9-77c728622cc8f2e524720cc42326689a fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-77c728622cc8f2e524720cc42326689a\"><\/div>\n<p>The EEOC\u2019s relentless attempts to force employers to adopt extremist gender theory come weeks after the Democrat-controlled Department of Education unilaterally rewrote Title IX rules to allow males \u201cidentifying\u201d as females to invade women\u2019s spaces in schools. As my colleague Jordan Boyd <a href=\"https:\/\/thefederalist.com\/2024\/04\/19\/biden-admins-title-ix-rewrite-obliterates-female-spaces-free-speech-and-due-process\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>, the new guidelines \u201ceffectively erase protections for sex-based spaces by expanding the Title IX prohibition against <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/retired-nfl-player-calls-for-separate-transgender-category-of-sports-after-biden-executive-order\/\" title=\"Retired NFL Player Calls For Separate Transgender Category Of Sports After Biden Executive Order\">sex discrimination<\/a> to include \u2018gender identity\u2019 \u2014 a term that\u2019s never mentioned in the original law.\u201d <\/p>\n<p>This means that men proclaiming to be women can use formerly female-only spaces such as locker rooms and sororities and participate in female-only sports leagues. The new rules have prompted a <a href=\"https:\/\/www.highereddive.com\/news\/15-states-attorneys-general-title-ix-lawsuits-department-of-education\/715004\/\" target=\"_blank\" rel=\"noreferrer noopener\">flurry of lawsuits<\/a> from GOP-led states.
