McCarthy highlighted the\u200d challenges\u200d in \u2063proving\u2063 fraud with specific criminal intent.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p style=\"font-weight: 400\">Former Assistant U.S. Attorney Andrew McCarthy, who led the successful 1995 terrorism prosecution against Sheikh Omar Abdel-Rahman and eleven others in the 1993 World Trade Center bombing, <a href=\"https:\/\/grabien.com\/story.php?id=472713&#038;utm_source=cliplist&#038;utm_medium=email&#038;utm_campaign=cliplist20240514&#038;utm_content=story472713\">commented<\/a> on the ongoing trial of former President Donald Trump in the Stormy Daniels hush money case.<\/p>\n<p style=\"font-weight: 400\">The indictment, brought by Manhattan District Attorney Alvin Bragg, accuses Trump of falsifying internal records held by the Trump Organization to hide the intent of payments made to Michael Cohen, who paid off porn star Stormy Daniels and Playboy model Karen McDougal so the stories of their alleged trysts with Trump would not become public in 2016. Cohen claims the Trump Organization reimbursed him along with bonuses; prosecutors contend that the money was falsely logged as legal expenses.<\/p>\n<p style=\"font-weight: 400\">\u201cThey haven\u2019t come close to proving that fraud has taken place,\u201d McCarthy stated. \u201cAnd it\u2019s \u2014 they don\u2019t just have to prove that fraud has taken place, they have to prove that it was fraud that included a specific intent to commit another crime, which we believe is a federal campaign finance crime. It\u2019s astonishing that we don\u2019t \u2014 we can\u2019t say that with complete certainty, and that\u2019s supposed to be spelled out in the indictment. But there\u2019s not a scintilla of evidence that Trump was even thinking about <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hollywood-liberals-dumping-massive-amounts-of-money-into-georgia-senate-runoffs\/\" title=\"Hollywood Liberals Dumping Massive Amounts Of Money Into Georgia Senate Runoffs\">federal campaign law<\/a>, let alone that they conspired to violate it.\u201d<\/p>\n<p style=\"font-weight: 400\">\u201cAnd I think it\u2019s important to make this distinction: You can make an agreement, which as Jonathan just said, is a legal arrangement, to not disclose, or to try to bury politically embarrassing information; you can absolutely intend to do that,\u201d he continued. \u201cThat doesn\u2019t mean that you were even thinking about the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/registered-foreign-agent-gave-200k-to-mcauliffe-campaign\/\" title=\"Registered Foreign Agent Gave 0K to McAuliffe Campaign\">federal campaign finance laws<\/a>, much less willfully violating them beyond a reasonable doubt. \u00a0This is what Bragg has to prove here to at least get a conviction, at least as a matter of law.
