The guidance \u200bextends Title VII protections, penalizing employers for misusing pronouns or\u2063 restricting facilities based\u2062 on biological sex rather\u200b than gender identity. Skrmetti criticized the EEOC&#8217;s guidance, claiming it undermines \u2064the separation of powers and constitutional legitimacy.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<p style=\"font-weight: 400\">On Monday, Tennessee Attorney General Jonathan Skrmetti led a coalition of 18 states in filing a lawsuit against the Equal Employment Opportunity Commission (EEOC) after it released new sexual harassment guidance extending Title VII\u2019s protections against <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/school-retroactively-suspended-student-over-sexual-assault-allegations-after-he-graduated-the-school-just-settled\/\" title=\"School Retroactively Suspended Student Over Sexual Assault Allegations AFTER He Graduated. The School Just Settled.\">sex-based discrimination<\/a> to cover gender identity.<\/p>\n<p style=\"font-weight: 400\">On April 29, the EEOC released its new guidance, which insists an employer may be liable under Title VII if they or another employee use a name or pronoun inconsistent with an employee\u2019s preferred gender identity. Not only that, but an employer can be liable by limiting access to a bathroom or other sex-segregated facility, such as a shower or locker room, based on biological sex and not on gender identity. If a customer or other non-employee fails to use an employee\u2019s preferred pronouns or refuses to share a restroom with someone of the opposite sex, the employer could also be sued.<\/p>\n<p style=\"font-weight: 400\">\u201cIn America, the Constitution gives the power to make laws to the people\u2019s elected representatives, not to unaccountable commissioners, and this EEOC guidance is an attack on our constitutional separation of powers,\u201d Skrmetti said. \u201cWhen, as here, a federal agency engages in government <em>over <\/em>the people instead of government <em>by<\/em> the people, it undermines the legitimacy of our laws and alienates Americans from our legal system. This end-run around our constitutional institutions misuses federal power to eliminate women\u2019s private spaces and punish the use of biologically-accurate pronouns, all at the expense of Tennessee employers.\u201d<\/p>\n<p style=\"font-weight: 400\">On January 20, 2021, the day President Biden was inaugurated, he signed an \u201cExecutive Order on Preventing and Combating Discrimination on the Basis of Gender Identity or Sexual Orientation.\u201d That order declared that \u201claws that prohibit sex discrimination\u2026prohibit discrimination on the basis of gender identity or sexual orientation.\u201d Biden directed federal agencies to \u201cfully implement statutes that prohibit sex discrimination\u201d consistent with the administration\u2019s interpretation.<\/p>\n<p style=\"font-weight: 400\">In response to the executive order, Biden\u2019s Department of Education and the Equal Employment Opportunity Commission issued guidance documents providing their interpretations of Title IX of the Education Amendments Act of 1972 and Title VII of the Civil Rights Act of 1964.<\/p>\n<p style=\"font-weight: 400\">On June 15, 2021, the EEOC issued a \u201cTechnical Assistance Document\u201d which purported to explain employers\u2019 obligations with respect to dress codes, bathrooms, locker rooms, showers, and use of preferred pronouns or names.<\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1715771734791000&#038;usg=AOvVaw3RAccFxpm5CI2m5KR1E_Ul\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p style=\"font-weight: 400\">On June 23, 2021, the Department of Education issued a \u201cDear Educator\u201d letter to directly notify those subject to Title IX of the Department\u2019s Interpretation. The \u201cDear Educator\u201d letter reiterated that \u201cTitle IX\u2019s protection against sex discrimination encompasses discrimination based on sexual orientation and gender identity\u201d and explained that the Department \u201cwill fully enforce Title IX to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-equality-work-destroys-spiritual-liberty-heres-what-you-ought-to-know\/\" title=\"The \u2018Equality ACT\u2019 Destroys Spiritual Liberty: Here\u2019s WHAT YOU OUGHT TO Know\">prohibit discrimination based<\/a> on sexual orientation and gender identity.\u201d<\/p>\n<p style=\"font-weight: 400\">On August 30, 2021, the state of Tennessee led a coalition of states and filed a complaint challenging the legality of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-feds-misquoted-scotus-to-force-states-to-let-men-in-girls-restrooms\/\" title=\"Judge: Feds Misquoted SCOTUS to Force States to Let Men in Girls' Restrooms\">guidance documents issued<\/a> by the Department and the EEOC in response to Biden\u2019s executive order. \u00a0In 2022, the United States District Court Eastern District of Tennessee <a href=\"https:\/\/www.tn.gov\/content\/dam\/tn\/attorneygeneral\/documents\/pr\/2022\/pr22-23-order.pdf\" target=\"_blank\" rel=\"noopener\">granted<\/a> the injunction.<\/p>\n<p><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Tennessee AG Jonathan Skrmetti and 18 states sued the EEOC over new sexual harassment guidance.
