The rule reinforces removal restrictions and prohibits the reclassification of federal bureaucrats. This broad regulatory change was built specifically to block the reinstatement of Trump-era reforms. The deep state will soon become even less accountable.<\/p>\n<p>The federal employee dismissal process is broken. Agencies take <a href=\"https:\/\/www.gao.gov\/assets\/gao-15-191.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">six months to a year<\/a> to remove poor performers, followed by lengthy appeals that <a href=\"https:\/\/americafirstpolicy.com\/issues\/20220914-union-arbitrators-overturn-most-federal-employee-dismissals\" target=\"_blank\" rel=\"noreferrer noopener\">often result in reinstatement<\/a> with back pay. If the employee wins, agencies must typically cover their attorney fees \u2014 at rates of <a href=\"http:\/\/www.laffeymatrix.com\/see.html\" target=\"_blank\" rel=\"noreferrer noopener\">$400 to $1,000 per hour<\/a>. This makes removing employees for even the worst offenses expensive and uncertain.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-306999719\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-49a661223f21c3110cf905ce24036a2f fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-49a661223f21c3110cf905ce24036a2f\"><\/div>\n<p>For example, the Department of Justice suspended two prosecutors who <a href=\"https:\/\/www.nytimes.com\/2013\/04\/08\/us\/politics\/judge-overturns-suspensions-for-stevens-prosecutors.html\" target=\"_blank\" rel=\"noreferrer noopener\">withheld<\/a> exculpatory evidence from a U.S. senator\u2019s defense team. The government restored two months of <a href=\"https:\/\/www.mspb.gov\/decisions\/precedential\/GOEKE_AND_BOTTINI_CB_0752_15_0228_I_1_OPINION_AND_ORDER_1122421.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">back wages<\/a> and paid out <a href=\"https:\/\/www.mspb.gov\/decisions\/nonprecedential\/GOEKE_AND_BOTTINI_CB_0752_15_0228_A_1_FINAL_ORDER_1327251.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">$643,000<\/a> in attorney fees.<\/p>\n<p>This dysfunction is all too common. Removing problematic employees is difficult in every <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/white-house-releases-list-of-president-trumps-accomplishments-and-it-is-historic\/\" title=\"White House Releases List of President Trump\u2019s Accomplishments \u2013  And It Is Historic!\">federal agency<\/a>. Half <a href=\"https:\/\/www.opm.gov\/fevs\/reports\/governmentwide-reports\/governmentwide-management-report\/governmentwide-report\/2021\/2021-governmentwide-management-report.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">report chronic poor performance<\/a> in their unit, and most <a href=\"https:\/\/www.opm.gov\/fevs\/reports\/governmentwide-reports\/governmentwide-management-report\/governmentwide-report\/2021\/2021-governmentwide-management-report.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">don\u2019t believe their agency<\/a> effectively addresses poor performers. <a href=\"https:\/\/www.mspb.gov\/studies\/researchbriefs\/Remedying_Unacceptable_Employee_Performance_in_the_Federal_Civil_Service_1627610.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Fewer than half<\/a> of federal career supervisors feel confident they could dismiss an employee for serious misconduct. Just a quarter believe they could remove a poor performer. Federal employees recognize the system is broken.<\/p>\n<p>Unfortunately, this dysfunction empowers bad actors, and it is not uncommon for career employees to inject partisanship into their official duties.<\/p>\n<div class=\"fdrlst__b89e9-54f4c0520d690afb57ffd04b9046e05f fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-54f4c0520d690afb57ffd04b9046e05f\"><\/div>\n<p>Such partisanship was <a href=\"https:\/\/www.washingtonpost.com\/politics\/resistance-from-within-federal-workers-push-back-against-trump\/2017\/01\/31\/c65b110e-e7cb-11e6-b82f-687d6e6a3e7c_story.html\" target=\"_blank\" rel=\"noreferrer noopener\">particularly evident <\/a>during the Trump administration. The press widely reported on <a href=\"https:\/\/www.bloomberg.com\/news\/features\/2017-12-18\/washington-bureaucrats-are-chipping-away-at-trump-s-agenda\" target=\"_blank\" rel=\"noreferrer noopener\">career employees opposing<\/a> the president\u2019s policies; some even <a href=\"https:\/\/www.freedomfoundation.com\/labor\/records-shed-light-on-bidens-day-one-firing-of-trumps-nlrb-general-counsel\/\" target=\"_blank\" rel=\"noreferrer noopener\">boasted<\/a> about their \u201cresistance.\u201d Many career bureaucrats acted as though they \u2014 not elected officials or presidential appointees \u2014 should set policy. <a href=\"https:\/\/www.monmouth.edu\/polling-institute\/reports\/monmouthpoll_us_031918\/\" target=\"_blank\" rel=\"noreferrer noopener\">Most Americans<\/a> recognize unelected bureaucrats have too much control over federal policy. The \u201cdeep state\u201d is real, and it is a serious challenge to our democracy.<\/p>\n<p>President Trump addressed these problems with an <a href=\"https:\/\/www.federalregister.gov\/documents\/2020\/10\/26\/2020-23780\/creating-schedule-f-in-the-excepted-service\" target=\"_blank\" rel=\"noreferrer noopener\">executive order<\/a> creating \u201cSchedule F\u201d for career officials in policy-influencing jobs. The order made them at-will employees, just like most private sector workers, without removal restrictions. Schedule F gave agencies the ability to effectively and quickly address poor performance or misconduct. At the same time, the order continued protections against politically motivated or discriminatory removals.<\/p>\n<p>Schedule F was designed with successful state-level reforms in mind. Many states have made most or all state employees at-will employees. <a href=\"https:\/\/americafirstpolicy.com\/issues\/20220913-at-will-employment-in-the-career-service-would-improve-florida-state-government\" target=\"_blank\" rel=\"noreferrer noopener\">These reforms<\/a> have generally shown positive results without the feared abuses materializing. <\/p>\n<p>Texas and Florida \u2014 two of America\u2019s three most populous states \u2014 have embraced at-will employment. Their state governments operate quite well. Schedule F would have expanded these successes nationally. The government can operate effectively if it has the will to do so.<\/p>\n<div class=\"fdrlst__b89e9-4ee4fe206d3da052409a3b52f0d3d7ea fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-4ee4fe206d3da052409a3b52f0d3d7ea\"><\/div>\n<p>Despite Schedule F\u2019s potential, President Biden revoked it shortly after taking office. His administration has now issued a new <a href=\"https:\/\/www.federalregister.gov\/documents\/2023\/09\/18\/2023-19806\/upholding-civil-service-protections-and-merit-system-principles\" target=\"_blank\" rel=\"noreferrer noopener\">rule<\/a> designed to prevent a future administration from bringing back Schedule F. The new regulations reinforce career employee removal restrictions and prohibit reclassifying career employees into an at-will status. Federal bureaucrats who inject partisanship into their duties will remain hard to dismiss. So will chronic poor performers.<\/p>\n<p>The Biden administration\u2019s rule cements major flaws in the federal workforce. The rule protects poor performers and bureaucratic resistance. It seems designed to ensure the deep state will remain unaccountable to the president \u2014 and the American people.<\/p>\n<p>Even government employees recognize the federal dismissal process is broken. President Biden\u2019s new rule will make it even harder to fix.
