Ballot drop boxes have been a contentious issue\u200c in Wisconsin,\u2062 especially during the 2020 election. The \u200dcase on reinstating absentee ballot drop boxes \u200bin Wisconsin was recently reviewed by the liberal-leaning Wisconsin Supreme Court. It is likely that the \u200cprevious ruling against the boxes \u200cwill be overturned, a decision that was influenced by the court&#8217;s conservative majority in 2022.\u200d The use \u2062of ballot drop boxes has been a significant issue in Wisconsin, particularly during \u200bthe 2020 \u200delection.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>The <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/wisconsin-supreme-court\/\" target=\"_blank\" rel=\"noopener\" title>Wisconsin Supreme Court<\/a> heard oral arguments Monday<a href=\"https:\/\/www.washingtonexaminer.com\/news\/campaigns\/state\/3001000\/wisconsin-supreme-court-examine-ruling-limited-ballot-drop-boxes\/\" target=\"_blank\" rel=\"noopener\" title> on a case<\/a> that could decide whether <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/wisconsin\/\" target=\"_blank\" rel=\"noopener\" title>Wisconsin<\/a> clerks could reinstate absentee <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/ballot\/\" target=\"_blank\" rel=\"noopener\" title>ballot<\/a> drop boxes after the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/spygate-judge-tries-to-protect-hillary-clinton-in-latest-pre-trial-rulings\/\" title=\"Spygate Judge Tries To Protect Hillary Clinton In Latest Pre-Trial Rulings\">court previously ruled<\/a> against it. <\/p>\n<p>The court, which has a liberal majority, seemed in favor of overturning a previous decision that said ballot drop boxes were not allowed to be placed outside a county clerk\u2019s office. The 2022 ruling was decided when the court had a 4-3 conservative majority, which has since flipped.<\/p>\n<p>Ballot drop boxes were an especially notable point of contention during the 2020 election in Wisconsin.\u00a0\u201cWhat if we just got it wrong?\u201d Democratic Justice Jill Karofsky <a href=\"https:\/\/www.jsonline.com\/story\/news\/politics\/2024\/05\/13\/wisconsin-supreme-court-liberals-question-past-ruling-on-drop-boxes\/73617689007\/\" target=\"_blank\" rel=\"noopener\" title>asked<\/a>, referring to the court\u2019s prior decision. \u201cWhat if we made a mistake? Are we now supposed to just perpetuate that mistake into the future?\u201d<\/p>\n<p>Ballot drop boxes were used far before the 2020 election, popping up across the state in the 1980s and 1990s, according to the <em>Milwaukee Journal Sentinel<\/em>. (AP Photo\/Scott Bauer, File)<\/figcaption><\/figure>\n<p>During the arguments, the court\u2019s liberal justices questioned the 2022 decision to ban the boxes. The 2022 <a href=\"https:\/\/www.theguardian.com\/us-news\/article\/2024\/may\/13\/wisconsin-ballot-drop-box-ban\" target=\"_blank\" rel=\"noopener\" title>ruling<\/a> said the boxes were illegal because they were not directly accounted for in any Wisconsin law. <\/p>\n<p>Some of the arguments Monday focused on the Wisconsin legislature\u2019s past statements of support for the boxes\u2019 use. However, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-supreme-court-is-poised-to-rule-on-affirmative-action-heres-what-you-need-to-know\/\" title=\"Supreme Court to Decide on Affirmative Action: Key Points\">conservative justices questioned<\/a> why legislators\u2019 decisions mattered to the court.<\/p>\n<p>\u201cWe\u2019ve had parties change their positions very recently in this court, and other people haven\u2019t been troubled by that \u2014 why does it matter that the legislature takes a different view of the statute for us to read the statute faithfully?\u201d conservative Justice Brian Hagedorn asked. <\/p>\n<p>Conservative Justice Rebecca Bradley argued that the plaintiffs\u2019 argument centered on the high court becoming lawmakers. <\/p>\n<p>\u201cYou are asking this court to become a superlegislature and give free rein, despite what the statutes say, give free rein to municipal clerks to conduct elections however they see fit,\u201d Bradley said. \u201cThat, counsel, seems to me to be the greater danger to democracy because you\u2019re asking this court to override what the legislature wrote.\u201d<\/p>\n<p>Still, the court appeared keen on overturning the 2022 ruling to reinstate the drop boxes.<\/p>\n<p><a href=\"http:\/\/washingtonexaminer.com\/\" target=\"_blank\" rel=\"noopener\" title><strong>CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/strong><\/a><\/p>\n<p>\u201cJust to be clear, there\u2019s nothing in the statutes that says that drop boxes are unauthorized or illegal,\u201d Karofsky <a href=\"https:\/\/www.nbcnews.com\/politics\/elections\/wisconsin-supreme-court-ballot-drop-box-ban-rcna151654\" target=\"_blank\" rel=\"noopener\" title>said<\/a>.<\/p>\n<p>The decision will come ahead of the 2024 general election, in which Wisconsin is one of several crucial swing states.
