These so-called \u201cabortion shield laws\u201d \u2014 many of which are likely unconstitutional \u2014 will defeat any ability for pro-life states and their citizens to hold abortionists accountable for violating their health and safety standards. Diligently enforced, shield laws invite a new war between the states over not just the lives of unborn children, but also our system of government.<\/p>\n<p>The extradition clause of the Constitution <a href=\"https:\/\/constitution.congress.gov\/browse\/article-4\/#:~:text=The%20United%20States%20shall%20guarantee,be%20convened)%20against%20domestic%20Violence.\" target=\"_blank\" rel=\"noreferrer noopener\">requires<\/a> that\u00a0\u201c[a] Person charged in any State with Treason, Felony, or other Crime, who shall flee from Justice, and be found in another State, shall on Demand of the executive Authority of the State from which he fled, be delivered up, to be removed to the State having Jurisdiction of the Crime.\u201d In short, a state cannot turn down another state\u2019s request to extradite fugitives within its borders.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-659985372\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-7d3597a9bae79067d0aa913b34d8e28f fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-7d3597a9bae79067d0aa913b34d8e28f\"><\/div>\n<p>Shield laws, such as those in <a href=\"https:\/\/casetext.com\/statute\/consolidated-laws-of-new-york\/chapter-criminal-procedure\/part-3-special-proceedings-and-miscellaneous-procedures\/title-q-procedures-for-securing-attendance-at-criminal-actions-and-proceedings-of-defendants-not-securable-by-conventional-means-and-related-matters\/article-570-securing-attendance-of-defendants-who-are-outside-the-state-but-within-the-united-states-rendition-to-other-jurisdictions-of-defendants\/section-57017-extradition-for-legally-protected-health-activity?ssr=false&#038;resultsNav=false&#038;tab=keyword&#038;jxs=wi\" target=\"_blank\" rel=\"noreferrer noopener\">New York<\/a> and <a href=\"https:\/\/casetext.com\/statute\/general-laws-of-massachusetts\/part-iv-crimes-punishments-and-proceedings-in-criminal-cases\/title-ii-proceedings-in-criminal-cases\/chapter-276-search-warrants-rewards-fugitives-from-justice-arrest-examination-commitment-and-bail-probation-officers-and-board-of-probation\/section-27613-surrendering-accused-not-in-demanding-state-at-time-of-crime-or-leaving-demanding-state-involuntarily?ssr=false&#038;resultsNav=false&#038;tab=keyword&#038;jxs=wi\" target=\"_blank\" rel=\"noreferrer noopener\">Massachusetts<\/a>, hug the edges of the extradition clause by prohibiting the surrender of non-fugitives. Accordingly, a person who promotes abortions while physically present within a pro-abortion state cannot be handed over to a pro-life state in which the abortion has occurred. After all, he has not actually fled from the pro-life state. As The New York Times points out, such laws <em>de facto<\/em> <a href=\"https:\/\/www.nytimes.com\/2024\/02\/22\/health\/abortion-shield-laws-telemedicine.html\" target=\"_blank\" rel=\"noreferrer noopener\">protect<\/a> those who prescribe abortion pills through telemedicine to women out-of-state.<\/p>\n<p>Several anti-extradition laws also indicate that abortionists are not their only concern. <a href=\"https:\/\/casetext.com\/statute\/new-jersey-statutes\/title-2a-administration-of-civil-and-criminal-justice\/chapter-2a160-persons-taken-out-of-state-to-answer-criminal-charge-warrant-of-governor-or-waiver-of-extradition\/section-2a160-141-surrender-of-individuals-seeking-reproductive-health-care-services-lawful-in-new-jersey-prohibited?ssr=false&#038;resultsNav=false&#038;tab=keyword&#038;jxs=wi\" target=\"_blank\" rel=\"noreferrer noopener\">New Jersey<\/a> protects those \u201ccharged in [another] state whose executive authority is making the [extradition] demand with \u2026 traveling to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/major-doctors-organization-publicly-embraces-dismembering-babies-until-birth\/\" title=\"Major Doctors\u2019 Organization Publicly Embraces Dismembering Babies Until Birth\">obtain reproductive health care services<\/a> that are permitted under the laws of this State.\u201d Language like this appears to falsely assume that pro-life states are criminalizing women and girls for seeking abortions out-of-state, concerns that reflect the media\u2019s narrative distortion.<\/p>\n<p>NBC News, for instance, reported in April 2023 that \u201cIdaho becomes one of the most extreme anti-abortion states with law restricting travel for abortions.\u201d Yet, the law in question does not actually criminalize out-of-state travel. It merely criminalizes adults who <a href=\"https:\/\/casetext.com\/statute\/idaho-code\/title-18-crimes-and-punishments\/chapter-6-abortion-and-contraceptives\/section-18-623-abortion-trafficking?ssr=false&#038;resultsNav=false&#038;tab=keyword&#038;jxs=wi\" target=\"_blank\" rel=\"noreferrer noopener\">transport<\/a> children outside of Idaho \u201cwith the intent to conceal an abortion from the parents or guardian.\u201d In that sense, anti-extradition laws \u2014 by covering abortion seekers who are at no risk of going to jail \u2014 are part of a broader campaign to smear pro-life states as cruel and extremist simply for trying to protect girls from adult abusers who often <a href=\"https:\/\/www.heritage.org\/life\/commentary\/abortion-pills-coercion-and-abuse\" target=\"_blank\" rel=\"noreferrer noopener\">force<\/a> them to undergo an abortion to hide the abuse.<\/p>\n<h2 class=\"wp-block-heading\"><\/h2>\n<p class=\"MsoNormal\"><span class=\"None\"><\/span><\/p>\n<p><span style=\"font-size: revert; color: initial;\">Making Prosecution Impossible<\/span>    <\/p>\n<p>Not content with harboring abortionists, abortion shield laws also make it impossible to charge or prosecute them in the first place. Several pro-abortion states have <a href=\"https:\/\/casetext.com\/statute\/illinois-compiled-statutes\/rights-and-remedies\/chapter-735-civil-procedure\/act-35-uniform-interstate-depositions-and-discovery-act\/section-735-ilcs-3535-unenforceable-foreign-subpoenas?ssr=false&#038;resultsNav=false&#038;tab=keyword&#038;jxs=wi\" target=\"_blank\" rel=\"noreferrer noopener\">banned<\/a> their courts from issuing subpoenas following another state\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/colombia-decriminalizes-abortion\/\" title=\"Colombia Decriminalizes Abortion\">abortion-related investigations<\/a>. State law enforcement agencies have been <a href=\"https:\/\/casetext.com\/statute\/general-statutes-of-connecticut\/title-54-criminal-procedure\/chapter-962-costs-fees-and-expenses-in-criminal-proceedings-or-prosecutions\/section-54-155a-public-agency-employees-etc-may-not-provide-information-in-furtherance-of-any-interstate-investigation-regarding-reproductive-health-care-services?ssr=false&#038;resultsNav=false&#038;tab=keyword&#038;jxs=wi\" target=\"_blank\" rel=\"noreferrer noopener\">ordered<\/a> to stop working on abortion cases with their counterparts from pro-life states.\u00a0Existing subpoenas can be <a href=\"https:\/\/casetext.com\/statute\/revised-code-of-washington\/title-7-special-proceedings-and-actions\/chapter-7115-protected-health-care-services\/section-7115030-subpoenas-quashing?ssr=false&#038;resultsNav=false&#038;tab=keyword&#038;jxs=wi\" target=\"_blank\" rel=\"noreferrer noopener\">quashed<\/a> if a state court finds that they <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-andrew-p-napolitano-twitter-and-the-freedom-of-speech\/\" title=\"Judge Andrew P. Napolitano: Twitter and the Freedom of Speech\">violate public policy<\/a> regarding \u201cprotected health care services,\u201d a euphemism for abortions and transgender surgeries.<\/p>\n<div class=\"fdrlst__b89e9-ca78c52c6feb30004a16038bd4b1ae2d fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-ca78c52c6feb30004a16038bd4b1ae2d\"><\/div>\n<p>\u201cIt will be virtually impossible for a prosecutor or civil attorney in a pro-life state to build a case against an abortionist who injures a woman or girl during a surgical or drug-induced abortion when the state where the abortionist lives will not cooperate,\u201d <a href=\"http:\/\/xn--it%20will%20be%20virtually%20impossible%20for%20a%20prosecutor%20or%20civil%20attorney%20in%20a%20pro-life%20state%20to%20build%20a%20case%20against%20an%20abortionist%20who%20injures%20a%20woman%20or%20girl%20during%20a%20surgical%20or%20drug-induced%20abortion%20when%20the%20state%20where%20the%20abortionist%20lives%20will%20not%20cooperate,%20observes%20mary%20e-v544voua.%20harned,%20an%20associate%20scholar%20at%20the%20charlotte%20lozier%20institute.\/\" target=\"_blank\" rel=\"noreferrer noopener\">observes<\/a> Mary E. Harned, an associate scholar at the Charlotte Lozier Institute. <\/p>\n<p>On top of that, <a href=\"https:\/\/casetext.com\/statute\/revised-code-of-washington\/title-7-special-proceedings-and-actions\/chapter-7115-protected-health-care-services\/section-7115030-subpoenas-quashing?ssr=false&#038;resultsNav=false&#038;tab=keyword&#038;jxs=wi\">Washington<\/a> even bans businesses from complying with subpoenas, warrants, and other court orders issued as part of an out-of-state abortion investigation. This represents an unprecedented attack on private employers who have conscientious objections to abortion, as the right to do business is made contingent upon complicity in the abortionist agenda.<\/p>\n<p>Meanwhile, abortionists are given a comfortable life thanks to abortion shield laws that remove any negative professional consequences. Some states prohibit state medical boards from <a href=\"https:\/\/casetext.com\/statute\/colorado-revised-statutes\/title-12-professions-and-occupations\/division-of-professions-and-occupations\/article-30-provisions-applicable-to-health-care-professions-and-occupations\/part-1-miscellaneous-provisions-applicable-to-health-care-professions-and-occupations\/section-12-30-121-legally-protected-health-care-activity-prohibit-adverse-action-against-regulated-professionals-and-applicants-definitions?ssr=false&#038;resultsNav=false&#038;tab=keyword&#038;jxs=wi\" target=\"_blank\" rel=\"noreferrer noopener\">disciplining<\/a> abortionists based on abortions performed out-of-state. Malpractice insurance companies are not allowed to <a href=\"https:\/\/casetext.com\/statute\/delaware-code\/title-18-insurance-code\/part-i-insurance\/chapter-25-rates-and-rating-organizations\/section-2535-adverse-actions-on-policies-relating-to-provision-of-medical-care-for-termination-of-pregnancy?ssr=false&#038;resultsNav=false&#038;tab=keyword&#038;jxs=wi\" target=\"_blank\" rel=\"noreferrer noopener\">impose<\/a> higher premiums on abortionists despite the risk of out-of-state sanctions. These privileges are often extended to <a href=\"https:\/\/casetext.com\/statute\/general-laws-of-massachusetts\/part-i-administration-of-the-government\/title-ii-executive-and-administrative-officers-of-the-commonwealth\/chapter-13-division-and-boards-of-registration\/section-13105-board-of-registration-of-genetic-counselors-powers-and-duties?ssr=false&#038;resultsNav=false&#038;tab=keyword&#038;jxs=wi\" target=\"_blank\" rel=\"noreferrer noopener\">genetic counselors<\/a>, <a href=\"https:\/\/casetext.com\/statute\/oregon-revised-statutes\/title-52-occupations-and-professions-occupations-and-professions\/chapter-675-psychologists-occupational-therapists-certified-sexual-offense-therapists-regulated-social-workers-licensed-professional-counselors-and-marriage-and-family-therapists\/psychologists\/licensing\/section-675070-authorized-sanctions-grounds-for-imposing-sanctions-civil-penalty?ssr=false&#038;resultsNav=false&#038;tab=keyword&#038;jxs=wi\" target=\"_blank\" rel=\"noreferrer noopener\">psychologists<\/a>, and other healthcare professionals who might push their patients to get an abortion.<\/p>\n<h2 class=\"wp-block-heading\"><span style=\"font-size: revert; color: initial;\">Abortionists Will Relocate<\/span><\/h2>\n<p>Given the many benefits abortion shield laws offer, one can expect abortionists to migrate en masse to pro-abortion states. From there, they will set up telemedicine hubs and \u201cunderground railroads\u201d that serve abortion tourists. <\/p>\n<div class=\"fdrlst__b89e9-d4c0d95482b5aff0a5728cc121a58538 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-d4c0d95482b5aff0a5728cc121a58538\"><\/div>\n<p>The architects of abortion shield laws openly admit that they intend for this to happen. For example, Colorado\u2019s Senate Bill 23-188 <a href=\"https:\/\/leg.colorado.gov\/sites\/default\/files\/2023a_188_signed.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">states<\/a> that \u201creproductive and gender-affirming health-care providers in states with abortion and gender-affirming health-care bans will want to relocate to states that protect their practice and values, thereby becoming an important part of Colorado\u2019s health-care infrastructure.\u201d<\/p>\n<p>Ultimately, certain abortion shield laws enable abortionists to enact vengeance upon anyone who seeks to hold them accountable for their malfeasance. A \u201cclawback provision,\u201d as The Hartford Courant <a href=\"https:\/\/www.courant.com\/2022\/04\/30\/connecticut-senate-passes-abortion-bill-after-emotional-debate-gov-lamont-pledges-signature\/\" target=\"_blank\" rel=\"noreferrer noopener\">labels<\/a> it, typically creates a new right of action for \u201ctortious interference\u201d with abortion.<\/p>\n<p>  As such, an abortionist held civilly liable in a pro-life state can sue the original plaintiffs for damages on the grounds that the latter had sued him first. This includes women and girls who suffered abortion-related injuries. When abortionists can recover litigation costs from their victims, the deterrent effect of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/scotus-to-hear-appeal-over-ky-abortion-law\/\" title=\"SCOTUS to hear appeal over Ky. abortion law\">pro-life laws<\/a> is all but dead.<\/p>\n<p>Abortion shield laws put the commercial interests of abortionists ahead of the safety of women and girls, not to mention the damage done to long-standing traditions of interstate cooperation. Pro-abortion states are turning themselves into impregnable fortresses for the abortion industry and havens for abortion tourism.
