New bombshell <a href=\"https:\/\/oversight.heritage.org\/OP_Memo_on_EO_14019_Partisan_Implementation_5.1.2024.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">documents<\/a> obtained by the Heritage Foundation\u2019s Oversight Project reinforce that is precisely the point of the directive \u2014 and the administration is working in cahoots with left-wing activist groups to achieve it.<\/p>\n<p>In March 2021, President Biden signed an \u201cExecutive Order on Promoting Access to Voting.\u201d The administration inked the directive, apparently the <a href=\"https:\/\/www.realclearinvestigations.com\/articles\/2023\/07\/26\/conservatives_oppose_secretive_biden_voting_order_as_bidenbucks_-_federal_zuckbucks_on_steroids_968461.html\" target=\"_blank\" rel=\"noreferrer noopener\">brainchild<\/a> of leftist think-tank Demos, to cheers from dozens of like-minded but officially nonpartisan nongovernmental organizations.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-915606294\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-c0eef1bee2f88fd192b22af41a214c82 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-c0eef1bee2f88fd192b22af41a214c82\"><\/div>\n<p>As I have been <a href=\"https:\/\/www.realclearinvestigations.com\/articles\/2023\/07\/26\/conservatives_oppose_secretive_biden_voting_order_as_bidenbucks_-_federal_zuckbucks_on_steroids_968461.html\" target=\"_blank\" rel=\"noreferrer noopener\">reporting<\/a> at <a href=\"https:\/\/www.realclearinvestigations.com\/articles\/2024\/04\/10\/how_taxpayers_will_heavily_subsidize_democrat_boots_on_the_ground_this_election_1023475.html\" target=\"_blank\" rel=\"noreferrer noopener\">RealClearInvestigations<\/a>, Executive Order 14019 mandates that every single federal agency register and mobilize voters with the express intent of increasing election participation among minority groups that tend to vote disproportionately Democrat. In pursuit of its aims, the order calls on agencies to \u201csolicit[] and facilitat[e] approved, nonpartisan third-party organizations \u2026 to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-puts-susan-rice-in-charge-of-effort-to-expand-vote-by-mail\/\" title=\"Biden Puts Susan Rice in Charge of Effort to Expand Vote by Mail\">provide voter registration services<\/a> on agency premises.\u201d<\/p>\n<p>That language has raised alarm bells among the right, who suspect the leftist groups supportive of the order \u2014 that may be unconstitutional or <a href=\"https:\/\/www.realclearinvestigations.com\/articles\/2023\/07\/26\/conservatives_oppose_secretive_biden_voting_order_as_bidenbucks_-_federal_zuckbucks_on_steroids_968461.html\" target=\"_blank\" rel=\"noreferrer noopener\">violate<\/a> several laws \u2014 could coordinate with agencies to implement it and increase registration only of Democrat voters.<\/p>\n<p>Such an effort could well prove decisive. A since-deleted but archived <a href=\"https:\/\/web.archive.org\/web\/20230327011211\/https:\/www.demos.org\/sites\/default\/files\/2023-02\/Voting%20Access%20EO%20Impact%20Estimates.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Demos analysis<\/a> indicates that, if fully implemented, the order could lead to 3.5 million new or updated voter registrations <em>annually<\/em> \u2014 a massive figure considering recent presidential elections have been decided by mere thousands of votes in a handful of states.<\/p>\n<h2 class=\"wp-block-heading\">Bombshell Memo<\/h2>\n<p>Details from a July 2021 listening session the Department of Justice (DOJ) conducted with leftist activists about implementing the order, revealed for the first time in a May 1 Oversight Project <a href=\"https:\/\/oversight.heritage.org\/OP_Memo_on_EO_14019_Partisan_Implementation_5.1.2024.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">memo<\/a>, suggest fears of collusion between federal agencies and leftist activist groups are more than merited. The details come from a set of unredacted notes taken by a DOJ attorney.<\/p>\n<div class=\"fdrlst__b89e9-f0e983ff117775946de416d30dd34270 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-f0e983ff117775946de416d30dd34270\"><\/div>\n<p>During those proceedings, Biden administration officials heard from activists overwhelmingly from the left. According to its review of the listening session roster, the Oversight Project found that \u201cEvery participant whose party affiliation or political donation history could be identified by the Oversight Project was identified as a Democrat except for one Green Party member.\u201d<\/p>\n<p>Here were some of their recommendations, as recounted by the unnamed Justice Department official:<\/p>\n<ul>\n<li>Keeda Haynes of The Sentencing Project indicated that eligible voters who are incarcerated \u201chave been left out of voting,\u201d and emphasized that those held in pretrial custody also have the right to vote. Haynes proposed a variety of ways the Federal Bureau of Prisons (BOP) could <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/2-more-gop-states-exit-national-voter-verification-coalition\/\" title=\"2 More GOP States Exit National Voter Verification Coalition\">provide voter registration information<\/a> during prisoner admission, orientation training, and various other touch points with prison personnel. She also recommended that authorities \u201cprovide in-person voting options, such as voting machines\u201d at facilities where \u201celigible voters\u201d reside. \u201cFelony disenfranchisement is voter suppression,\u201d the DOJ attorney recorded.<\/li>\n<\/ul>\n<ul>\n<li>Dana Paikowsky of the Campaign Legal Center indicated a desire to \u201cdevelop infrastructure in jails and prisons and also help people understand their eligibility after they are released.\u201d She related that her organization remained \u201cconcerned about BOP\u2019s focus on voter registration only, and only on individuals from ME, VT, and DC. Felons in Puerto Rico are also eligible to vote. In Mississippi, don\u2019t lose right to vote for federal convictions, and AL also has some eligibility. Those individuals with convictions for federal misdemeanors can usually vote, too.\u201d<\/li>\n<\/ul>\n<ul>\n<li>Terry Minnis of Asian Americans Advancing Justice pushed not only for agencies to create multi-lingual materials pertaining to voting, but for making \u201cvoter registration info mandatory at naturalization ceremonies.\u201d<\/li>\n<\/ul>\n<ul>\n<li>Michelle Bishop of the National Disability Rights Network reportedly called on increasing the access to vote for people in long-term care facilities \u2014 without any apparent concern suffering patients could be taken advantage of by partisan operatives.<\/li>\n<\/ul>\n<ul>\n<li>Nik Youngsmith of the Mexican American Legal Defense and Educational Fund seemed to acknowledge that under the order, noncitizens could be registered to vote, noting \u201cFederal employees need to know who should be properly registered and not. Don\u2019t want someone to face charges for registering based on bad info.\u201d<\/li>\n<\/ul>\n<p>The documents obtained by the Oversight Project date back to a July 2021 meeting, yet represent something of a major revelation in May 2024. That illustrates how surreptitious this effort has been.<\/p>\n<h2 class=\"wp-block-heading\">Administration Partnering with Leftist Groups<\/h2>\n<p>Although the Biden administration has stonewalled congressional Republicans over the strategic plans each agency was to develop in accordance with the order, evidence has <a href=\"https:\/\/thefederalist.com\/2024\/02\/29\/9-ways-the-feds-are-using-bidenbucks-to-rig-the-2024-election\/\" target=\"_blank\" rel=\"noreferrer noopener\">slowly emerged<\/a> through primarily conservative media reportage and watchdog groups\u2019 Freedom of Information Act requests and litigation, suggesting the administration took the groups\u2019 suggestions to heart.<\/p>\n<div class=\"fdrlst__b89e9-13b6764a269528429a3907ea3235013c fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-13b6764a269528429a3907ea3235013c\"><\/div>\n<p>In January, The Daily Signal <a href=\"https:\/\/www.dailysignal.com\/2024\/01\/30\/how-biden-pushes-inmate-voting-with-help-from-interest-groups\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> that BOP \u201chas partnered with and regularly consults on voting issues with the League of Women Voters, the American Civil Liberties Union, the Campaign Legal Center, and the Washington Lawyers\u2019 Committee\u201d \u2014 several of which were represented at the July 2021 listening session \u2014 in connection with the executive order. A BOP spokesman detailed that the bureau had partnered with such groups to offer \u201ccivics education classes\u201d and \u201cvoter registration drives\u201d at several correctional facilities nationwide.<\/p>\n<p>Mississippi Secretary of State Michael Watson wrote a <a href=\"https:\/\/www.foxnews.com\/politics\/top-red-state-official-demands-answers-biden-executive-order-attempting-register-illegals-vote\" target=\"_blank\" rel=\"noreferrer noopener\">letter<\/a> in March to Attorney General Merrick Garland raising concerns that under Executive Order 14019, the U.S. Marshals Service was being directed to \u201cmodify agreements with jails\u201d to mandate that they \u201cprovide voter registration materials and facilitate voting by mail,\u201d on top of requiring the DOJ \u201cto facilitate voter registration and mail voting for individuals in the custody of the Bureau of Prisons.\u201d According to Watson, this could lead to not only ineligible voters but among them noncitizens \u2014 including illegal aliens \u2014 being encouraged to illegally register to vote.<\/p>\n<p>U.S. Citizenship and Immigration Services is <a href=\"https:\/\/www.foxnews.com\/politics\/biden-admin-launches-push-expand-voter-registration-citizenship-ceremonies\" target=\"_blank\" rel=\"noreferrer noopener\">working<\/a> to register voters at naturalization ceremonies. Other agencies ranging from the Departments of Housing and Urban Development to Labor and <a href=\"https:\/\/www.dailysignal.com\/2024\/05\/02\/exclusive-under-biden-order-usda-teams-with-left-wing-groups-to-grow-new-voters\/\" target=\"_blank\" rel=\"noreferrer noopener\">Agriculture<\/a> have also been executing plans to register voters who favor Democrats.<\/p>\n<p>In connection with a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.pamd.140876\/gov.uscourts.pamd.140876.18.0_3.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">federal lawsuit<\/a> challenging the order brought by 27 Pennsylvania state legislators, the Foundation for Government Accountability (FGA) \u2014 which has sued the Biden administration to unearth documents and communications associated with the order \u2014 filed an amicus brief asserting that:<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>all of the federal agencies FGA has identified as taking active steps to carry out EO 14019 have one thing in common: They provide government welfare benefits and other services to groups of voters the vast majority of which have historically voted Democrat.<\/p>\n<\/blockquote>\n<p>The House Small Business Committee recently subpoenaed the Small Business Administration (SBA) over its stonewalling regarding an agreement the agency came to with all-important swing state Michigan to \u201cpromote civic engagement and voter registration\u201d \u2014 including through allowing state officials to engage in in-person voter registration efforts at SBA\u2019s business outreach events.<\/p>\n<p>Consistent with FGA\u2019s brief, Fox News <a href=\"https:\/\/www.foxnews.com\/politics\/key-biden-agency-slapped-historic-subpoenas-improper-swing-state-voter-registration-push\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a> that:<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>An investigation by the House Small Business Committee found that 22 out of 25 such outreach events have taken place in counties with the highest population of Democratic National Committee (DNC) target demographics.<\/p>\n<p>Meanwhile, 11 of 15 Michigan counties that showed the largest <a href=\"https:\/\/www.foxnews.com\/politics\/appeals-court-drops-charges-michigan-elections-worker-downloaded-voter-list\">voter <\/a><a href=\"https:\/\/www.foxnews.com\/politics\/appeals-court-drops-charges-michigan-elections-worker-downloaded-voter-list\" target=\"_blank\" rel=\"noreferrer noopener\">registration<\/a> increase over the last year have ranked highest in population of young voters and Black voters, according to the committee \u2014 two of the left\u2019s most-sought voting blocs.<\/p>\n<\/blockquote>\n<p>To the extent the Biden administration is using the full resources of the federal government to turn out Democrat voters under the facially nonpartisan guise of expanding the franchise to allegedly underrepresented groups, this would echo Democrats\u2019 related efforts to use nonprofit organizations to achieve the same. As I recently reported at RealClearInvestigations, at least one major Democrat Super PAC has written to donors that:<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>501(c)(3) voter registration focused on underrepresented groups in the electorate would be the \u2018single most effective tactic for ensuring Democratic victories\u2019 \u2013 \u20184 to 10 times more cost-effective\u2019 on after-tax basis at \u2018garnering additional Democratic votes\u2019 relative to alternatives like \u2018broadcast media and digital buys.\u2019<\/p>\n<\/blockquote>\n<p>In recent election cycles, Democrat fat cats and dark-money vehicles have given hundreds of millions of dollars to left-leaning, state-based voter registration organizations targeting demographics that tend to vote Democrat in pivotal states. These outfits have arguably flouted IRS restrictions on charities engaging in political activity by targeting their \u201cnonpartisan\u201d electioneering activities toward populations likely to vote blue.<\/p>\n<p>As reported, at least two recipients of grants under the Everybody Votes Campaign \u2014 the left\u2019s preferred vehicle for driving out voters via 501(c)(3)s \u2014 were listed on an <a href=\"https:\/\/thefga.org\/wp-content\/uploads\/2022\/09\/CRT-9-8-22-Production-FGA_section-17.pdf#page=2\" target=\"_blank\" rel=\"noreferrer noopener\">email<\/a> as participants at the July 2021 listening session.<\/p>\n<h2 class=\"wp-block-heading\">Legal Challenge\u2019s Urgency<\/h2>\n<p>With the 2024 election fast approaching and the Biden administration executive order beinge implemented, Pennsylvania legislators\u2019 challenge to it has taken greater urgency. Several weeks ago a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/andrea-peyser-persecuting-christians-who-refuse-to-do-work-for-same-sex-weddings-is-nothing-less-than-bigotry\/\" title=\"Andrea Peyser: Persecuting Christians Who Refuse to Do Work for Same-Sex Weddings Is Nothing Less Than Bigotry\">district court judge dismissed<\/a> the case on standing grounds. On April 23, the legislators filed a petition for writ of certiorari at the Supreme Court, and asked the court to <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23-1162\/308607\/20240429165257988_Motion%20to%20Expedite%20SCOTUS%20Petition%204-29-24.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">expedite the case<\/a>.<\/p>\n<p>The legislators believe the executive order violates state laws \u201cprohibiting the influence of outside organizations in election operations\u201d enacted over concerns regarding the influence of \u201cZuckerbucks\u201d \u2014 private financing of public election administration from the Zuckerberg-Chan Foundation \u2014 during the 2020 election. In their motion urging the Supreme Court to swiftly take up the case, the legislators explain that Congress neither authorized the executive action nor appropriated funding for it, and that Pennsylvania law therefore bars such voter registration activities.<\/p>\n<p>When the relevant law was introduced, its sponsor\u2019s memo \u201cexplained the need to prevent public officials from partnering with third party non-governmental organizations \u2018for the registration of voters or the preparation, administration or conducting of an election in this Commonwealth.\u2019\u201d<\/p>\n<p>\u201cExactly what the legislators sought to prevent through their law-making authority has now been facilitated by executive action by the President who is also a candidate in the 2024 election and, as such, stands to benefit personally from the executive action,\u201d the legislators wrote.<\/p>\n<p>Time will tell whether the Supreme Court will hear their case, rule that they do in fact have standing, and thereby give them a chance to seek an injunction that would halt the executive order before voting begins.
