<span>   May 11, 2024 at 10:52am <\/span> <\/span>  <\/header>\n<section>\n<p>In today\u2019s edition of \u201cpetty grievances escalated to an absurd level,\u201d a popular ice cream chain has been sued for allegedly misleading customers as to the ingredients of one of its most popular flavors.<\/p>\n<p>In a case currently dividing opinions on the internet, a woman has sued Cold Stone Creamery because, allegedly, its pistachio ice cream contained no actual pistachios.<\/p>\n<p>Really.<\/p>\n<p>As reported in the U.K.\u2019s <a href=\"https:\/\/www.theguardian.com\/us-news\/article\/2024\/may\/08\/cold-stone-pistachio-ice-cream-lawsuit\" target=\"_blank\" rel=\"noopener\">Guardian<\/a>, this whole sorry saga began in July 2022, when a Long Island woman ordered a scoop of pistachio ice cream at a local <a href=\"https:\/\/www.westernjournal.com\/blood-splatters-store-cold-stone-creamery-employee-loses-3-fingers-job\/\" target=\"_blank\" rel=\"noopener\">Cold Stone.<\/a><\/p>\n<p>To her sorrow, however, upon looking up the ingredients later on, she found that it contained \u201cpistachio flavoring\u201d rather than actual pistachios.<\/p>\n<p>The woman then decided this was enough grounds for a lawsuit, which has been escalated to the Eastern District Court of New York in Brooklyn, presided over by federal Judge Gary Brown.<\/p>\n<p>According to <a href=\"https:\/\/www.businessinsider.com\/cold-stone-creamery-sued-pistachio-ice-cream-no-nuts-2024-5\" target=\"_blank\" rel=\"noopener\">Business Insider<\/a>, the woman and her legal team argued that she \u201creasonably believed\u201d that the offending dairy treat contained pistachios, and when she found it most likely did not, \u201cheartbreak followed.\u201d<\/p>\n<p>Oh, boy.<\/p>\n<p>In response to this heart-wrenching tragedy, the woman \u2014 or, more likely, her lawyer\u2019s clerks \u2014 compiled a formidable amount of evidence, including comparisons with ice cream brands that actually contain pistachios, as well as a survey that found 85 percent of consumers believed that a pistachio-flavored product would contain pistachios.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Is this a frivolous lawsuit?<\/p>\n<\/p><\/div>\n<p>Judge Brown wrote that the case was a \u201cdeceptively complex question about the reasonable expectations,\u201d and that, in response to Cold Stone\u2019s argument, \u201cIt seems inconceivable that such a consumer should have to search online to find the relevant webpages while waiting in line to order a scoop of ice-cream.\u201d<\/p>\n<p>Granted, this woman might have a legitimate <a href=\"https:\/\/www.westernjournal.com\/judge-allows-class-action-whopper-lawsuit-proceed-burger-king-explaining\/\" target=\"_blank\" rel=\"noopener\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-steven-crowder-announces-lawsuit-against-facebook\/\" title=\"BREAKING: Steven Crowder Announces Lawsuit Against Facebook\">false advertising<\/a><\/a> case.<\/p>\n<p>After all, it would seem logical to assume that a pistachio-flavored product would contain actual pistachios.<\/p>\n<p>However, the ingredient list did cite \u201cnatural flavor,\u201d which has been the standard way for major food corporations to disguise their use of cheaper substitutes (though there could be at least a little pistachio in there).<\/p>\n<p>As <a href=\"https:\/\/www.healthline.com\/nutrition\/natural-flavors\" target=\"_blank\" rel=\"noopener\">Healthline<\/a> explained, the only requirement for \u201cnatural flavors\u201d is that they be derived from a plant or animal.<\/p>\n<p>Still, all this legal hullabaloo has revolved around a cup of ice cream costing around $5.<\/p>\n<p>False advertising aside, was this really worth this woman dedicating two years or more of her life, compiling evidence and lawyers and escalating this case to a federal court?<\/p>\n<p>She easily could have gone back to the <a href=\"https:\/\/www.westernjournal.com\/woman-licked-ice-cream-carton-identified\/\" target=\"_blank\" rel=\"noopener\">Cold Stone<\/a> and asked for a refund, and that would have been the end of it.<\/p>\n<p>This did not need to be taken before a federal judge.<\/p>\n<p>But, in an increasingly <a href=\"https:\/\/www.westernjournal.com\/entitled-woman-assaults-mcdonalds-employees-refusing-special-request-fight-back-ends-leaving-handcuffs\/\" target=\"_blank\" rel=\"noopener\">entitled society<\/a>, many genuinely believe that something as petty as a misleading ice cream name deserves legal and financial compensation.<\/p>\n<p>And if the legal system allows them to escalate their
