Upper III<\/span><\/a> <\/span> <span>   May 10, 2024 at 8:59am <\/span> <\/span>  <\/header>\n<section>\n<p>A Texas judge has dismissed misdemeanor charges of riot participation filed against 211 alleged illegal immigrants who stood accused of overrunning members of the Texas National Guard in March at the U.S.-Mexico border in El Paso.<\/p>\n<p>County Court of Law Judge Ruben Morales dismissed the charges Wednesday, ruling that his court had no jurisdiction over the cases, according to the <a href=\"https:\/\/www.elpasotimes.com\/story\/news\/local\/2024\/05\/08\/over-200-border-riot-cases-in-el-paso-thrown-out-over-technicality-migrants\/73620450007\/\" target=\"_blank\" rel=\"noopener\">El Paso Times<\/a>.<\/p>\n<p>The public defender in the case, Kelli Childress, had moved for dismissal, claiming that the EL Paso District Attorney\u2019s Office had failed to submit a \u201ctransfer order\u201d when the cases were removed from the district court and moved to the county\u2019s docket.<\/p>\n<p>Without that order, Childress argued, jurisdiction over <a href=\"https:\/\/www.westernjournal.com\/migrant-mob-overwhelms-soldiers-us-soil-bowls-left-guard-front-gate\/\" target=\"_blank\" rel=\"noopener\">the cases<\/a> remained with the original court.<\/p>\n<p>\u201cAll of those processes were ignored here,\u201d Childress claimed, according to the Times.<\/p>\n<p>Kyle Lasley of the El Paso County DA\u2019s Office, unsurprisingly, disagreed.<\/p>\n<p>\u201cThis process argument does not deprive this court of jurisdiction,\u201d he told the judge, arguing that since the county court had jurisdiction over misdemeanor cases, it could rule on the 211 riot participation cases regardless of whether the transfer orders had been filed.<\/p>\n<p>Morales sided with the public defender, according to the Times.<\/p>\n<p>\u201cIf I don\u2019t have jurisdiction,\u201d Morales said, \u201cthere\u2019s nothing I can do on these cases\u201d except dismiss them, the outlet reported.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Is illegal immigration going to be the most significant issue of the 2024 election?<\/p>\n<\/p><\/div>\n<p>After the hearing, Childress said the DA\u2019s Office should focus on <a href=\"https:\/\/www.westernjournal.com\/white-house-issues-disgraceful-response-video-illegal-immigrant-mob-plowing-border-agents\/\" target=\"_blank\" rel=\"noopener\">more important cases<\/a> rather than expending resources <a href=\"https:\/\/www.westernjournal.com\/judge-gives-easter-sunday-gift-migrants-arrested-southern-border-riot-overwhelmed-us-soldiers\/\" target=\"_blank\" rel=\"noopener\">prosecuting misdemeanors<\/a>.<\/p>\n<p>\u201cThe tenacity with which they\u2019re going after these misdemeanor cases that don\u2019t even have evidence,\u201d she told reporters Wednesday.<\/p>\n<p>\u201cWhen we\u2019ve got thousands of cases still in backlog waiting to have their cases reviewed and screened and brought to a grand jury \u2026 and these cases somehow, 18 hours after they\u2019re dismissed for no probable cause, those are able to be brought to a grand jury,\u201d she claimed.<\/p>\n<p>The Times reported that Childress claimed to be waiting on the DA\u2019s Office to review 1,600 open cases, about half of which were over six months old and another quarter of which had been open for a year or longer.<\/p>\n<p>\u201cIt\u2019s very frustrating to watch what\u2019s happening there and really not understanding,\u201d Childress said.<\/p>\n<p>\u201cI keep hearing the words that this is not a political move and this is not an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/new-poll-shows-latinos-sour-on-biden-could-cost-him-arizona-nevada\/\" title=\"Recent Poll Indicates Latino Discontent With Biden, Potentially Impacting Arizona and Nevada\">anti-immigration position<\/a>, but instead of hearing what it\u2019s not, I\u2019d like to hear what it is,\u201d she added.<\/p>\n<p>District Attorney Bill Hicks said he would appeal the dismissals, however.<\/p>\n<p>\u201cOur office feels very strongly that the procedure was proper,\u201d Hicks said during a news conference on Thursday, according to the Times.<\/p>\n<p>\u201cWe argued that it was appropriate and proper and we feel very strongly that it was done properly and Morales\u2019 order is an inappropriate order,\u201d he added.<\/p>\n<hr>\n<div>\n<p><b><i>An Important Message from Our Staff:<\/i><\/b><\/p>\n<p><i><span>In just a few months, the world is going to change forever.
