Subsequent statements from Bailey modified his original assertions.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/commentary\/\">  Commentary <\/a>  <\/p>\n<h2>Judge Engoron Under Investigation for What Happened Before Slapping Trump with $454 Million Fine<\/h2>\n<p> <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/cfavocci\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/cfavocci\/%20\"><span>Christine Favocci<\/span><\/a> <\/span> <span>   May 10, 2024 at 4:37am <\/span> <\/span>  <\/header>\n<section>\n<p>The New York State Commission on Judicial Conduct has launched a probe into a New York real estate attorney\u2019s claim that he advised Judge Arthur Engoron in the case against former President Donald Trump.<\/p>\n<p>Attorney Adam Leitman Bailey told <a href=\"https:\/\/www.nbcnewyork.com\/investigations\/new-york-lawyer-tried-advise-judge-trump-trial-civil-fraud\/5395676\/\" target=\"_blank\" rel=\"noopener\">WNBC-TV<\/a> that he had a courthouse conversation with Engoron three weeks before the judge would slap Trump with a $454 million <a href=\"https:\/\/www.westernjournal.com\/trump-savages-judge-engoron-whopping-350-million-fine-ruled-even-saw-case\/\" target=\"_blank\" rel=\"noopener\">penalty<\/a> for fraudulently inflating the value of his assets.<\/p>\n<p>New York judges are barred from considering outside opinions in such a way when litigating a case, yet Bailey said he discussed the legal questions at length with the judge.<\/p>\n<p>\u201cI actually had the ability to speak to him three weeks ago,\u201d Bailey said in an interview with the station on Feb. 16, just hours before the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-issues-injunction-blocking-several-directives-from-l-a-countys-new-controversial-d-a\/\" title=\"Judge Issues Injunction Blocking Several Directives From L.A. County\u2019s New Controversial D.A.\">judge issued<\/a> his ruling.<\/p>\n<p>\u201cI saw him in the corner [at the courthouse], and I told my client, \u2018I need to go,&#8217;\u201d he recounted.<\/p>\n<p>\u201cAnd I walked over, and we started talking \u2026 I wanted him to know what I think and why \u2026 I really want him to get it right,\u201d the attorney continued.<\/p>\n<p>Bailey said he knew Engoron after appearing before him \u201chundreds of times\u201d in the course of his employment.<\/p>\n<p>\u201cHe had a lot of questions, you know, about certain cases. We went over it,\u201d the attorney said.<\/p>\n<p>He said he \u201cexplained to\u201d Engoron that ruling against Trump would have far-reaching implications beyond destroying the former president, including damaging New York\u2019s economy.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Was Engoron biased against Trump?<\/p>\n<\/p><\/div>\n<p>If Trump were forced to pay a <a href=\"https:\/\/www.westernjournal.com\/trump-posts-bond-ny-fraud-case-crushing-democrats-fantasies\/\" target=\"_blank\" rel=\"noopener\">hefty fine<\/a> and shut down his business, it would make other companies concerned about similarly being targeted at any time, even when there were no actual damages or victims, as in this case.<\/p>\n<p>Trump\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/why-both-republicans-and-democrats-are-wrong-about-bill-barr\/\" title=\"Why Both Republicans And Democrats Are Wrong About Bill Barr\">legal team raised<\/a> the same points, which Engoron ignored in his verdict.<\/p>\n<p>In a later interview with WNBC, Bailey walked back his claims slightly, saying they \u201cdidn\u2019t even mention the word \u2018Donald Trump&#8217;\u201d during their conversation.<\/p>\n<p>However, the attorney admitted that it was understood exactly what they were discussing.<\/p>\n<p>\u201cWell, obviously, we weren\u2019t talking about the Mets,\u201d Bailey said.<\/p>\n<p><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/o1ZBhHbYbjY?si=MCK2QePHvRS7Ch4I\" width=\"560\" height=\"315\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p>According to the New York State Rules of Judicial Conduct, \u201ca judge shall not initiate, permit, or consider ex parte communications, or consider other communications made to the judge outside the presence of the parties or their lawyers.\u201d<\/p>\n<p>While Engoron would be allowed to \u201cobtain the advice of a disinterested expert,\u201d it would require notice to everyone involved in the case with the chance to respond.<\/p>\n<p>Al Baker, a spokesman for the state\u2019s Office of Court Administration, denied that the judge had <a href=\"https:\/\/www.westernjournal.com\/california-judge-rules-trump-ally-disbarred-role-2020-election\/\" target=\"_blank\" rel=\"noopener\">broken those rules<\/a>.<\/p>\n<p>\u201cThe decision Justice Engoron issued February 16 was his alone, was deeply considered, and was wholly uninfluenced by this individual,\u201d Baker said in a statement, according to WNBC.<\/p>\n<p>Bailey has said he\u2019s not a fan of Trump, but that doesn\u2019t necessarily mean he\u2019s telling the truth.<\/p>\n<p>After all, he\u2019s the kind of attorney who had his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/terry-mcauliffe-fundraises-for-virginia-dem-who-served-time-for-underage-sex\/\" title=\"Terry McAuliffe Fundraises for Virginia Dem Who Served Time for Underage Sex\">law license suspended<\/a> for allegedly telling a party in a case that they \u201cshould just kill themselves,\u201d an appellate court <a href=\"https:\/\/www.abajournal.com\/news\/article\/lawyer-is-suspended-partly-for-telling-tenant-he-is-worthless-and-should-commit-suicide\" target=\"_blank\" rel=\"noopener\">found in 2019<\/a>.<\/p>\n<p>Still, everything about Engoron and how he applied the law was questionable, even without Bailey\u2019s accusation.<\/p>\n<p>It\u2019s clear that anti-Trump zealots in New York, including Engoron and Democratic New York Attorney General Letitia James, blatantly <a href=\"https:\/\/www.westernjournal.com\/trump-returns-fire-ny-ag-letitia-james-net-worth-fraud-allegations-targeted\/\" target=\"_blank\" rel=\"noopener\">targeted<\/a> the former president.<\/p>\n<p>James brought the civil lawsuit, and Engoron dutifully imposed a ridiculous penalty that would have greatly reduced Trump\u2019s wealth had it not been <a href=\"https:\/\/www.westernjournal.com\/watch-trump-stuns-reporter-1-word-answer-question-bond-payment\/\" target=\"_blank\" rel=\"noopener\">lowered<\/a> to $175 million.<\/p>\n<p>They did this without much to go on besides criminalizing a common business practice that is part of the dance between borrowers and lenders.<\/p>\n<p>Engoron may or may not have acted on Bailey\u2019s advice, but it\u2019s crystal clear that the judge had a mission that had nothing to do with justice.<\/p>\n<hr>\n<div>\n<p><b><i>A Note from Our Deputy Managing Editor:<\/i><\/b><\/p>\n<p><i><span>I heard a chilling comment the other day: \u201cWe don\u2019t even know if an election will be held in 2024.\u201d <\/span><\/i><\/p>\n<p><i><span>That wasn\u2019t said by a conspiracy theorist or a doomsday prophet.
