Now \u2014 four years later \u2014 the State Election Board (SEB) chided the county for violating the law during the 2020 election but stopped short of referring the case for further investigation by the attorney general.<\/p>\n<p>The SEB <a href=\"https:\/\/georgiarecorder.com\/2024\/05\/07\/georgia-oversight-panel-ruminates-on-2020-election-hiccups-as-2024-showdowns-loom\/\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> 2-1 Tuesday that Fulton County must have an independent election monitor to oversee its elections after it found more than 3,000 ballots were scanned twice during the 2020 presidential recount. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-885087242\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-03874a22bd6dce37db9448ad158edb65 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-03874a22bd6dce37db9448ad158edb65\"><\/div>\n<p>The Georgia secretary of state\u2019s office could not confirm how many of the ballots that were scanned twice were also counted, <a href=\"https:\/\/www.ajc.com\/politics\/georgia-election-board-reprimands-fulton-for-double-scanned-ballots-in-2020\/G3H27SUHGFDRHAOZSG4JQJ2F7E\/\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a> to the Atlanta-Journal Constitution (AJC). General counsel for the secretary of state\u2019s office Charlene McGowan said their investigation found \u201cthere are some duplicative ballot images in the ballot images that Fulton County provided, but what cannot be confirmed conclusively is if those ballots were included in the count.\u201d<\/p>\n<p>\u201cFulton County used improper procedures during the recount of the presidential contest in 2020,\u201d McGowan concluded.<\/p>\n<p>There are also 380,761 ballot images from the 2020 Election Day machine count that are \u201cnot available,\u201d state board member Janice Johnston said during Tuesday\u2019s meeting. <\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\"> <span class=\"h5mgjA6H0BC1w8ZzTsG3Dav\"><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">\u201cDoes the investigation confirm that there are missing ballot images?\u201d<\/p>\n<p>\u201cYes.\u201d<\/p>\n<p>Case closed. Johnston then asked Fulton County about the 380,761 missing ballot images, to which Ann Brumbaugh, who is <a href=\"https:\/\/myfultoncountyga.org\/-\/media\/BRE31824-Approved-Minutes.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">legal counsel<\/a> for the Fulton County Board of Elections, said it was the \u201cfirst time\u201d she was hearing of these allegations. <\/p>\n<div class=\"fdrlst__b89e9-ef9afed68e7e437dd1f2baf5d5f87d0a fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-ef9afed68e7e437dd1f2baf5d5f87d0a\"><\/div>\n<p>Harrison Floyd, one of the co-defendants in Fulton County District Attorney Fani Willis\u2019 lawfare case against former President Donald Trump, claimed in a post on X that the county was lying. <\/p>\n<p>\u201cThis is NOT the first time Fulton County has heard this allegation because we made it in COURT and my attorneys subpoenaed them for the images,\u201d Floyd <a href=\"https:\/\/twitter.com\/hw_floyd\/status\/1788204510483234824\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>. \u201cFulton County is refusing the comply with our subpoena.\u201d<\/p>\n<p>Floyd <a href=\"https:\/\/www.fultonclerk.org\/DocumentCenter\/View\/2529\/76-MOTION-10-13-23\" target=\"_blank\" rel=\"noreferrer noopener\">subpoenaed<\/a> the county\u2019s election board seeking copies of the voting system \u201cof each original unique native ballots cast for all mail-in, absentee, and Uniformed and Overseas Citizens Absentee Voting Act\u201d for the 2020 election. The Board then filed a \u201cMotion to Quash Subpoena\u201d in 2023.<\/p>\n<p>The Georgia Recorder claimed that \u201celection officials determined mistakes in 2020 by <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/georgia-secretary-of-state-partially-bends-the-knee-acknowledges-ballots-were-counted-unlawfully-and-in-secret\/\" title=\"Georgia Secretary of State Partially Bends The Knee, Acknowledges \u2018Ballots Were Counted Unlawfully And In Secret\u2019\">county election workers<\/a> would not have changed the outcome.\u201d President Joe Biden won the Peach State by 11,779 votes. Following the election, a law was passed requiring ballot images to be kept for two years after each vote. <\/p>\n<div class=\"fdrlst__b89e9-daf25ae3065f8de29cedbc9289c61860 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-daf25ae3065f8de29cedbc9289c61860\"><\/div>\n<p>The <a href=\"https:\/\/voterga.org\/wp-content\/uploads\/2024\/05\/2023-025-Counting-Complaint.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">complaint<\/a> over Fulton County\u2019s handling of the election was brought by Joseph Rossi and Kevin Moncla, who alleged in filings the presence of 3,125 duplicate ballots as well as \u201c17,852 votes \u2026 for which no physical ballot was in evidence.\u201d<\/p>\n<p>Board member Ed Lindsey acknowledged the \u201cclear evidence that in 2020 there were numerous violations of regulations and statutes,\u201d but nonetheless proposed a motion to give Fulton County a mere slap on the wrist. His motion, which the SEB adopted, \u201callows the county to avoid paying a fine or having the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wisconsin-special-counsel-91-nursing-homes-had-95-100-voter-turnout-in-2020\/\" title=\"Wisconsin Special Counsel: 91 Nursing Homes Had 95-100% Voter Turnout in 2020\">attorney general investigate<\/a> the double-counting of 3,075 ballots and other allegations of irregularities during the 2020 presidential recount,\u201d according to the <a href=\"https:\/\/georgiarecorder.com\/2024\/05\/07\/georgia-oversight-panel-ruminates-on-2020-election-hiccups-as-2024-showdowns-loom\/\" target=\"_blank\" rel=\"noreferrer noopener\">Georgia Recorder<\/a>. <\/p>\n<p>Republicans including the DeKalb County GOP called on Lindsey to resign in March over his <a href=\"https:\/\/thefederalist.com\/2024\/03\/18\/georgia-election-board-member-voted-on-cases-involving-counties-he-lobbied-for\/\" target=\"_blank\" rel=\"noreferrer noopener\">voting<\/a> on cases that appeared before the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dekalb-county-gop-calls-on-georgia-election-board-member-to-resign-over-lobbying-conflicts\/\" title=\"DeKalb County GOP urges Georgia Election Board member to step down due to lobbying conflicts\">board involving clients<\/a> he lobbied for, as The Federalist\u2019s Shawn Fleetwood <a href=\"https:\/\/thefederalist.com\/2024\/03\/27\/dekalb-county-gop-calls-on-georgia-election-board-member-to-resign-over-lobbying-conflicts\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported<\/a>. Lindsey is a registered lobbyist for the DeKalb and Cobb County governments.<\/p>\n<p>\u201cLindsey also <a href=\"https:\/\/media.ethics.ga.gov\/search\/Lobbyist\/Lobbyist_Name.aspx?&#038;FilerID=L20160004\">previously lobbie<\/a>d on <a href=\"https:\/\/media.ethics.ga.gov\/search\/Lobbyist\/Lobbyist_Group.aspx?&#038;FilerID=L20160004&#038;LGID=18883\">behalf<\/a> of the National Vote at Home Coalition, a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/antifa-leftists-get-censored-by-social-media-platforms\/\" title=\"Antifa, leftists get censored by social media platforms\">left-wing organization<\/a> that pushes insecure mail-in voting policies and notably interfered in the 2020 election to boost Democrats,\u201d Fleetwood reported. <\/p>\n<p>Johnston voted against the motion in favor of more accountability for the county.<\/p>\n<p>\u201cEither the votes should be invalidated or the paper ballots should be investigated to verify their authenticity,\u201d Johnston said, according to the AJC. \u201cThere\u2019s no way this election or recount should have been certified.\u201d<\/p>\n<p>\u201cWith over 140 violations of election laws and rules, it would be a travesty not to refer this to the Attorney General and let this ride,\u201d Johnston <a href=\"https:\/\/georgiarecorder.com\/2024\/05\/07\/georgia-oversight-panel-ruminates-on-2020-election-hiccups-as-2024-showdowns-loom\/\" target=\"_blank\" rel=\"noreferrer noopener\">added<\/a>.<\/p>\n<p>Voters Organized for Trusted Election Results in Georgia <a href=\"https:\/\/voterga.org\/wp-content\/uploads\/2024\/05\/Press-Release-State-Election-Board-Refuses-to-Refer-140-Fulton-2020-Violations-to-Attorney-General.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">condemned<\/a> the board for not referring \u201cthe most important case in its history to the Attorney General for investigation and prosecution.\u201d<\/p>\n<p>The SEB previously reprimanded the county after it failed during the 2022 primary to count 1,326 votes. The county fixed the error and the election was \u201crecertified\u201d in June of 2022, <a href=\"https:\/\/www.ajc.com\/politics\/georgia-investigation-finds-fulton-didnt-count-1300-votes-in-22-primary\/URWCNBOM4VHABGH6M62M6X2QQI\/\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a> to the Atlanta Journal-Constitution. <\/p>\n<p>In 2023 the <a href=\"https:\/\/www.ajc.com\/politics\/georgia-investigation-finds-errors-in-fulton-audit-of-2020-election\/BZ7D5JXOMRBPZIU4PNVYIHQZR4\/\" target=\"_blank\" rel=\"noreferrer noopener\">AJC<\/a> reported that during the audit of the 2020 presidential election in Fulton County, there were \u201cseveral cases\u201d in which election workers \u201cmistyped vote totals or allocated votes to the wrong candidate\u201d but that the State Election Board simply \u201cordered Fulton County to \u2018cease and desist\u2019 from violations in future audits, implement new audit procedures and adequately train elections staff.\u201d<\/p>\n<p>Last year, the board unanimously <a href=\"https:\/\/apnews.com\/article\/georgia-elections-fulton-county-state-takeover-945cfa5782b44515ecd4310121bf6b24\" target=\"_blank\" rel=\"noreferrer noopener\">voted<\/a> not to take over elections in Fulton County. <\/p>\n<p>The revelations come four years after the two Republican members of the Fulton County Elections Board at the time did not vote to certify the election.
