The decision followed a \u200clawsuit by \u200dformer Governor Andrew Cuomo against the Commission on Ethics and Lobbying in Government over attempts to have him \u200dforfeit $5 million in book profits.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div data-td-block-uid=\"tdi_78\">\n<p>An appeals court in <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/new-york\/\" target=\"_blank\" rel=\"noopener\" title>New York<\/a> ruled on Thursday that a state commission investigating <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/ethics\/\" target=\"_blank\" rel=\"noopener\" title>ethical <\/a>violations was created unconstitutionally. <\/p>\n<p>This ruling comes from a lawsuit filed by former Gov. <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/andrew-cuomo\/\" target=\"_blank\" rel=\"noopener\" title>Andrew Cuomo<\/a> against the state\u2019s Commission on Ethics and Lobbying in Government; the lawsuit concerned the watchdog agency\u2019s attempt to force him to forfeit $5 million he earned from writing a book about his administration\u2019s efforts during the COVID-19 pandemic. <\/p>\n<p>The watchdog agency asserts that Cuomo broke his promise not to use <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/minnesota-governor-calls-in-national-guard-ahead-of-trial-over-george-floyds-death\/\" title=\"Minnesota Governor Calls In National Guard Ahead Of Trial Over George Floyd\u2019s Death\">state resources<\/a> on the book. Cuomo, who denies the allegations, said that the state constitution does not grant the commission authority to prosecute him.<\/p>\n<p>In a unanimous ruling, the Appellate Division of the state Supreme Court upheld a lower court ruling in favor of Cuomo. Judges wrote that the watchdog agency \u201cthough well intentioned in its actions, violated the bedrock principles of separation of powers.\u201d<\/p>\n<p>The commission was created by the state legislature and then-Lt. Gov. <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/Kathy-Hochul\/\" target=\"_blank\" rel=\"noopener\" title>Kathy Hochul<\/a> in 2022, replacing a previous ethics commission often criticized for not having enough independence.
