Biden confronts three felony\u2064 charges connected to a 2018 firearm acquisition, with allegations of \u200b<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/report-south-korean-police-indict-countrys-first-omicron-patient-for-lying-in-virus-survey\/\" title=\"Report: South Korean Police Indict Country's First Omicron Patient for 'Lying' in Virus Survey\">providing false information<\/a> about\u2064 his drug addiction\u2062 to acquire a revolver.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div data-td-block-uid=\"tdi_78\">\n<p>An appellate court on Thursday denied <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/hunter-biden\" target=\"_blank\" rel=\"noopener\" title>Hunter Biden<\/a>\u2018s requests that his gun charges be dropped, clearing the way for a trial to begin in less than one month.<\/p>\n<p>A three<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-poised-to-reject-democratic-challenge-to-arizona-election-laws\/\" title=\"Supreme Court Poised to Reject Democratic Challenge to Arizona Election Laws\">-judge panel<\/a> in the Third Circuit Court of Appeals did not entertain the merits of Biden\u2019s <a href=\"https:\/\/www.washingtonexaminer.com\/news\/justice\/2970528\/hunter-biden-appeals-courts-after-judges-decline-drop-charges\/\" target=\"_blank\" rel=\"noopener\" title>appeals<\/a> but instead said none of the challenges the first son raised were appealable before the trial, according to a court <a href=\"https:\/\/www.courtlistener.com\/docket\/67511701\/111\/united-states-v-biden\/\" target=\"_blank\" rel=\"noopener\" title>order<\/a>.<\/p>\n<p>Biden will head to court on June 3, for a one-week trial, during which a jury will decide if Biden is guilty of three felonies stemming from a 2018 gun purchase.<\/p>\n<p>Special counsel David Weiss alleged in an indictment last year that Biden lied on a <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/guns\/\" target=\"_blank\" rel=\"noopener\" title>gun<\/a> form about his drug addiction so that he could purchase a revolver.<\/p>\n<p>Weiss said in court filings that federal investigators obtained warrants for Biden\u2019s computer data several years ago and that the data contained messages of Biden admitting to being a <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/drugs\/\" target=\"_blank\" rel=\"noopener\" title>hard drug user<\/a> around the time he purchased the firearm in October 2018.<\/p>\n<p>Weiss also revealed that after Biden was indicted, investigators tested a substance on the revolver, which had been stored in the government\u2019s possession as evidence, and that a test showed the substance was cocaine.<\/p>\n<p>Biden\u2019s attorneys <a href=\"https:\/\/www.washingtonexaminer.com\/news\/2827800\/hunter-biden-unveils-defense-tactics-delaware-gun-case\/\" target=\"_blank\" rel=\"noopener\" title>raised<\/a> numerous challenges to Weiss\u2019s methods to obtaining the evidence, and those fights are still playing out in court. <\/p>\n<p>Biden\u2019s appeals that were just denied centered on his argument that his charges should be dismissed on three separate grounds: that Weiss was not a lawfully appointed special counsel, that a defunct plea deal gave Biden immunity from prosecution, and that the DOJ violated the separation of powers by caving to congressional pressure to prosecute Biden.<\/p>\n<p><strong><a href=\"https:\/\/www.washingtonexaminer.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a><\/strong><\/p>\n<p>Judge Maryellen Noreika denied all three motions, and while the appellate court\u2019s decision allows those denials to stand for now, Biden could still raise new challenges to them after the trial.<\/p>\n<p>Noreika, an appointee of former President <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\/\" target=\"_blank\" rel=\"noopener\" title>Donald Trump<\/a>, has left pending a fourth request from Biden to dismiss his charges based on the argument that they are unconstitutional.
