Sponsored by Democratic Assemblywoman Amy Paulin and Democratic State Senator Mike Gianaris, it was crafted in reaction to the overturning of Harvey Weinstein&#8217;s sex \u200ccrimes conviction by the New York Court of Appeals.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<p>A bill introduced to the <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/new-york\/\" target=\"_blank\" rel=\"noopener\" title>New York<\/a> Assembly will allow prosecutors to use a defendant\u2019s prior <a href=\"https:\/\/www.washingtonexaminer.com\/tag\/sexual-assault\/\" target=\"_blank\" rel=\"noopener\" title>sexual assault<\/a> history to be used as evidence in a sexual assault proceeding, allowing prosecutors to establish a pattern of behavior of a defendant\u2019s \u201cbad acts.\u201d <\/p>\n<p>Sponsored by<a href=\"https:\/\/www.washingtonexaminer.com\/tag\/democrats\/\" target=\"_blank\" rel=\"noopener\" title> Democratic<\/a> Assemblywoman Amy Paulin, who has openly shared her experience as a rape <a href=\"https:\/\/www.lohud.com\/story\/opinion\/contributors\/2017\/01\/10\/any-rape-abomination-amy-paulin\/96391396\/\" target=\"_blank\" rel=\"noopener\" title>survivor<\/a> and Democratic State. Sen. Mike Gianaris, the bill was written in direct response to the overturning of Harvey Weinstein\u2019s sex crimes conviction in New York. In a 4-3 ruling, the New York Court of Appeals\u00a0overturned the Hollywood producer\u2019s charges because the judge allowed women to testify about allegations not included in the case, giving the jury a prejudiced view of Weinstein. <\/p>\n<p>\u201cWhat that decision exposed is that the law required clarity \u2014 nowhere does New York state law answer this question,\u201d Gianaris told CNN. \u201cWe want to make it clear that this should be allowed.\u201d<\/p>\n<p>However, Manhattan prosecutors said they intend to retry Weinstein in the case this year. Weinstein, who was also convicted and sentenced to 16 years in prison in California,\u00a0was recently <a href=\"https:\/\/www.cnn.com\/2024\/04\/25\/us\/harvey-weinstein-conviction-overturned-appeal\/index.html\" target=\"_blank\" rel=\"noopener\" title>transferred to the Bellevue Hospital Prison Ward<\/a>. Similarly, the California prosecutors used\u00a0 \u201cprior bad acts\u201d as witnesses.
