Several new pieces of evidence indicate it\u2019s even possible federal employees planted classified documents to frame Trump. <\/p>\n<p>Even if what happened isn\u2019t that nefarious \u2014 although exactly that scenario has already been deployed against Trump several times \u2014 not only could the case be thrown out of court, but some federal lawyers may have risked their licenses for mishandling evidence. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1116077600\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-2e0bd7aee023b5a94997114c7e8e9c3e fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-2e0bd7aee023b5a94997114c7e8e9c3e\"><\/div>\n<p>As time goes on, the lawfare cases are looking increasingly like coverups of government attempts to imprison Democrats\u2019 top political opponent by framing him with crimes he didn\u2019t do. It\u2019s yet another indication the federal government is using the U.S. legal system to serve extremist partisans instead of justice, destroying equality before the law.<\/p>\n<h2 class=\"wp-block-heading\">Did the Feds Plant the Classified Documents that Prompted This Case?<\/h2>\n<p>Recent court disclosures give two indications that federal employees could have planted the classified documents used to mire Trump and several aides into a sprawling investigation and an election-interfering court case. The first is the explosive evidence revealed Friday: For 11 months, the special counsel\u2019s office hid that it misplaced some \u2014 we don\u2019t know how many or which \u2014 of the same <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-spy-chief-on-allegedly-classified-documents-virtually-impossible-to-prosecute\/\" title=\"Trump Spy Chief on Allegedly Classified Documents: \"Virtually Impossible\" to Prosecute\">allegedly classified documents<\/a> it claims Trump criminally possessed at Mar-a-Lago.<\/p>\n<p>In that news-dump-timed <a href=\"https:\/\/www.courtlistener.com\/docket\/67490070\/522\/united-states-v-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">filing<\/a> Friday afternoon, the special counsel\u2019s office revealed that when federal agents took boxes of papers from Trump\u2019s home in an unprecedented FBI raid, they took out what they thought might be classified documents the president allegedly was not allowed to possess. They say they marked these documents\u2019 original location in the boxes with \u201cplaceholder\u201d sheets of paper marked for an inventory. <\/p>\n<p>Yet after these boxes were removed to the FBI\u2019s Washington field office for further inspection, the special counsel says, they discovered the boxes were not in the same state as when they were seized at Mar-a-Lago. When attempting to piece the boxes back together, the special counsel\u2019s office said, \u201cIn many <strong>but not all instances<\/strong>, the FBI was able to determine which document with classification markings corresponded to a particular placeholder sheet\u201d (emphasis added). <\/p>\n<div class=\"fdrlst__b89e9-1aa2c4cfb15b2a3d3b6130185af8fb3d fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-1aa2c4cfb15b2a3d3b6130185af8fb3d\"><\/div>\n<p>The filing also says the FBI \u201cgenerally\u201d inserted the \u201chandwritten sheets,\u201d indicating <em>there were exceptions<\/em> to its use of placeholders to indicate the allegedly original locations of allegedly classified documents Trump allegedly criminally possessed. In a footnote, the special counsel writes that this situation is \u201cinconsistent with what Government counsel previously understood and represented to the Court.\u201d In other words, the special counsel has been lying to the court, the public, and the Trump legal team this whole time about the evidence grounding its entire case. <\/p>\n<p>If they didn\u2019t always use placeholders to mark moved documents and don\u2019t know what documents some placeholders correspond to, some documents could be missing \u2014 or added. If there is no reliable and provable inventory of the seized document boxes, how can anyone trust the boxes accurately represent what Trump had? The DOJ <em>admits <\/em>the boxes were tampered with and are not in their original condition!<\/p>\n<p>Second, there\u2019s the <em>also <\/em>newly uncovered fact that <a href=\"https:\/\/thefederalist.com\/2024\/04\/30\/federal-agency-had-pallets-of-documents-sent-to-mar-a-lago-one-year-before-doj-raid\/\" target=\"_blank\" rel=\"noreferrer noopener\">a federal agency sent<\/a> \u201ctwo pallets\u201d of documents to Mar-a-Lago <em>while <\/em>the National Archives and Records Administration was setting up this documents case. It\u2019s unknown who all had access to these document boxes during their packing, temporary storage in Virginia, and transit to Trump\u2019s home. Were those boxes a setup too? Imagine if some boxes the feds sent amid NARA\u2019s dispute with Trump were also boxes the DOJ can\u2019t verify as being in their original state.<\/p>\n<h2 class=\"wp-block-heading\">Potential Consequences: Tossing Case, Punishing Lawyers<\/h2>\n<p>In a May 4 <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.648653\/gov.uscourts.flsd.648653.529.1.pdf\">letter<\/a>, Trump\u2019s defense argues the document-tampering corrupts the special counsel\u2019s entire case: \u201c[I]t was our understanding that most, and potentially all, of the charged documents were buried within the boxes and located next to other items that provided favorable context.\u201d Corrupting any allegedly classified documents at issue in this case, they say, eliminates legal defense possibilities, making this case moot.<\/p>\n<div class=\"fdrlst__b89e9-bbff902905f91cd70fc3e7f41285f4be fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-bbff902905f91cd70fc3e7f41285f4be\"><\/div>\n<p>\u201cThe theory behind spoliation inference is that when a party has destroyed evidence, it shows that the party had consciousness of guilt or other reasons to avoid evidence.\u00a0Hence, the court will conclude that the evidence was not in spoliator\u2019s favor,\u201d <a href=\"https:\/\/civilprocedure.uslegal.com\/discovery\/spoliation-of-evidence\/\" target=\"_blank\" rel=\"noreferrer noopener\">says USlegal.com<\/a>. <\/p>\n<p>Spoilation <a href=\"https:\/\/content.next.westlaw.com\/practical-law\/document\/I0fa034abef0811e28578f7ccc38dcbee\/Spoliation?viewType=FullText&#038;contextData=%28sc.Default%29&#038;transitionType=Default\" target=\"_blank\" rel=\"noreferrer noopener\">is not only<\/a> a federal crime, but it risks the licenses of any lawyers who do it, as it violates the American Bar Association\u2019s codes of conduct. Sanctions for spoilation include lawsuits against those alleged to have committed it and dismissing affected cases. That would be especially appropriate here, as the entire case rests on documents the DOJ has admittedly tampered with.<\/p>\n<h2 class=\"wp-block-heading\">Biden\u2019s White House Helped Instigate Classified Docs Lawfare<\/h2>\n<p>We also learned just last week that the White House and Department of Justice lawyers colluded with NARA to develop what became the special counsel\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/donald-trump-arrested-pence-hits-former-president-over-classified-documents-indictment\/\" title=\"Trump arrested, Pence criticizes him for classified documents indictment.\">classified documents indictment<\/a>, starting an <em>entire year<\/em> before the FBI raid on Mar-a-Lago, <a href=\"https:\/\/www.realclearinvestigations.com\/articles\/2024\/05\/02\/unredactions_reveal_early_white_house_involvement_in_trump_documents_case_1028630.html\">according <\/a>to documents reviewed by reporter Julie Kelly. Just the News <a href=\"https:\/\/justthenews.com\/government\/federal-agencies\/records-show-archives-official-met-biden-wh-counsel-day-indictment\" target=\"_blank\" rel=\"noreferrer noopener\">reports<\/a> the collusion between NARA and the White House could have begun as early as a few weeks into the Biden presidency, according to White House visitor logs.<\/p>\n<p>So of course the classified documents case didn\u2019t arise from concern over legal improprieties, as the complete lack of prosecution for the same conduct from Joe Biden, Mike Pence, Hillary Clinton, James Comey, and DOJ leakers also proves. It was a political hit from the beginning, using federal agencies and resources to strangle Democrats\u2019 top political opponent and override the votes of half the country. Talk about an insurrection.<\/p>\n<p>The current lawfare cases against Trump are as legally and morally defensible as impeaching him over a Democrat smear operation falsely labeling him a Russian spy. Yet multiple media have claimed the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-pushes-court-to-hold-trump-team-in-contempt-in-classified-docs-case-report\/\" title=\"DOJ Pushes Court To Hold Trump Team In Contempt In Classified Docs Case: Report\">classified docs case<\/a> is the \u201cstrongest\u201d of the five (<a href=\"https:\/\/www.nbcnews.com\/politics\/politics-news\/trump-unindicted-co-conspirators-effort-overturn-2020-election-michiga-rcna149248\">or<\/a> <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/elections\/2024\/04\/25\/donald-trump-unindicted-co-conspirator-arizona-fake-elector-case\/73450272007\/\">seven<\/a>)<strong> <\/strong>attempting to bankrupt and jail Trump so Republicans can\u2019t win the presidency. Outlets describing this case that way include <a href=\"https:\/\/slate.com\/news-and-politics\/2023\/07\/trump-indictment-legal-case-which-is-strongest.html\">Slate<\/a>, <a href=\"https:\/\/reason.com\/2024\/02\/26\/4-reasons-trump-says-a-judge-should-dismiss-charges-in-the-classified-documents-case\/\" target=\"_blank\" rel=\"noreferrer noopener\">Reason<\/a>, <a href=\"https:\/\/www.nytimes.com\/article\/trump-cases-counts-charges-strengths.html\" target=\"_blank\" rel=\"noreferrer noopener\">The New York Times<\/a>, <a href=\"https:\/\/www.bbc.com\/news\/world-us-canada-66404233\" target=\"_blank\" rel=\"noreferrer noopener\">BBC<\/a>, <a href=\"https:\/\/thehill.com\/homenews\/senate\/4639872-democrats-alarmed-over-conservative-judges-in-trump-court-cases\/\" target=\"_blank\" rel=\"noreferrer noopener\">The Hill<\/a>, <a href=\"https:\/\/www.ft.com\/content\/e9b4e5a9-4676-4f07-b051-a4b95cc19afc\" target=\"_blank\" rel=\"noreferrer noopener\">Financial Times<\/a>, <a href=\"https:\/\/www.wsj.com\/podcasts\/whats-news\/trump-charged-over-retention-of-classified-documents\/b75c43f4-528b-4590-92f5-5843dcb4261e\" target=\"_blank\" rel=\"noreferrer noopener\">The Wall Street Journal<\/a>, and <a href=\"https:\/\/newrepublic.com\/post\/173620\/rump-is-scared-shitless\" target=\"_blank\" rel=\"noreferrer noopener\">The New Republic<\/a>.<\/p>\n<h2 class=\"wp-block-heading\">The \u2018Strongest\u2019 Case Is a Setup<\/h2>\n<p>The case \u201cis absolutely airtight,\u201d a Georgia State professor <a href=\"https:\/\/www.bbc.com\/news\/world-us-canada-66404233\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a> the BBC. The Wall Street Journal <a href=\"https:\/\/www.wsj.com\/articles\/the-federal-case-against-trump-on-the-mar-a-lago-documents-12054f5\">described <\/a>the case as \u201cserious\u201d and contrasted Trump\u2019s allegedly \u201cwillful\u201d retention of classified documents with Hillary Clinton\u2019s \u2014 accidental? \u2014 illegal <a href=\"https:\/\/www.nationalreview.com\/2015\/03\/hillarys-specious-arguments-about-her-e-mail-andrew-c-mccarthy\/\">use of a private server<\/a> containing classified documents. National Review Editor Ramesh Ponnuru <a href=\"https:\/\/www.washingtonpost.com\/opinions\/2024\/04\/23\/trump-trials-political-persecution-fault\/\" target=\"_blank\" rel=\"noreferrer noopener\">called <\/a>the classified docs case \u201cthe most solid case against Trump.\u201d<\/p>\n<p>Really? These are the same agencies that willingly laundered Russian disinformation from Democrats\u2019 presidential candidate through the DOJ and FBI with Spygate, affecting now three election cycles. They\u2019re the same people who lied about Ukraine to protect Biden corruption with a defensive impeachment of Trump, and whose intel agency heads lied their heads off claiming Hunter Biden\u2019s laptop was \u201cRussian disinformation.\u201d<\/p>\n<p>They\u2019re the same people who lied to a secret court to spy on Trump\u2019s campaign after apparently setting up a volunteer through dodgy intel contacts. They\u2019re the same people who amped up the \u201cRussia, Russia!\u201d narrative by arranging a meeting between a Russian lawyer and Don Trump Jr. that he thought was a waste of his time but sure made a strong smear-by-association news cycle.<\/p>\n<p>Steven D\u2019Antuono, the guy running the Washington field office when it tampered with the documents in Trump\u2019s case, is the <a href=\"https:\/\/twitter.com\/julie_kelly2\/status\/1788201623266730411\">same guy<\/a> who oversaw the FBI entrapment of a bunch of shiftless dudes into a hoax kidnapping \u201cconspiracy\u201d against Michigan Gov. Gretchen Whitmer.
