The scrutiny over \u200bBiden&#8217;s varied views on abortion has brought focus to how this\u200d may affect his backing from pro-choice supporters and the strategic direction of \u200bhis campaign.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<header> <a href=\"https:\/\/www.westernjournal.com\/commentary\/\">  Commentary <\/a>   <span> <\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/author\/aaltomari\/\">  <\/a> <\/p>\n<p> <span>   By <a href=\"https:\/\/www.westernjournal.com\/author\/aaltomari\/%20\"><span>Anthony Altomari<\/span><\/a> <\/span> <span>   May 8, 2024 at 8:35am <\/span> <\/span>  <\/header>\n<section>\n<p>CNN\u2019s Jake Tapper called out President Joe Biden\u2019s ever-changing position on the issue of abortion.<\/p>\n<p>In an <a href=\"https:\/\/edition.cnn.com\/videos\/politics\/2024\/05\/05\/sotu-landrieu-on-abortion.cnn\" target=\"_blank\" rel=\"noopener\">interview<\/a> that aired Sunday with Biden campaign co-chair Mitch Landrieu, Tapper questioned whether Biden\u2019s shifting stance on abortion over his political career will be harmful to his campaign.<\/p>\n<p>Tapper characterized Biden\u2019s position on abortion as \u201call over the map\u201d and asked whether it undermines support from him from pro-choice advocates.<\/p>\n<p>\u201cDo you think his own long, complicated history on this issue \u2014 do you think it muddies his message, and undermines the contrast with Donald Trump?\u201d Tapper asked.<\/p>\n<p>Landrieu at first criticized how Trump has handled the abortion issue, but then explained how Biden\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/i-was-ambivalently-pro-choice-then-i-learned-a-harsh-truth\/\" title=\"I Was Ambivalently Pro Choice. Then I Learned A Harsh Truth.\">pro-choice stance<\/a> is stronger than ever.<\/p>\n<p>\u201cSince his presidency, he has been very strong in his support of a very simple notion: that he trusts women to make decisions about their reproductive health,\u201d Landrieu said.<\/p>\n<p>To Tapper\u2019s point, Biden\u2019s position on <a href=\"https:\/\/www.westernjournal.com\/judge-hands-ny-democrats-massive-loss-axes-abortion-rights-measure\/\" target=\"_blank\" rel=\"noopener\">abortion<\/a> has been inconsistent throughout his career.<\/p>\n<p>In 1974, then freshman Senator Biden said that he didn\u2019t like the Supreme Court\u2019s decision on abortion.<\/p>\n<p>\u201cI think it went too far. I don\u2019t think that a woman has the sole right to say what should happen to her body,\u201d the Washingtonian <a href=\"https:\/\/www.washingtonian.com\/1974\/06\/01\/joe-biden-kitty-kelley-1974-profile-death-and-the-all-american-boy\/\" target=\"_blank\" rel=\"noopener\">reported<\/a> in 1974.<\/p>\n<div id=\"firefly-poll-container\">\n<p>Do you believe abortion is murder?<\/p>\n<\/p><\/div>\n<p>In 2006, Biden called himself \u201cthe odd man out\u201d in the Democratic Paty on the abortion issue, according to <a href=\"https:\/\/www.cnn.com\/2019\/06\/13\/politics\/joe-biden-abortion\/index.html\" target=\"_blank\" rel=\"noopener\">CNN<\/a>.<\/p>\n<p>\u201cI do not view abortion as a choice and a right. I think it\u2019s always a tragedy, and I think that it should be rare and safe, and I think we should be focusing on how to limit the number of abortions.\u2019 Biden said.<\/p>\n<p>Just this year, <a href=\"https:\/\/www.westernjournal.com\/israeli-officials-say-got-played-biden-administration-hamas-cease-fire-talks\/\" target=\"_blank\" rel=\"noopener\">Biden<\/a> said that he\u2019s \u201cnever been supportive of, you know, \u2018It\u2019s my body, I can do what I want with it,\u201d the New Yorker <a href=\"https:\/\/www.newyorker.com\/magazine\/2024\/03\/11\/joe-biden-profile\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<p>Yet, since his inauguration in 2021, Biden has been anything but a sideline spectator on the issue.<\/p>\n<p>In July 2022, just a few weeks after the Supreme Court overturned Roe v. Wade, Biden signed an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/republican-led-states-sue-biden-admin-over-expansive-climate-order-targeting-trump-legacy\/\" title=\"Republican-Led States Sue Biden Admin Over Expansive Climate Order Targeting Trump Legacy\">executive order aimed<\/a> at protecting access to abortion services.<\/p>\n<p>CNN <a href=\"https:\/\/www.cnn.com\/2022\/07\/08\/politics\/what-is-in-biden-abortion-executive-order\/index.html\" target=\"_blank\" rel=\"noopener\">reported<\/a> that the \u201cexecutive order attempts to safeguard access to medication abortion and emergency contraception, protect patient privacy, launch public education efforts as well as bolster the security of and the legal options available to those seeking and providing abortion services.\u201d<\/p>\n<p>In June 2023, Biden denounced abortion restrictions in Republican-governed states, arguing that the states were depriving women of \u201cbasic health care,\u201d <a href=\"https:\/\/www.nytimes.com\/2023\/06\/23\/us\/politics\/biden-abortion.html\" target=\"_blank\" rel=\"noopener\">according<\/a> to the New York Times.<\/p>\n<blockquote>\n<p dir=\"ltr\" lang=\"en\">\u201cIn his 50+ years in politics \u2026 Biden has been all over the map on abortion,\u201d says CNN\u2019s Jake Tapper.<\/p>\n<p>\u2014 \u201cIn \u201974, he said Roe v. Wade went too far, and that a woman should not have \u2018the sole right to say what should happen to her body.&#8217;\u201d<\/p>\n<p>\u2014 \u201cIn 2006, he said, \u2018I do not view\u2026 <a href=\"https:\/\/t.co\/uad5XSziwI\">pic.twitter.com\/uad5XSziwI<\/a><\/p>\n<p>\u2014 RNC Research (@RNCResearch) <a href=\"https:\/\/twitter.com\/RNCResearch\/status\/1787175243095663090?\">May 5, 2024<\/a><\/p>\n<\/blockquote>\n<p>Just this year, in his <a href=\"https:\/\/www.westernjournal.com\/ouch-instead-state-union-bump-biden-getting-opposite\/\" target=\"_blank\" rel=\"noopener\">State of the Union address<\/a>, Biden said, \u201cif you, the American people, send me a Congress that supports the right to choose, I promise you I will restore Roe v. Wade as the law of the land again,\u201d <a href=\"https:\/\/www.huffpost.com\/entry\/biden-confronts-scotus-justices-directly-on-abortion-during-state-of-the-union_n_65ea82ffe4b024897f7c19fe\" target=\"_blank\" rel=\"noopener\">Huffpost<\/a> reported.<\/p>\n<p>It seems like Biden\u2019s position on abortion corresponds to that of his base. Instead of having an independent opinion based on what he believes, he\u2019s believing what he thinks will get him elected.<\/p>\n<p>Tapper is right to bring up Biden\u2019s tepidity on the issue. There is perhaps no issue that Biden has flipped back and forth over in his career more than abortion.<\/p>\n<p>What Biden represents is an opinion that is often held on the left, particularly among left-leaning legal scholars: the idea that codified laws are living, constantly evolving instruments.<\/p>\n<p>It\u2019s in stark contrast to the position taken by the mainstream right, who take an originalist perspective on laws. They argue, <a href=\"https:\/\/constitutioncenter.org\/the-constitution\/white-papers\/on-originalism-in-constitutional-interpretation\" target=\"_blank\" rel=\"noopener\">according<\/a> to the National Constitution Center, that laws should be interpreted with the understanding of those who wrote them, not those who are reading them.<\/p>\n<p>The idea of the left is that the <a href=\"https:\/\/www.westernjournal.com\/biden-administration-announces-new-gun-control-measures-republicans-slam-unconstitutional\/\" target=\"_blank\" rel=\"noopener\">U.S. Constitution<\/a> should change over time to accommodate how society\u2019s view on key issues changes.\u00a0 This all happens without any sort of formal amendment process, and is instead implemented by enlightened members of the judiciary.<\/p>\n<p>As many people are aware, the Constitution makes no mention of abortion in its text.\u00a0 Rather, the theory of the \u201cliving constitution\u201d was utilized by the Supreme Court to permit them to bring the Constitution into the modern age.<\/p>\n<p>David Strauss, a professor of law at the University of Chicago Law School, <a href=\"https:\/\/www.law.uchicago.edu\/news\/living-constitution\" target=\"_blank\" rel=\"noopener\">defined<\/a> a living constitution as \u201cone that evolves, changes over time, and adapts to new circumstances, without being formally amended.\u201d<\/p>\n<p>This idea that the Constitution can change over time and adapt to new circumstances has been the foundation of Supreme Court decisions that have written rights into the Constitution based on what the Court wants it to say.<\/p>\n<p>This philosophy is concerning, to say the least.<\/p>\n<p>For the left and \u201cliving constitutionalists,\u201d no constitutional right is safe.\u00a0 To them, the government is the arbiter of what rights should and should not be guaranteed.<\/p>\n<p>To them, the law is subject to their will.\u00a0 If a provision of the law is disharmonious with their will, they will simply change it.<\/p>\n<p>The core issue with that philosophy is, at the end of the day, the letter of the law means nothing more than what judges think it ought to mean, irrespective of what it says.<\/p>\n<p>That\u2019s why overturning Roe v. Wade was the correct jurisprudential decision, even if it was not popular.\u00a0 Nothing in the Constitution guarantees anyone the right to have an abortion.<\/p>\n<p>The Constitution was founded on the principle that there are some rights so sacred, so worth protecting, that citizens can only be deprived of them when <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/brooklyn-center-city-manager-fired-after-calling-for-due-process-in-duane-wright-shooting\/\" title=\"Brooklyn Center City Manager Fired After Calling For Due Process In Duane Wright Shooting\">afforded due process<\/a>.<\/p>\n<p>And no right is greater than that of the <a href=\"https:\/\/www.westernjournal.com\/pro-life-groups-hit-back-new-york-ag-letitia-james-court-allege-unfair-witch-hunt\/\" target=\"_blank\" rel=\"noopener\">right to life<\/a>.\u00a0 Unlike the left, many on the right believe that rights come from God, not government, and that they cannot be changed just because some judges feel like they should.<\/p>\n<p>That\u2019s why conservatives have so <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/republican-senate-candidates-start-to-shift-on-key-plank-that-has-haunted-last-two-cycles\/\" title=\"Republican Senate candidates are beginning to change their stance on a crucial issue that has plagued the past two election cycles\">consistently opposed abortion<\/a>. Sure, you can deprive someone of life with due process.\u00a0 But how can you give a baby in the womb due process?<\/p>\n<p>The left and right can, and do, disagree on many issues. From immigration and taxes to welfare and energy, all of these debates have their place.<\/p>\n<p>But when it comes to abortion, and the deprivation of the right to life, this is something that we really should all be able to agree on. After all, if we don\u2019t protect the right to life of innocent children, what is worth protecting?<\/p>\n<p>Does any other issue matter if we can kill our most vulnerable citizens?<\/p>\n<hr>\n<div>\n<p><b><i>A Note from Our Deputy Managing Editor:<\/i><\/b><\/p>\n<p><i><span>I heard a chilling comment the other day: \u201cWe don\u2019t even know if an election will be held in 2024.\u201d <\/span><\/i><\/p>\n<p><i><span>That wasn\u2019t said by a conspiracy theorist or a doomsday prophet.
