State Supreme Court Justice \u200bDaniel Doyle ruled that the state \u2062legislature failed to\u2064 follow \u2062the correct procedure for passing a\u2063 ballot measure. \u200cThis ruling \u2062disrupts Democrats&#8217; 2024 election strategy aimed at expanding control of the state&#8217;s legislative\u2062 chamber. \u200cThe fraudulent abortion amendment \u2064to the New York Constitution hits a \u2062roadblock. This ruling hampers the Democrats&#8217; 2024 election \u200cagenda to secure control of the state&#8217;s legislative body.  <\/p>\n<p class=\"readmore\">\n    <button onclick=\"showReadMore()\" id=\"readmorebtn\">Read more&#8230;<\/button>\n<\/p>\n<hr id=\"line\">\n<span id=\"more\"><\/p>\n<div>\n<div>\n<figure>\n<p>         <span>Image Credit<\/span>FDRLST\/Canva       <\/p>\n<\/figure><\/div>\n<p>Democrats and activists who sought to enshrine abortion in the New York Constitution with the ratification of a deceptively worded amendment face a new obstacle after State Supreme Court Justice Daniel Doyle <a href=\"https:\/\/iapps.courts.state.ny.us\/nyscef\/ViewDocument?docIndex=BCfdWv_PLUS_L2PqNXxyimddw\/g==\" target=\"_blank\" rel=\"noreferrer noopener\">ruled<\/a> that the state legislature failed to adequately satisfy the constitutionally outlined procedure for passing a ballot measure. <\/p>\n<p>\u201cThe constitution is the supreme will of the people,\u201d he <a href=\"https:\/\/thehill.com\/policy\/healthcare\/4649908-new-york-abortion-related-equal-rights-amendment-state-ballot-judge-tosses\/\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>. \u201cIts amendment should be undertaken by strict adherence to the will of the people.\u201d <\/p>\n<p>New York requires the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/new-york-sues-amazon-over-alleged-worker-exploitation-amid-pandemic\/\" title=\"New York Sues Amazon Over Alleged Worker \u2018Exploitation\u2019 Amid Pandemic\">state attorney general\u2019<\/a>s office to issue a formal opinion about the amendment before the legislature fulfills its mandated two-time passage. State Assembly Member Marjorie Byrnes, a Republican, filed a lawsuit noting that New York Attorney General Letitia James\u2019 formal opinion on the ballot measure did not come until after the rushed first vote.<\/p>\n<p>\u201c\u2018Substantial compliance\u2019 is not compliance, and this court cannot condone actions taken by the Legislature in derogation of the expressed will of the people,\u201d Doyle agreed, waving off Democrats\u2019 excuses for the procedural flop. <\/p>\n<p>Doyle\u2019s smackdown is one of the first actions a court has taken against the <a href=\"https:\/\/thefederalist.com\/2024\/05\/03\/every-state-facing-deceptive-unlimited-abortion-ballot-measures-this-november\/\" target=\"_blank\" rel=\"noreferrer noopener\">several abortion-themed ballot measures<\/a> facing voters in various states this fall. <a href=\"https:\/\/www.politico.com\/news\/2024\/05\/07\/equal-right-amendment-era-new-york-00156521\" target=\"_blank\" rel=\"noreferrer noopener\">Corporate<\/a> <a href=\"https:\/\/apnews.com\/article\/abortion-new-york-amendment-election-2024-4d3815708ef78c11599e1ebbb35ef896\" target=\"_blank\" rel=\"noreferrer noopener\">media<\/a> <a href=\"https:\/\/www.nytimes.com\/2023\/06\/29\/nyregion\/equal-rights-amendment-ny.html\" target=\"_blank\" rel=\"noreferrer noopener\">readily admit<\/a> that the ruling throws a wrench in New York Democrats\u2019 expensive 2024 election strategy to increase turnout in the battleground race for control of the state\u2019s lower legislative chamber.<\/p>\n<p>New York already ensures <a href=\"https:\/\/ag.ny.gov\/publications\/abortion-legal-and-protected-new-york-state\" target=\"_blank\" rel=\"noreferrer noopener\">unlimited, on-demand abortion<\/a> through the subjective judgment of a medical professional who only needs to deem the mother\u2019s life or physical or mental health at risk to greenlight abortion at any point in gestation. The ill-named <a href=\"https:\/\/www.nyclu.org\/en\/press-releases\/equal-rights-amendment-advances-new-york-voters-november-2024\" target=\"_blank\" rel=\"noreferrer noopener\">Equal Rights Amendment (ERA)<\/a>, however, sought to effectively prevent the government from enacting limits on baby-killing in the future. <\/p>\n<p>The proposed amendment also included a barrage of sweeping language and terms such as \u201cdiscrimination\u201d that would equip the New York Constitution with a <a href=\"https:\/\/www.nysenate.gov\/legislation\/bills\/2023\/S108\/amendment\/A\" target=\"_blank\" rel=\"noreferrer noopener\">\u201ccivil right\u201d<\/a>  allowing men to play women\u2019s sports. Proponents of the ballot measure even <a href=\"https:\/\/www.nyclu.org\/press-release\/equal-rights-amendment-advances-new-york-voters-november-2024\" target=\"_blank\" rel=\"noreferrer noopener\">bragged<\/a> that the amendment could stop the state from banning things like transgender mutilation and chemical castration for children.<\/p>\n<p>\u201cThe ERA \u2026 would prohibit discrimination by the government based on a person\u2019s ethnicity, national origin, age, disability, and sex \u2014 including their sexual orientation, gender identity, gender expression, pregnancy and pregnancy outcomes,\u201d the ACLU of New York <a href=\"https:\/\/www.nyclu.org\/press-release\/equal-rights-amendment-advances-new-york-voters-november-2024\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>. \u201cIt would also protect against any government actions that would curtail a person\u2019s reproductive autonomy or their access to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/planned-parenthood-sues-after-south-carolina-governor-signs-heartbeat-bill\/\" title=\"Planned Parenthood Sues After South Carolina Governor Signs \u2018Heartbeat\u2019 Bill\">reproductive health care<\/a>.\u201d<\/p>\n<p>As <a href=\"https:\/\/www.foxnews.com\/politics\/ny-ballot-initiative-could-ban-parents-approving-childs-trans-surgery-critics-warn-fiery-campaign\" target=\"_blank\" rel=\"noreferrer noopener\">conservative groups<\/a> around the state have <a href=\"https:\/\/www.instagram.com\/p\/C6rF0T3OwcM\/?igsh=MWN1OHJlMTFoZzVwMA%3D%3D\" target=\"_blank\" rel=\"noreferrer noopener\">repeatedly noted<\/a>, those \u201coutrageous and unconstitutional\u201d provisions infringe on parents\u2019 rights.<\/p>\n<p>James <a href=\"https:\/\/x.com\/NewYorkStateAG\/status\/1787887912895316019\" target=\"_blank\" rel=\"noreferrer noopener\">said she<\/a> plans to appeal the ruling. <\/p>\n<p>\u201cThe Equal Rights Amendment was advanced to protect people\u2019s fundamental rights like reproductive freedom and access to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/study-medicaid-data-casts-significant-doubt-on-abortion-as-essential-for-birth-spacing\/\" title=\"Study: Medicaid Data Casts Significant Doubt On Abortion As \u2018Essential\u2019 For Birth Spacing\">abortion care<\/a>.
